    If he marries after his mother becomes a U.S. citizen, that’s fine (but your mother will have to inform USCIS to modify the I-130).  Otherwise because there is no immigration visa category  for LPRs petitioning married sons, your mother will have to file a new I-130.  

    Assuming my brother marries before 5 years from now which is the minimum time my mother needs to be eligible for citizenship. What would be my best option?

  2. Hello, I am a US Citizen and my mother just received her green card through AOS.

    I have a 27 years old unmarried brother  (planning to get married in the next few years) who lives back home. 

     

    What would be the quickest, most efficient option to get him a green card? 

    Should I file the I–130 myself (US Citizen) or it’s better to do it through my mother (PR)?

    My mum's case was approved after about 11 months. Thank you to every one who helped me or showed support. Finally we are able to travel abroad, we'll probably visit Montreal for Thanksgiving.

    It’s not sealed.
    When they send back the application for payment error, the open everything and reorganize the paperwork their way. They also use staples!

    I have to resubmit and and correct the fees. Last time, @HRQX mentioned that the medical form is valid only 60 days after surgeon signature which is expired for me. I went to check the USCIS website and I found the below update.

    Could you please confirm that I can still use my form which was signed on 9/21/2021.I am using the old form by the way. Thanks.

  6. @bobarola I did not receive no text no emails didn’t got charged either. 

    Today, as a matter of fact, (after 3 weeks) I checked my mail. I found my application got returned to me for the second time!! The Reason is the same as last time “ The payment amount is incorrect or has not been provided”

     

    I submitted two personal checks Because the credit card form did not work last time. There was enough fun in my checking account .

     

    $535 for the I- 130

    $1252 for the I–485

     

    can anyone help me. I’m starting to get tired of this process. Thank you.

  7. Hello everyone,

    So, I followed all of your advice and submitted my packet a couple weeks ago. Today, while checking my mail, I found that USCIS rejected and returned all my documents with the below reason for each form (I-797C) : 

    Your G-1450, authorization for a credit card transaction is invalid due to incomplete information and/or the credit card information you supplied was denied

     

    USCIS Is asking me to resend everything with the proper payment. 

     

    I have submitted two G–1450 forms, one for I-485 with $1225 fee and one for the I-130 with $535 fee. I am pretty sure that I have checked about 10 times all the credit card information and address.

    I called my bank to check,  they said there were no denied transaction on my account or anything like on their side. I am very disappointed about this.

     

    My question is : Should I send personal checks this time instead? Could you please confirm the fees?

     

    Also, I noticed that the issued a new Medical examination form where they added a new section for COVID-19 vaccine. At the time of my submission, the civil surgeon filled out the old version and included a photocopy of the vaccination card. Should I have my civil surgeon fill out the new version of  I-693?

I-693 (vaccination record) you can file either together with the whole packet or she can send it in later when she gets an RFE or bring to the interview if USCIS decides to interview her. You can file as soon as you get your naturalization certificate.

    Thanks for the details Demise. Can I fill those form online to save time like I did for my N400. I know I can do I-130 at least from my account.

    Most importantly have you asked your mother if she wants to stay stuck in the US (AP is not taking 3 to 5 months to get it's more like 8+ months). Will she have medical insurance incase of emergency, how about family back home? Will she want to fly back if an emergency happens there? Make sure before she stays long enough to get a 10 ban that she is 100% sure this is what she wants to do. 

    I will have to ask her and make that decision. Here in NJ, they offer same day interview/oath.

Both are free if filed with I-485 or while I-485 is pending. Both take roughly 6 months to be issued and if filed together the advance parole just gets attached to the EAD card as an annotation.

     

    So it's not like she'll be with nothing throughout the entire process while waiting for her green card. Roughly 6 months in she'll get her EAD and be able to work, get a social security number, get a driver's license, travel internationally (be mindful of covid restrictions, AP alone does not bypass those), etc.

     

    She should NOT travel abroad until she has the EAD/AP in hand. Doing so now would get her banned for re-entry and others already established that she would not be eligible for a waiver.


    This sounds like a solid strategy and gives me big hope.

    So If I understand well, it’s possible to apply from within US and they will be forgiving her visa overstay. Just need to wait 1-2 yrs.

    …That was my next question!

    She couldn’t go back because of airline canceling tickets then she was waiting for her visa extension to process, and now Covid hit hard back home so the country is locked down. If I send her home to apply later, don’t you think they will be forgiving due to the extraordinary situation. I am referring to the 3 yrs ban. Thank you.
