I think you were still waiting for approval for your petition so make sure to follow up and request an expedite at each stage of the process VSC, NVC then embassy. Hi Beejay, Im still here. Serenity did give me excellent advice, but unofortunately I havent been able to follow up. I asked my M-I-L for some type of medical paperwork showing her heart issue, and she hasnt been able to provide me with any. I dont know if its exaggeration on the my husbands brother's part, or what, but Ive just been sitting tight.

I think this is soo freaking unfair the way they are processing these I-130s, but what can I do. I even thought about filing again since it seems that people are being approved within two months, but I dont have the money to throw away.

What is the reason for the discrepancies between the time it takes for certain applications to get approved and others? Some of you have been waiting a ludicrously long time that makes me anxious. Are the differences due to the fact we are all applying from different countries (i.e., some countries are faster than others), or what?

This is a terrible situation! I know you are still within the official "processing time" but that is crazy that many of the people who applied after you and got sent to MSC are getting approved so quickly. I don't know anything about the expedite process, but maybe check in with the spouse I-130s forums, as I have noticed a few who have tried that... I believe you would contact a congressperson, not a lawyer... don't know if it would help, but it sounds like you have a good reason and maybe an inquiry would at least get your case looked at by a real person... I am really sorry to hear it is taking so long!!

Thanks SerenityNOW, I am really at my wits end. The most frustrating part is like you said, so many people who applied later are getting approvals. Ive seen people go from NOA1 to NOA2 in about 40 days. Everytime I try USCIS, I get nothing because I'm within "processing time" . I haven't tried Congressman, but I saw someone else say the Congressman said they couldn't do anything until they were over the processing time.

My stepdaughter is already 13, so shes getting to that difficult stage, and now they are considering leaving her to live with a friend. She doesn't need all the shifting around, she needs stability.

This whole process is making me sick to my stomach. I officially hate USCIS. I cannot wait to be done with them. I sent in my I130 in July, and haven't heard anything since then. Originally, I was patient and not in a rush since I didn't expect her to come until after the school year, but things have changed. My step-daughter lives with her paternal grandmother, who has become ill. My hubby's siblings have convinced her to come to the US to tend to her health, but she is trying to wait until the step daughter situation is worked out. The siblings are pressuring her, and keep telling my hubby he needs to go to a lawyer etc. I keep telling them a lawyer will not help at this point and there's nothing we can do but wait. I actually believe that they think its our fault, or we haven't done something.

I told my hubby already that if anything happens to his mom in the meantime, it will be on his conscience so she needs to come whenever she is ready, but we don't know what to do with stepdaughter. My case hasn't been touched since its been accepted, and VSC keeps changing the processing time, so that they're still within processing time.

Im just frustrated.

I filed in July as well. 7/29 to be exact, at VSC. My case is for a stepchild though, so Ive been in a different thread. I actually just came across this thread with people who can relate to my despair. July 29th, and I still havent heard a peep yet. I had no idea what was going on until I found this. Its really ridiculous.

Yeah, I had already added this fee to my budget ... I am spending a lot of time learning about all of this process for immigrating a child here, and I have gotten some completely incorrect information from immigration lawyers, so I appreciate your input. I definitely have no expertise in the realm of immigration, just relying on extensive research and the knowledgeable VJ folks.

I was speculating because it was odd to me that the USCIS information about the fee made a note of pointing out that: "Failure to pay does not affect the lawful status of the applicant. The applicant will have their passport stamped showing their lawful admission and permanent resident status..."

An actual plastic green card is not a requirement to apply for a passport for our situation -- per USCIS instructions for my stepson to apply for a passport, one of the items he can provide for the application (in addition to his birth certificate and proof of his father's citizenship) is: "The child's foreign passport showing the Bureau of Citizenship and Immigration Services in the Department of Homeland Security (USCIS) I-551 stamp in the passport".

Since we will apply for the U.S. passport as soon as he arrives, my stepson would probably have a U.S. passport in hand before any physical green card would even arrive (at least from my past experience, passports take less time than green cards do). Green cards are confiscated upon citizenship, so I was just wondering how this works... we would pay the fee, then the green card production request would immediately be cancelled with the passport application ... maybe. Or there will be a provision that we have to pay the Immigrant Fee before being approved for a passport (that scenario makes more sense to me) -- even though the fee is supposedly for the card itself, not to become a permanent resident. This new fee hasn't even been implemented yet, so I don't think that anyone has all the answers on how this will work, especially for this small group of people who fall under the Child Citizenship Act who are becoming LPRs and citizens simultaneously. Hopefully others ahead of me in the process will post their experiences.

In any event, I am not paying that fee until we are back in the States after the interview, so both that fee and the passport fee will be paid at approximately the same time, even though the payments are going different places. We will then find out whether that delays the passport production process.

But here's another thought about the Immigrant Fee: Based on the info in the previous post, I wonder if this means that if the immigrant doesn't need an actual "Green Card", we don't need to pay this fee?? My stepson will become a citizen immediately -- sounds like yours too -- which of course involves paying a fee if we want to get a passport (of course we do!). Apparently we apply for his U.S. passport with his foreign passport stamp and his birth certificate showing his father's name + my husband's naturalization certificate -- so he is never actually going to get a green card ... I wonder if those in that situation don't need to pay the Immigrant Fee?? Might as well try it, as the worst that will happen is that they say that fee must be paid before a passport can be issued. Maybe this is good news for you too if this works.

Well there is the fun new "Immigrant Fee" that is required as of Feb 1 - $165, paid after the interview...

So I guess I really should have waited til my hubby became a citizen to file. Not only would life have been easier for us with the I864W step, but we more than likely would have been approved already, and got in before the new fee. It seems that VSC transferred all cases after August 15th to NBC for faster processing since they were backlogged. People who filed as late as Nov are currently receiving approvals, while we just wait. Supposedly VSC is processing cases from the end of May.

How do you know if your i130 case was being transferred to NBC? Filed petition for parents on JULY 31,2012 still no update.

Based on what I researched and found here on VJ, applications sent after about August 15th were transferred to NBC due to severe delays. So if you filed in late July, you will probably just be waiting. People who filed in Sept, Oct, and even Nov are being approved at NBC.

I have a quick question for you (I skimmed this thread but there are more than 650 posts - sorry if you have talked about this!) - you applied in early March of last year and are just now getting the approval, so about 10 months total. Do you think that is the normal processing time now? Or did your case take longer for some reason? I am trying to estimate how long this process will take, and I had told his family about 5 months, but maybe 5 months is the average for only the USCIS part? Ugh. We are going to miss another summer if this takes more than 8 months. I tried to time it so he could start school at the beginning of a school year. Oh well. Nothing I can do now except make sure I have everything ready to go as soon as we get the first approval.

Our petition was sent to the MSC for some reason. At least it is finally "in the system" and I can check for status updates (the notifications didn't work for most of our previous applications).

You never can tell with USCIS. Hopefully processing speeds up, and you are able to get through by the summer. From November to August should be okay... but then again I submitted mine to USCIS at the end of July and still havent heard anything. I hope they pick up the pace on the processing now that the holidays are over.

Our visas were approved and issued so we are finalizing our plans to get the kids here. Final hurdle!

This stage can be hard because there isn't really anything to do but wait. You will get to NVC which will be a more active process. It does look like VSC should be close to adjudicating your petition. What was your time frame? Was it this summer? You should have plenty of time to meet that goal.

Yea I know beejay. And yea, I wouldnt want to pull her out of school, so the summer should be fine. Its just that like you said, with nothing to do but wait... it gets hard. I felt so good about being patient til December, and now Im getting antsy. I think I have ADD. I dont like to spend too much time on any one project, Im already ready to move on to the next thing.

Ok, that's the Vermont Service Center. Their processing times were quite different than CSC and I don't believe they have been processing at 4 months this year.

Checking the USCIS page for processing times it looks like VSC is processing I-130 petitions from May of this year, although it hasn't been updated since Oct. 30th. https://egov.uscis.gov/cris/processingTimesDisplay.do

Those times should be taken with a grain of salt, especially since it hasn't been updated recently but the vj timelines seem to concur that VSC is processing petitions filed in May and that it is taking 200 days for NOA2 from VSC. http://www.visajourney.com/content/ir1cr1historical

A co-sponsor for the I-864 just has to be an LPR or USC residing in the U.S. So you could pick the brother or the father, whoever has sufficient income. It also doesn't have to be a relative.

It is only the I-134 associated with I-129f petitions that the Philippine embassy will typically reject co-sponsors. This is not the case when filing I-130s which use the I-864.

Hi Rebecca, it can be very hard when waiting for children's approvals. I hope you hear something soon. As far as I know you can only have one timeline per log in so I believe if you want to input data for the kids you would have to create a new log in. You could also post this question in the site related discussion forum, you might get a better answer there.

Hi Lucy4! Sorry you haven't heard anything yet. Where did your petition end up, CSC? VSC? I think things have been slowing down considerably and 4 months is no longer the norm for CSC. It remains to be seen on the petitions sent to local offices via NBC.

I think it was sent to the Chicago lockbox. The receipt code starts with EAC. Ive never gotten any notification of it being moved.

YEAH well husband stuck in Florida. All flights were canceled due to hurricane. Now we waiting to hear if they will close embassy tomorrow too. We faxed what we needed too. BUT we have the originals. So all I can hope for if they remain open that they understand why she doesnt have the originals and hope they are nice to her as we are not there with her. Thanks sancruz! I can't believe how nice they were! We got some bad info about not needing to pick up her medical and bringing it to the interview. When my hubbie took her to get the TB read they said they would send it over. So when we got to the interview and they asked about it, they said that we were approved but they had to wait for the medical and it could take up to 6 weeks. But then the lady said, its still early, why don't you run over to the medical place and see if he could get it. So, we waited at the embassy and my hubbie went and got it. They let him back in. We went back to the window and the lady gave us the green approval ticket and marked the visa urgent for production! She was so kind! That and the drama of me having my earphones and charger for phone in my purse (no phone or other electronics mind you), so, the over zealous security peeps sent me outside and,ade me get back in line. So, by the time I got in, my husband said they had already called our name. When they called again they asked why we were late. So, my husband explained what they did at security. But from that point on they were very sweet. Talking to my daughter and asking just a few questions. All of that and we were still finished pretty quick and with great success. She loves dragging her suitcase around. So excited to go with us! Thanks to all who answered questions and cheered us along the process. May you all get the outcome you wish for. I can't wait to bring our little gilr home and introduce her to so many things!

Hi guys I need some advice. I applied for my passport book the 15 of August and the received my app the 20th. When I checked online it still processing. And I'm traveling the 10 of september. I paid for regular service. Do u guys think I will get it on tint to travel. Please advice.

If you dont receive it, or see any change in status by this Friday, I would call and pay the additional $70 to expedite. Give them your travel dates and possibly your itinerary number, they will work on it and make sure you have it on time. It takes about 2 days or so for the expedite request to go through, and this is a holiday weekend. Once processed, it will be sent overnight.

That's basically the explanation the woman on the phone gave me after she put me on hold. I just didn't like her explanation as it seems like splitting hairs because the kids will get citizenship through their father, my husband, once they enter so in essence the purpose of the I-864 is void upon entry. At the time we filed he was an LPR which is why I petitioned them instead of them.

Oh well, packet is ready and will be sent off today. Yay paperwork.

I do feel less disgruntled if this was an oversight on my part rather than an arbitrary interpretation of the I-864w by someone who didn't know what they were talking about.
