  1. Hi folks,

    I was a k-1. my green card (I-485 Application to Register Permanent Residence or Adjust Status) was approved January 13, 2023 and expires January 13, 2025. I have not received any notification that extends for 48 months instead of 24. Should I contact USCIS or Im not applicable for the extension?

    I’m honestly not sure. When I went to the embassy to register our marriage I asked if I could get a new passport with the new last name. The guy was very confused lol and told me that he wasn’t sure but if I could, I’d have to wait until my passport expired to maybe do so. 
     

    It’s been a few years now and I recently did renew my Greek passport but I honestly did not ask whether I could change my name on it. I should’ve, I just didn’t feel like dealing with Greek bureaucracy haha. If you find out though, let me know!!

    Hey there! I'm also from Greece and have the same problem since as you know, Greece won't let you change your last name. But to answer your question, yes, you should be good to go. I have taken multiple trips to Greece and other countries with my Greek passport that has my maiden name, ticket booked in that maiden name, and GC in married name. Entering Greece / other countries, border authorities won't typically care what is on your GC. To board back to the US, they'll check your GC but I've never had them ask why the names are different. Once in the US, CBP cares about the GC itself for the most part and I've never had them ask anything about the names. I always carry a copy of our marriage certificate just in case.

     

    Now, what I haven't quite figured out is what to do once my naturalization is approved since I'll have 2 passports with 2 last names but as far as traveling on a GC, you should be okay!

    Regarding the last name change, i know that per law is not allowed but when i go to our embassy to reguster my marriage they cant change my name there?

    I was literally 1hour and 20 minutes over the phone with turbo tax advisor. She had never done before but was really keen to help.

    After some tests etc we managed to include the form 2555 and exclude the foreign taxes. I still have some concerns may not did it correctly but fingers cross.

     

    At Form 1040 

    Line 1h Other Income Earned has the Gross Amount for foreign income

    Line 8  Other income from Schedule 1, line 10   has - (minus the income earned)

    Schedule 1 8d Foreign earned income exclusion from Form 2555    has - (minus the income earned)

    If she wants to get a credit for Greek taxes paid, that is a form to fill out— Form 1116 or she can choose to exclude  the income from US taxation with Form 2555. One or the other but not both. Either one can save tax dollars. Yes one month is not going to make a huge difference, but the IRS has procedures one is to follow even if it’s only a month to report as foreign earned income. 

    Yes the money will save are not much anyway just trying to do it right so I have no tax issues or penalties

    Okay so you file with your husband. You have to report all his and all of your income (US and abroad) earned in 2022. Your US income is entered in TurboTax where it asks for W2 info. Foreign Income will be entered toward the end of the income questions under the section called “Less Common Income”. That’s where your January income gets entered. 
     

    TurboTax will take you through questions and do form 2555 ito exclude your Greek income. You qualify to exclude because you were a bonafide resident of Greece, allowed to work and earn money there.. It is written more for Americans working abroad so sometimes the wording is confusing. I think it asks what visa you had. That is not K1. It is asking what visa you had for Greece. Well none. You didn’t need a visa because you were citizen of Greece allowed to work there. You do absolutely qualify for the foreign earned income exclusion and if TurboTax says you don’t, then you have answered on of their questions incorrectly so back up and review what you entered. 
     

    If you get stuck, come back to this thread and ask specific questions.

     

    Gotcha, thanks it said that i did not qualify and i had to complete an other alien something form outside turbotax and manually. I will redo the foreign income section. Thanks again

    I need your valuable help again!

     

    Jan 1 - Jan 31 of 2022 I worked in my country Greece and I had a small income. I will pay my taxes for Greece in Greece.

     

    Feb 1 enter USA with K1 stopped any work no income till Dec 1 of 2022 and for this one month income I have w2 and will pay taxes in USA. No green card just work permit. I got the green card in January

     

    So I worked one month Jan (greece) one month Dec (usa).

     

     

    Do I have to complete the form 2055 for foreign taxes attached with the 1099 in my situation for Jan 2022 before I entered USA?

     

    I read on the following thread no but not sure if is true..

    It is automatically excluded because your start date for us tax purposes as a us taxpayer is the day you stepped foot on us soil.  Any income earned prior is not a part of your taxable income for us purposes.  You dont bring it on the form at all.   You can voluntarily elect to be treated as a us taxpayer for the entire year at which time you become eligible to use the 2555

    So I just received an RFE for my AOS application.

     

    Quote

    Submit a copy of the marriage certificate between the K-1 applicant, XXXXXXXX, showing the date of the marriage within 90 days of the K-1’s arrival into the United States. The marriage certificate must be issued by the government agency authorized to issue the document. For immigration purposes, the marriage must have been registered with the government agency authorized to register marriages from the location where the marriage took place. The marriage certificate must have the seal of the issuing office, the date of registration, and signature of the registrar

     

    I included to my package the copy of the marriage certificate (without seal) but I can't recall if I added a copy of the original certificate (yes I know I should have keep a record but for this I did not.

     

    So I have two questions

     

    1) They are giving me the option to upload the file online, can I go ahead and upload a picture of the original marriage certificate along with a letter explaining? do I need to mail that as well?

    2) is there any way to need the long form? I have requested that for my country and still waiting

  9. Oh i just found this thread, seems indeed that some people get approved faster than expected without expedite and some without interview.. lucky.. i will take a closer look to the posts

     

    Oh so is either day or you have to wait? :( really dont know whats going on so just waiting for a miracle!

    After submitting the "Check Case Processing Times" for I-785, (c)(9), for NBC (National Benefits Center), the update shows:

    At the bottom shows your earliest "Get Inquiry Date". If you input your receipt date from your Timeline, I think your earliest inquiry date according to USCIS is April 15, 2023.

    I have not received NOA1 Yet but I just receiced two sms with two different receipt numbers.. any idea why and what I should expect? Is the 797C meaning RRE?

    No. You'll get a replacement card shortly after approval of either (or both) I765 or (/and) I485 in your new name.

     

    Not for USCIS. Just apply for your DL or state ID in maiden name if still eligible. Once your immigration name has been changed with I765 or I485 approval, you'll go back and update your ID.

     

    Again, apply in maiden name.

    Thank you for your answer. Now my legal name is not my husband's surname? So to all the forms I user my new last name and as previous my old last name. I did not keep my last name as maiden..

    Is ok to have as new legal name my husbands surname already?

     

    Also at forms I can see the SSN but as new one not replacement, will be replaced automatically as soon as I complete my SSN?
