Your husband is the biological father and on the son's birth certificate, right? and he is a US citizen when child was born?  I thought that qualifies as CRBA?

    https://travel.state.gov/content/travel/en/international-travel/while-abroad/birth-abroad.html

He has to have lived in the US for 5 years before the age of 14 or have been in the us at the time of the child’s birth

However, once your son get his visa and touches down in the US he automatically becomes a US citizen if he will be residing with your husband.

Yes I know this, just wondering what we need to bring to our interview. Trying to prepare

do you have green card already? are you doing AOS or consular processing?

if your biological son is only 2 years, he should be american when he was born

did you already marry when you deliver the baby?

I already have a green card. Filing though consular processing. My husband can’t pass on the citizenship to our som because he hasn’t met the physical Stay requirements. We were married when he was born.

Her nationality can have a lot to do with it.  If it is Nigeria, or another high fraud country, it is too bad she didn't renew with the dropbox. Did she have many visits prior to the visa expiring?  Does she have significant travel history, requiring visas, in her passport?   It does sound like she is appearing to be an overstay risk to the consulate.   She should wait a significant amount of time before trying to renew again.

Thank you. Drop box has been centered in Nigeria. She does have a significant travel history. I think she may have been black listed

Maybe that "friend" is really her? Could she be talking about herself?

Concerning healthcare, there are a lot of countries with better healthcare systems than the US.

I am a green card holder thanks and marries to a USC. Yes but people would also want to have a baby in a place they are family we with and also with friends or family that can support.

If the "friends" have traveled all over the world it must be a huge family if they have a kid at each country they visit.

Some people like to play the system and then think they are smarter than the rest of the world....they would never settle in the US yet are willing to make the kid pay taxes for life....come on. 😆

    I'll make it easier:

    The OP is the "friend"

The "friend" is pregnant again and want to extend her personal US Citizens army.

    The End

I think If you do not know much about a topic it’s best to keep silent.

Huh?   That is a very odd comment.

Why was she trying to have the first baby in the US?

Health care is better there than our home country

Unfortunately, that's what 99% of the people who overstay and adjust say at POE.

They have travel history all over the world. I struggle to see why they would settle in the US

It is common for Hospitals etc to give cash discounts, how massive it was may be a factor.

And there is a specific variant of the B that allows medical tourism.

I was cutting to the chase with my original comment.

It was a 75% discount. It was shocking as well. Maybe she needs to pay the full bill and reapply again. She isn’t trying to have another baby in the US

  8. 3 minutes ago, Timona said:

Are you sure she does not owe? I have not heard of a hospital issuing discounts to foreigners.

I have seen the medical bill. They gave her a massive discount for paying cash. I don’t see what the other reason for denial could be. They are quite well off and travel frequently

If they refused her, then that's their decision. There is a concrete reason: she has a US citizen child and the embassy/consulate most likely believes that your friend is an overstay risk. She has to get a different visa entirely. Having that many refusals for the same visa type is no bueno. At this point, any further attempts on the visitor visa is just giving the embassy/consulate free money. And what does the "discount" have to do with the visa refusals??? Never heard of an American hospital being that nice lol.

    Always love your brevity.

They don’t want to live in the US. The just want to be able to vIsit and go on holiday

    Hi,

I received a message today that the NVC APPROVED my Affidavit of support and my Tax Return. They requird an updated civil document which I took care of.

I have a Case FE notice asking me to submit every 2020 W-2/1099 forms but the Affidavit davit and tax return is accepted. What does that mean?

Hello. Please how long did it take NVC to review your documents

  10. Hello Everyone.

I just got an expedite approval at the NVC but was told that my civil documents will have to be reviewed first before my case is sent to the embassy. How long does it take NVC to review documents? I submitted on the 12th of May. Does the expedite approval also mean they will speed up the review of my civil documents?

if you go to the Nigerian portal and check the approved cases, you can get an idea of timeframes of the approved visas on right hand on that page

    i checked 2 out of the 5

This is why it is so important that members do a timeline

one CR1/IR1 filed in 3/16/2019 and interviewed in 1/11/2021

    a  K1   applied 1118/2019 and interviewed in 4/192021

Wow. That means I’m in for a long wait. I haven’t seen many recent interview dates so I thought to put a post instead

Within 4 days after the I-130's were approved, myself, my wife and my step-daughter all received e-mail from National_Visa_Center@state.gov titled "Notice of Immigrant Visa Case Creation" that included NVC Case Number and Invoice ID Number which you could use to log into https://ceac.state.gov/IV and pay the fees.  After the fees were paid it took about 3 more days until the payment processed and now I already summited the AOS and am working on the DS-260's.  Ill probably get those submitted by tomorrow and it's going to be about 1 1/2 week before we can get her NBI Clearance (Police Certificate)  otherwise I think we are good for the civil documents.

Finally got my email and have made payment. Application is for my son and I’m a US citizen so we don’t need AOS. Hopefully things a lot fast from here

Oh nice lucky you. Maybe California is slow at everything including sending the packages to NVC. Hope we get something by tomorrow

I'm not sure how you worded your questions, but that is a typical vague answer.

How many years have you lived in the U.S.?  Where were you born?   I'm just wondering if you are close to 5 years or very far away.  You know, it does not have to be continuous, right?

One of the reasons I am moving from Philippines to the U.S. is so my Philippine born USC kids can get that 5 years under their belt and never have to worry about passing their U.S. Citizenship on to their kids.

I asked since I don’t qualify to pass citizenship to my child so I still have to go through the CRIBA process and a get a rejection letter before I file an immigration petition.

I am no where near the 5 year mark. I’m about 1 year. It makes a lot of sense
