  1. Hi, I received an RFIE (request for initial evidence) stating "Submit a copy of the birth certificate or other primary birth record issued by the appropriate civil authority for the applicant..."

     

    I am a Canadian citizen, and I was born in Afghanistan. I submitted my Tazkera (Afghanistan national identity document) as proof of birth because this document is specified as an alternate document to the birth certificate on the state.gov U.S. Visa: Reciprocity and Civil Documents. It states that "The tazkera (national identity document) is the principle document used in official settings for proof of identity, citizenship, and also used as a quasi-birth record. All Afghan applicants applying for U.S. immigrant, special immigrant, or other such visas must present a tazkera."     So I am wondering did they misplace my Tazkera, hence, they are requesting a birth certificate. In that case, I would need to send it to them again as a response to the RFIE. Did anyone else have a similar experience? If so, did you submit any additional proof of birth? Thanks

  2. Hi, just wanted to post an update.

     

    02/08/2021 - Delivered to USCIS lockbox

    03/10/2021 - Received 3 NOA receipt text messages 

     

    I am not sure when the check was cashed because it’s a cashier’s check, but I-485 case status says fingerprint fee was received as of 03/06/2021.

     

    Also, my priority date on all the receipts is 02/08/2021. So, regardless of how long they take to process the application, the priority will be when it was delivered.

    In 2020, I was in Canada from January to March. Then I went to the U.S. as a Visitor to be with my spouse. Now, I meet the U.S. Substantial Presence Test because I spent more than 183 days in the U.S.

    For the whole year of 2020, I have been employed remotely by a Canadian company. In Canada I have a house (joint mortgage), driver's license, health card, bank account, and credit cards.

    How do I file my taxes? Do I file Canadian taxes first and then file U.S. taxes and claim Foreign Earned Income Exclusion with the IRS?

    Any help is appreciated. Thank you!

  4. I sent my AOS application today and I included an I-130 Approval Notice which I downloaded from the USCIS website, however, today I received the official approval letter (i-797) in the mail. The approval letter I received in the mail has some graphics and says i-797 at the top while the one I downloaded from the USCIS website doesn’t have any graphics and no heading at the top saying I-797, but both documents have the same information. Will this be a problem?

Filing is delayed this year and the  IRS won’t begin processing until Feb 12, so no rush. A joint return will get you more money back. Start over. Your 2019 return will suffice for AOS. It is currently your “most recent tax return.”

    How can one do a joint return if the other spouse does not have an SSN/ITIN?

  6. Actually, I figured that we can file the 2020 taxes now and get the 1040 which we can send with the I-864 as well as I-944. The only issue now is that the I-944 requires a tax return transcript which will take months to receive because we are paper filing, but we will write an explaination stating that we will bring it to the interview. So I hope this won't cause rejection of the AOS package. 

  7. My wife was a student in university in the years 2017, 2018, 2019.

    She was a dependent for the years 2017 and 2018, however, for 2019 she did her taxes with wages from a part time job (under 5k income). My wife started working in January 2020 and has an income over 60k.

     

    For the I-944 and I-864, based on my understanding we will have to submit the 2019 Tax return transcript since that is the most recent one we have. We will also be adding all the paystubs from January 2020 till now which show her income is above the poverty guideline. 

     

    The reason why I can't wait for the 2020 tax return transcripts is that me and my wife have to paper file our taxes, I will also need to apply for an ITIN number and I believe this process will take months. 

     

    What I want to know is that will the AOS application be rejected and will we lose our fees or we will get a potential RFE? I do not mind getting an RFE later on because we will be filing our taxes soon and have the return transcript ready.
