Excellent news. Ultimately your expedite was granted.
Recent experience of a friend , w expedite request made to USCIS on I-130, denial email received same day…BUT 10 days later notice received by post that expedite approved and NVC case creation email…only drawback is that they switched consular post from Ankara to Abu Dhabi…but worth it.

Your case was sent to embassy so presumably they will schedule the earliest available interview.Congrats

This is extremely odd in my case. I requested an expedite August 11 of this year. A couple of weeks later, I received a rejection notice.

Another thing that I find odd in my case is that most of the interview letters being sent out by the Embassy are those DQed a month before our DQ date. So in essence they kinda expedited our case by a month. LOL!

In any case, we’d take this small victory!

So we should just wait for the embassy to schedule a date or do we need to schedule one?

@Natepartlan Congrats on your interview letter from USEM! Can I confirm that you are saying both your unmarried children are still F2A even though they have aged out over 21 since their DQ April 2020 date? Are you saying that they will still be processed as F2A even though they are over 21 now because they were under 21 when they were DQ'ed  back in April 2020.

My in-laws have their daughters F2A's that has been DQ'ed since Nov 2020 & waiting for an interview scheduling from USEM- it will soon be a full 2 years now having being DQ'ed and being current. I'm thinking about sending an expedite request within 60 days before she turns 21 and "ages out"

@Bochog As shared in my other post- USEM website in October now states that they are processing F2A's that were DQ'ed in Feb 2020 "Most current family preference cases being scheduled are approved expedite cases and cases that were documentarily complete at National Visa Center in February 2020."

Here is the month by month F2A issuance statistics issued by USEM this year in 2022 (yellow highlight) https://travel.state.gov/content/travel/en/legal/visa-law0/visa-statistics/immigrant-visa-statistics/monthly-immigrant-visa-issuances.html

Interestingly, USEM processed FX visas, which is the same as an F2A.

Do you think the F2A is for the regular DQ date and the FX were the ones who were expedited?

Oddly enough, 3 weeks after the rejection we get an email from the NVC saying we're now scheduled for interview in November.  Maybe the rejected expedite request 'put us on their radar'?  Who knows how things work over there.  Anyway, SLEC medical scheduled and Manila hotel reserved.  Now more hurry up and wait 😝

    Refresher for those compiling data:

    Visa class F2A-F22

    PD 06Dec2017

    I-130 approved 05Aug2019

DQ 24Apr2020 (which was 1 day after Trump's shutdown mandate?)

    Expedite request 29Aug2022

    Expedite rejection 16Sep2022

    Interview scheduled 06Oct2022

Congratulations!!! Ecstatic for you and your family!

Hopefully we get ours soon, too! *fingers crossed*

After this, I went ahead and made an expedite request to NVC and they surprisingly gave me a quick response (18 hours!) that they had forwarded the request to USEM.  About how long did it take to get your rejection?  Of course, we're waiting with fingers crossed for positive result.

For anyone wondering, I only emphasized the 'out of normal processing time' and Apr2020 DQ in my request.

Any update on your expedite request?

In my experience, USEM takes about two weeks to respond if they will approve or deny the expedite request.

    Good luck on your request!

~2.4yrs for us for 2 unmarried children of LPR (under 21 at time of Apr2020 DQ).  As a data point to help others, what general content did you put in your expedite requests?

    Medical reason for my wife.

Apparently, they deem it as "not urgent" and "not qualified for an expedite" :(

Omg they have not set an interview for you for 2 years from NVC being dq’d? That’s just insane!

    Yes!

I sent them an expedite request multiple times (most recently on the 2nd anniversary), but they rejected all of it.

    It's just extremely frustrating. :(

They sent everything through email. and the last time we checked my brother's status it says the papers are in Manila and it's READY.. not sure what ready means but I hope ready to be scheduled for interview soon!

Wow! So cool! So happy for your brother!

I think you are correct about the status part. I think it's ready to be scheduled!

Thank you for answering my questions!

One of my brother's children is turning 21yrs old at the end of the year.. we requested last February 2022 but got denied and requested again about 2 weeks ago and got accepted for expedite processing. Reason was still the same.. PD is Oct 2010 and DQ is Mar 2021.

    That sounds good, and congratulations!

    What embassy is this?

    Thank you for your response.

    1. Up to 90 days early. To be on safe side, better if you don't file right on the first eligible day.

    2. Nobody is required to be in the US for 5 years. 30 months is the physical presence requirement. as long as your trips didn't last for more than 6 months, you are good to go.

    3. No effect at this point.

    Thank you for your response.

Follow up to number 3, if ever my naturalization moves quicker than the interview date, my wife can just show my naturalization certificate and it won't affect anything at all?

    Thank you again!

  11. I became a permanent resident Oct 23, 2017. Since moving here, the only times that I was out of the country was for brief vacations in the Philippines.  My questions are as follows:

    1. I read somewhere that I can file early, but I'm not sure of the time frame. Is it 90 days or 180 days before my 5th year anniversary?
    2. Am I eligible to file early given the fact that I am not here the entire 5 years due to my brief vacations in the Philippines?
    3. I filed a petition to bring my wife over from the Philippines and it's now awaiting an interview at the local embassy in the Philippines. Will my naturalization application affect said petition (delay it since there will be a Change of Status on my end)?

Thank you in advance to all who will take the time to answer my queries.

If your situation is still the same, you will probably get denied again. Of course you can try?

Also, changing the reason? Unless you have multiple reasons that all would qualify for an expedite, there is no valid point to changing the reason.

Thing is, I have read that some just request for an expedite without giving any specific reason other than they have been waiting for so long, and they were approved. When I requested for an expedite, I gave a medical reason, and I was denied.

On a side note, this immigration thing is really confusing and tiring. :(

So you’re probably looking at early 2024 for your oath ceremony. I’d be surprised if she hasn’t already got her green card by then.

But let’s say assume that she hasnt been called for interview by then, will my citizenship affect her current petition? I mean, do I need to refile everything to a CR-1 petition instead of F1?

  14. 32 minutes ago, SusieQQQ said:

Are there any derivative children on the petition? This is the usually the key factor leading to problems. If only a spouse, it usually goes faster if you’re a citizen. However - you may not complete the process before she gets to interview anyway - when did you file? What service center? Are you approved/DQ? What FO will you apply for citizenship at?

Yup, we’re already DQ since Aug 2020.

    No kids.

I don’t think it’ll do a lot to be honest, but the situation in Manila embassy now is that they’re only processing expedited family preference cases. I applied for an expedite sometime last year, but it was denied.
