  1. I am really curious to know if this works too. I have been wondering why a few of us have had problems when sending only the email for the choice of agent - even if it is sent from an email NVC has on file. This issue does seem to be specific to IR2 cases.I'm really hoping it was just a fluke and that you and Serenity will be able to get through with the W's. Especially if you're not worried about breezing through NVC I think it's worth trying. We had our tax stuff ready to go just in case so I think getting the W rejected and then sending in the I-864 cost us about 2 weeks.

    Nah, we've lost enough time with USCIS, so Im probably going to just go with 864. I will try to wait until school ends before she immigrates, but given Grandma'a health issue, I want her to be ready asap.

    lucy4, i only scanned over the ds230 but i thought the part for them to sign said to wait and fill out at the embassy?? i will look at it again

    I have to look again, Im not too sure either but I thought you signed part 1, and waited to sign part 2. I vaguely remember that from the K1 days.

  2. My husband is the petitioner since he became a citizen before we decided to bring his kid here. I am in the stepchild threads because my husband would never in a million years spend as much time as I have reading through all these threads and gathering all the information! So despite the fact that he is the petitioner, I filled out all the forms and made all the lists of documents AND I made myself the "agent" with NVC :)

    I found out about all this I-864W stuff through beejay etc.s posts way back in this thread (I actually read through every single post one weekend in January.) I wonder if I would have even known about that option if this forum didn't exist...

    Although I am pretty sure that my stepson qualifies for the waiver, I would NOT be surprised if the embassy asks for tax transcripts anyway based on previous experience with them - so we will be ordering the tax transcripts for the interview just to be safe rather than trying to order them from there. Imagine.

    Ok, no problem. I wasnt questioning why you were here, the issue just piqued my interest because Im in the exact same boat. Only difference is, I submitted the form a few weeks before he had his oath ceremony. Who knew I probably would have been approved a long time ago if I had waited? I found out about the W form from beejay as well (isnt she great?) but then I dont think her form was accepted since she wasnt the immediate parent. So chances are that although my husband is a citizen, since he wasnt the filer, we wont be able to use a W form. I ordered my transcripts yesterday though.

  3. Yeah, I don't know if there is an official age when children can sign for themselves? (if there is, I'll add this info to the wiki page). A small child, for sure would not be expected to sign for themselves. On the I-864W (we will be sending this, since my husband is a US citizen now, and his child is less than 18) it specifically says if the child is over 14, he or she has to sign it themselves.

    But now I'm not sure about the other forms, if the rule is 14+? My husband's kid is 16, so we had him sign everything... guess we'll find out if the forms are accepted or not!

    Looks like at least three of us will have late spring/summer interviews!!!!!!

    Lucy4 - it took us about a month to get the case and Invoice Identification numbers for NVC. I didn't pay attention to how long it took to invoice for AOS though. If you have all the documents ready, once you have the numbers, you should theoretically be able to finish the process in around two-three weeks, assuming the invoices come quickly, you pay ASAP, then they take a couple of days to process the invoice, a couple of days to receive your forms and documents in the mail ...

    I sent the Choice of Agent e-mail - from my stepson's e-mail account, which NVC has no record of yet, so we'll see if that works! - and paid the AOS fee today. I'll come back and post about how long those took to be accepted.

    Serenity, you just opened another question, are you the petitioner or your husband? If you are the petitioner, wouldnt you have I864? I think beejay explained before that I864W would only be accepted if the child's citizen parent is the petitioner. Let me know if it works for you, because I'd much rather file the W than the regular form.

    My stepchild is 13, so Im gonna have her father sign everything.

  4. CONGRATS!! i know its a relief to be at NVC..

    i am there too, for a little while anyway.. we just paid the IV bill and am sending documents today!

    I am doing like Serenity and taking my time because we also want a summer interview, therefore i didnt send Ds3032 by email, we sent it by snailmail and my husband signed it

    i saw that others put "father of minor child" or something like that and thats what we did without any issue!!

    Thanks Quana. Are you doing that with the 230 as well? signing as father of minor child?

  5. YAAAAAAAAAAAAY! I was wondering about your case...

    You will catch up to us at NVC, as we are dragging our feet now. I have all the documents ready to go, but we are trying to get an early summer-ish interview so we don't have to make two trips back and forth for interview AND to bring the kid. He can't leave until nearly July because of school.

    Since time is not a huge concern to us at the moment, I am going to send the choice of agent e-mail (from stepson's account) WITHOUT the actual DS-3032 form attached to see if it works. Some people have said that the form must be attached to a minor's application (for sure it is not required for spouse applications). I am doing the test to find out if it is true or not.

    Yay! Thanks Serenity. Im looking forward to having company at the NVC. I feel like everyone else in here is either done or at least at the Embassy.

    Question about the DS3032. I had planned on just sending the email as well, but I guess Ill have to attach the form. With a minor though, does the forms need to be signed by the minor. I plan on having her father sign everything including the DS230, as a representative for her since shes a minor. I was planning on sending the DS3032 from either my own or his email address.

    No good news, but there is some movement on my case today. The call was the senators office asking me for a copy of my NOA1. Not sure if that means they put a call in and needed more info, or if they were just about to start researching the case. However, this morning I received a text and email update from USCIS saying that my name changed. When I followed up with them, they assured me that it was just a touch and my case is with the adjudicator now. So I guess thats good news today.

  7. Congrats! I feel that today is my day. Im gonna report my NOA2 later yall.

    I posted this yesterday, but I think my spidey sense was a little off... today is gonna be my day. I just received an email and text saying my case was updated. When I checked it said my name was updated, and I'm still on Initial Review. I called USCIS and was transferred to a Tier 2 rep, she assured me that the name update was an error just meaning that it was touched, and the case is with an adjudicator being decided right now. I guess its the same as the alien number change updates. So hopefully ill have an approval today. :)

    anyway, my husband file i 130 for my son last oct,,us citizen petition for step child. Now we are still waiting for NOA2.

    I applied for Us citizen 2 weeks ago, and already did my biometrics... When the time comes that i become us citizen assuming crossing fingers ill have my interview in june or july,

    So if i become a citizen is my son automatically becom us citizen too?Hes under 18.

    "I am under 18, unmarried, immigrating as the child of a U.S. citizen, and will automatically become a U.S. citizen under the Child Citizenship Act of 2000 upon my admission to the United States."--- is this applyto my son..? Granting that im already a Us citizen by the time Uscis get around of approving the I130, coz it seems like they are very slow, 5 months waiting for noa2 and when i call them they said that csc processing is 7 months???

    Im actually confuse?

    If you become a citizen, your minor child will too, once s/he is living here in the country with you.

    I just missed a call on my phone from my Senator's office, Im waiting for a call back. Not that I expect to hear anything other than that VSC is severely backlogged etc etc, but I am excited just to hear something.

    You can use this and put in whatever specifications you want. I see your profile says you are filing for IR-2, but there seem to be minimal entries for IR-2 I-130s. The IR-1/CR-1 I-130s are moving right along now though, ours was just approved yesterday with a July 17 priority date.

    Thanks. But I figured it would be easier for people to mention approvals here, rather than searching in the various threads by month, daily for any mention of an approval. I know I cant be the only one who does that.

  10. I filed a 130 for each of my 2 stepsons (each unmarried and under age 13, IR2) on 11/8/2012 (108 days and counting) who are not in the US (in Philippines) so I am expecting NVC processing. After calling last week and getting to tier 2 support, I was told that the cases had been moved to Arlington Virginia office which I thought was strange as the Washington DC office is located in Fairfax, Va. After looking up the office it appears that it is an ASYLUM office. We did not apply for asylum for them, only simple 130s. I am a USC, I have no issues with sponsorship or qaulifying income, have not received any RFEs for any case, and stepsons were both issued MSCxxxxxxxxxx numbers.

    By the way, I also filled for my wife (natural mother) the same day (11/8) with 130/485 concurrently and she has already completed (including interview at Fairfax location) and has Conditional GC in hand.

    So the question is why would a simple 130 which should go to consulate processing through NVC end up in an ASYLUM office when the beneficiaries are not in the US?

    I have now setup an INFOpass appointment at the Fairfax office (in early march) but was wondering if anyone has had a similar situation.

    It sounds to me like they transferred the file for faster processing. If this is indeed the case, consider yourself blessed. Ive been waiting for my file to be processed at VSC since July 30th. It seems that they are very delayed and started transferring files to other offices, which will result in a speedier approval.

  11. Is MIL implying she wants to leave for the US to get healthcare or be cared for by the brother but is remaining only to take care of your daughter? What a difficult situation. I think unless MIL tells you that she is having trouble caring for your daughter or you have direct evidence that there is cause for concern I don't see that there anything you can do at this point...

    Exactly. She wants to leave soon, and is only staying to take care of our daughter. I really hope the health thing isn't anything too major because at the rate VSC was moving, it's one week per month. I'm actually not expecting noa2 before another two months or so. I'm losing patience.

  12. I can't imagine the frustration you are going through. You don't need to share the actual details but was there an incident that happened that prompted your husband's brother to say this? An emergency visit to the doctor/hospital? I don't think that going around MIL is a good idea but if there is a serious condition could your husband's brother provide any documentation? I can see how it would be hard to know what to do when you don't really know what is going on. Is your MIL denying there is an issue or just not providing documentation?

    This month should really bring approval of your petition. Hoping you hear soon.

    Brother in law is here, not there, but in another state. He is the one bringing mother in law to stay with him, supposedly to deal with her health. She is trying to hold out, since she is the main caregiver for stepdaughter. We had no idea it would take this long, and although she downplays the health problem and says she will try to hold out for her granddaughter. We dont want to be the ones responsible if there is a serious problem and she doesnt leave. She has visa and everything, but she is trying to stay there for her granddaughter.
