I wouldn't. My lawyer discouraged it too.

The problem is, if you miscalculated the date and petition arrives a little early - it will get rejected.

Adding a week will minimize this chance.

Fun fact, a friend of mine, who filed I-751 two weeks after me got approved 4-5 months earlier than me. Same service center. Neither of us had RFEs or interviews. So me sending earlier didn't get me there faster 😃

With current processing times, whether you file on the day or two weeks later - you'll probably be applying for N-400 with pending I-751

Yeah I just used the calculator on their site (http://www.uscis.gov/forms/filing-calculator-for-form-i-751-filing-jointly-with-your-spouse) and the first day of the filing window falls on a Friday. So I've been supposing if I send it Friday afternoon they will probably receive it earliest by Monday, I get the point having a cushion though. The only reason I want to send it asap is because I've started collecting evidence, letters, and I don't want the dates on the evidence to be too old. E.g. I have a letter already that would be dated 2 weeks before I send the application. Though I also don't want to be collecting evidence at the last minute.

Do not send the day window opens. Delay by few days to avoid rejection.

How long of a delay are you talking about for waiting for taxes? Few weeks? Sure. Longer - I'd file without it.

Oh interesting , so it's not good to send it the first day the window opens? Why would it get rejected?

As for the delay yeah could be a couple weeks, given nothing else comes up when filing.

  3. So the window to apply is coming up pretty soon and at the same time we are almost ready to file taxes as well. The problem is to finish this year's taxes I need a document from my previous company which may arrive some days or even week after the window to apply is open. Of course we are including last year's tax returns in the I-751 packet along with bunch of other financial evidence, but do you think it's worth applying a little later but having the second tax return also ready to go? We do want to send the packet the day the window opens.

tl:dr worth to delay applying for I-751 (within allowed window of course) for including second joint tax return? thank you!

  4. I know a common piece of evidence for living together is a lease agreement with names of both spouses or mortgage statement with both names. In my case, I owned the home before we got married, having the mortgage be in our names would require refinance and all sorts of bureaucratic headaches. Would it be fine if I got a letter from the HOA which states that we are both registered to live at my residence? (you have to submit application / register with HOA if a new resident comes to live) Of course beside this, there's bunch of other evidence showing my wife's address being here including bank statements, driver licenses, wife's W2, health insurance and medical bills, etc. Thank you in advance.

  5. Hello everyone,

we are going to be filing i-751 in roughly a month and wanted to get any feedback on the current evidence packet I'm planning to send:

    1. Birth Certificate of our child born during our marriage
    2. Statement from our HOA confirming joint residency
    3. Bank Statement confirming Joint Account Details and also statements showing both our direct deposits going into account
    4. Joint CD Account
    5. Savings, 401K, Life Insurance beneficiary set as my wife
    6. 2022 tax year joint return , 2023 will either be filed or still in progress
    7. Car Insurance with our names and our driving licenses with same address
    8. Credit Card Transactions from two joint cards that we have
    9. Affidavit Letter from our priest who married us and has known us ever since my wife arrived in the US (we are active in the church community and my wife volunteers there). Contemplating another such letter from a friend who has known us.
    10. Family Medical Insurance showing our names (me, wife, son) ; also medical statements / bills for my wife to our address
    11. Some photos from our trips together ; photos with family and friends ; plane tickets together
    12. Cell Phone bill for both of us

Perhaps there may be a few other items to add if they come to our mind. Some things have been in my name before we married (e.g. I bought a car / apartment before our marriage). thanks!

I-751 a force for good that forces couples to shop for insurers with better customer services.

so apparently the "Named Insured" is only my name but even though her name is not there, she is still covered because of how the policy works. I have to somehow get a document from insurance agent to list the actual drivers covered. This is just so moronic, why don't they put all the drivers covered on the insurance card or on some document. If the cop pulls her over, how does the cop know she's covered when it's just my name under "named insured". State Farm is absolute garbage!!!!

Just reading through this thread and adding to this comment - before my husband got a U.S. driver's license, I went ahead and added him to my car insurance as a non-driver spouse. So his name still appeared when I printed out the declaration page but it made no change to the cost. I figured it didn't hurt to have as much as possible showing that we were married/spouses. That was for AOS, but still relevant and potentially useful for ROC when one spouse doesn't drive.

Here are some things we included in our ROC packet that may be helpful:

    • Credit card statements for any joint credit cards and/or documentation your spouse is an authorized user
    • Copies of letters, cards, or invitations addressed to both spouses
    • Documentation of any joint memberships (gym, Costco, Amazon, etc.)
    • Documentation that you're both on the same mobile phone plan
    • A selection of photos throughout the marriage (in your case family photos with your child would be great)
    • Documentation of any trips taken together since marriage
    • Emergency contact sheet from employer/doctor/school/daycare, etc. (either showing you're each other's emergency contact, or you are both contacts for your child)
    • Healthcare Durable POA for each spouse (this is easy to draw up from templates online and good to have on hand anyway)

You would think adding your wife to car insurance is easy, but I've been dealing with the incompetent car insurance and they still can't add her to my car insurance! they say she's added but they send car insurance card with only my name. What can I do when there is so much incompetency. Yes I want her to be on my car insurance, but it seems these insurance companies have some severe IQ issues and cannot do it!!!

Our case is approved and 10 year gc in hand after 12 months. Our evidence:

    * joint bank account statements. One per quarter.  All household expenses paid out of this account since I-485 interview

    * joint gas and electric statement.  One per quarter.

    * joint brokerage statements. One per quarter.
    * Costco and AAA renewal statements in both names

    * joint auto insurance

    * joint title on car

    * two references from friends (both U.S. citizens). Not notarized

    * all flight and cruise itineraries taken since I-485 interview

We did not provide joint  title on home, joint lease on home, joint mortgage on home.

Thank you this is useful. I can also provide a letter from our condominium association confirming that both of us have lived at said address.

I'm not sure how to get my wife's name on electric statement but I can try if that will make a big difference.

Agreed, it's worth checking, but likely the premium is higher if she's a new driver. If money isn't a problem, and OP thinks she may take the car one or twice a month to go do grocery run or attend yoga session or whatever - why not? Otherwise other good evidence may suffice.

She's a new driver yes, and I live in a state with very high car insurance rate, that's why I've been hesitant unless she starts driving.

@stag you can also include samples of annotated photos showing you and your wife with family and friends. Place 2-3 photos per page. Also you can ask for sworn affidavits from friends and people who know you as a couple. These two are generally weaker pieces of evidence, but it doesn't hurt to include them.

Yeah we have many photos like that with my family and such that's not an issue.

You think an IO is not going to wonder about that if you submit matching drivers licenses without matching the insurance policy?  At an AOS interview one time the IO compared our house keys and copied our matching CC cards for his file.  They reference and cross reference everything.

My wife had a bad experience with driving and doesn't want to drive anymore. Why should I pay extra for insurance? I don't think it's an unreasonable situation.

That's good. Don't add her to car insurance if she doesn't plan driving - waste of money.

But 401k beneficiary, life insurance for sure.

Got it, I forgot there was a 401K beneficiary option, I'll make sure to set that, thanks.

I think this is good. Do you have a family plan for your phone service? If you can somehow demostrate it,.maybe worth including.

Did you pay for any services for your wife? E.g. medical bills showing her name as a patient and your name / billing address as a payer. Or presents that you got her from some online stores. Or she used your card to pay for something. Essentially, any combination of her paying for you or vice versa. My wife sometimes buys tickets to events, listing both our names.

Yes we have our phone bill together. Yes we have medical bills together, and the same card we buy many things together (she has her own card, same number). We also have tickets together to events, trips, hotels, and so forth.

You have me flagging you LOL

In a “normal” household she should already be insured to drive, she should already be your life insurance beneficiary.  It is not unusual for mortgage and deed to be in one or the other’s name, nor is it unusual for utilities to be the same.  Dependent on health/dental etc is a given. Just reading you the flags dude.

I didn't add her to car insurance because she doesn't drive at all and didn't think it made sense to pay much higher to have her added, though I can add her if it will be an issue. I can easily change the life insurance beneficiary.

Don't just rely on child's birth certificate. Some couples had a child together and then separated. Unless you have enough evidence of living together, USCIS may give you a hard time.

I have quite a bit, but it seems the fact I acquired my home before my marriages and not during is a red flag since are both names are not on it? We do have joint bank accounts, credit card, trips together, our insurances together, addresses of driver license and medical bills together, but there's a few things only in my name simply because I acquired it before marriage. Just want to plan for these things.
