    Case Created : JULY 05- 2019
    Interview Date : JAN 19, 2021 (AP) & FOLLOW UP Interview at  FEB 10- 2022 (221g)
    Consulate : DHAKA BANGLADESH
    Documents Requested : I-864W , NEW MEDICLE, POLICE CLEARANCE, PHOTO,UPDATE DS-260, New Passport
    At 28 march- 2022 Embassy asked for My Birth Certificate. (Sent Via Drop Box At march 29- 2022)
    Last Update : April 19-2022 ( From Refused to Administrative Process)
    my kids are waiting for me. Can any one suggest me any ways what should i do in this situation?

    I am sorry for your loss.  If you case is undergoing administrative processing, you must either wait for completion or sue the government (expensive).  Administrative Processing can not be waived or expedited. The reality is that you do not have a "right" to immigrate to the US .  Hopefully, your issue will be resolved soon.  

    What is my fault over here , and what is my wife fault and what is my kids fault over here, wont embassy give me a reason for it ? why i dont have "right"? to take care of my family

    Our File took place in July 2019 , My wife was a US Citizen and i am from Bangladesh. i got my first interview on JAN 2021 , Visa Officer put our case in Administrative Process later in December 2021 my wife dies due to covid i let embassy know embassy took a follow up Interview at FEB 10, 2022 and issued a 221G ( new medical , police Clearance, New Passport , I 864W, Passport Photograph & Visa Officer said he is putting my case from IR1 to IW1). I submitted all of them at march 1- 2022, every day my case status remain the same which is "Refused" but updating the date only. i called the US  embassy Dhaka they  saying my case is still in Administrative Processing.

    My minor Kids are living in a measurable situation without any parents. 

    This is an in human act from US Embassy Dhaka & this is against basic human right. Please suggest what can i do at this situation.

    Seems any CO reading your email would wonder what would happen if u could come now?

    1.  who will pick u up at airport?

    2.  how would u get around to even buy groceries with no job yet and no income

    and no state DL?

    3.  how would you get into her House or apartment as u have no key?

    4.  did u tell the interviewing CO that u plan to work in the US and now u are changing to need to be home to care for her?

     

    Basically even though u will have a I 551 stamp enabling u to work immediately,  u won't yet have a job and income.

    the USC has to support an immigrant helping with getting DL,  and all things essential for living here for a few months at the least and she can't do that at this point

     

    U need to let the AP play out and be thankful if the visa is issued and Pray USC wife is out of hospital and can start u with all u need here

    Don't push the embassy as it could " Backfire"

    1. no one is going to came Airport to pick me up & My mother in law is out of work due to her work and our kids are not eligible to drive so all i have to do it by my self for now.

    2. i am dependent and i guess for few months i will be able to bear all expenses and create all necessary things that need to be done.

    3. Kids are at house as they are staying at home.

    4. our visa is IR1 catagory and CO doesn't ask me anything regarding my work.

     as i am new immigrant to USA so there is lots of thing that i need to do when we start to live together.

     

    I am thankful for the embassy and their process as well, i am worried about my wife and my family which is natural and you are right this AP is creating more complex with covid .

     

    i am not planning to Push the Embassy i am just letting them know about our situation which is crucial i know hospital is doing great as they always do but at the end of the day we all are human being who wants to look and care after our beloved.

    Since January I have contact them every Month not only me but my wife he senator and congress women as well but same reply which is you case is in Ap you need to wait. I can get back my passport as there is an option open for that but i don't want to get it back without the VISA. receiving the passport without visa is meaning less.

    They haven't forgotten about your case.  It is in AP.  If you were still pre-interview, you could request an expedite to get an interview.

     

    AP cannot be expedited, or waived.  Sorry to hear about the situation, and best wishes for her recovery.

    Thanks for your reply we have kids to look after and I am worried about that and hospital is taking a good care but what happened after releasing my wife!!! My interview was in January in this year. After that it’s in AP and nothing yet .

    My wife is an US citizen by birth , also the petitioner of our case she is in hospital with low Oxygen level with high of sugar level, In these crucial situations please help me to give suggestions what is the possible thing i could do at this Moment as my interview date was January 19th 2021 at Dhaka Us Embassy Bangladesh. Visa officer he will contact me very soon but its seems they forgot about this case since then same reply from embassy to wait. She is admitted  in a hospital in her local area my Mother in Law  her only local guardian who is currently out of city due to her work.
     
    In this Crucial Situation Please help me to get some advice for that . IT'S URGENT, let me know if anything needs to be provided.
    i have called and email the US embassy Dhaka but they are saying to wait . Can you Believe embassy saying this at this Emergency situation......!!!!

    and it is good as it did not result in a denial 

    so,  they are working on your case and only wait for your country to provide all the documents needed to support their inquiries

    Thank you very much for your reply, that is exactly what i am thinking. i have tried in many ways to know where is our case stuck but there is no clue not even senator & congress could help us regarding this issue, i have no other way but wait. Me and my wife have been through this website and talked our family and friends but we didn't see any case like ours IR1 case stay in AP for 10 months that is more then regular AP time , They have kept my passport and our civil documents with marriage pictures, Still no reply from embassy, Pray for Us guys. and I am Thankful that Step are taken.

    They filed a Writ of Mandamus in 2020, as they were still awaiting an answer. 

     

    Unfortunately, it appears all you can do it wait and reply to any and all requests for more information or evidence.

    Every case is different. So, no one can tell you when your AP will end.

    Hopefully, they'll get their answers and you'll receive your visa sooner rather than later.

Me and my wife have been through this website and talked our family and friends but we didn't see any case like ours IR1 case stay in AP for 10 months that is more then regular AP time , They have kept my passport and our civil documents with marriage pictures, Still no reply from embassy, Pray for Us guys. this is their reply every month i asked them about Our case. The reference you provide that might be a record of criminal issue but in our case there was no 221G or anything like this. They took my passport civil doc and marriage Pics.

    since your country has poor record keeping ,  this takes time 

    when the embassy has completed the task and if the CO is going to approve and issue the visa,  you will get a notice to redo the medical exam

    not the criminal report as the above security checks have done that 

     

    it is possible (and i would think USC should expect this)   the USC may have to file a new I 864 and provide lastest IRS transcripts as u say your interview was in January and  2019 would have been needed

    and now 2020 are required .   if the process goes beyond April 15th of 2022,   2021 IRS transcripts will be asked for

I am not sure if it might also be related to the whole pandemic since a lot of US Embassies if not all closed for many months. I hope your case resolves quickly and you’re able to get your visa. Did the immigration officer told you you were approved? 

    No, officer told me that my case is in Ap, What about your case , did officer approved your husband visa ? did officer asked any further Documents

    I hope so it issue very soon. your advise is just perfect few lawyers said the same. i don't want to Sue DOS as its time consuming and way to expensive to hair a lawyer for this, But can you assume how much longer it gonna take?

    I have appeared interview in January 19th in this year and consular kept my passport with civil documents and our wedding pictures and told me they will contact me very soon but it’s more then 10 month still in Administration Process , case status date updated month then 10 times but still in same position. We married in 2018, visa category is IR 1, my wife contacted embassy with congress and senator and herself as well and I also send emails and calls but same answer every time . Is there anyone in this situations or what is the possible suggestions at this stage? I didn’t receive any 221 g letter.

  15. our case approved & documentary Qualified at NVC on April 12- 2020, but still there is no update our host country is Bangladesh and Embassy started their IR1/CR1 services after lock down, more over Bangladesh embassy replied our inquiry that our case is still at NVC so they can not Schedule an interview.

    So my question is - What is the process to bring our case from NVC to the Host country.

    NB: I have already emailed to NVC for Expedite, but they didn't respond yet its been a month.
