    Same case here, I just got an RFE "Submit a completed Form I-693, Report of Medical Examination and Vaccination Record" by mail to my local office (It is not a deficiency request which in that case means they lost your medical). 

     

    I completed with the vaccines during my medical overseas with K1 visa but I noticed in my USCIS account that several of the documents sent with my AOS were not scanned - including the DS-3025. I applied AOS on Sept 2021, my medical and visa were under the 6 months validation but medical was done before they changed the DS-3025 form that includes the COVID vaccine record and I was off season for flu shot. Still my DS-3025 marks "K1 visa applicant voluntary completed vaccination requirements".

     

    Another K1-AOS filler just replied the RFE by uploading on his USCIS account a copy of the DS-3025 and his GC got approved a month later. So Today, I just did the same: uploaded copy of my DS-3025 highlighted that I completed vaccination and the date summited and, even at that moment was not mandatory, I also uploaded a copy of my COVID card.

     

    *I called a USCIS doctor and she laughed about USCIS asking for another medical when mine was completed overseas. Cost = $310USD.

     

    Has someone else respond the RFE by summiting the DS-3025?

    Hi yes. I ended up having the medical redone as requested in the RFE. A couple weeks later they sent another RFE asking for the same medical, AGAIN!

    I contacted my congress representative who did whatever she does, and my case and Green Card were approved less than 48 hours later

  2. Update:

     

    Was contacted by my congresswoman's department. I sent them all the info they required. They called me today to say they spoke with USCIS yesterday and they said my Green Card application has been approved.

     

    I received a call from USCIS a couple hours later saying my RFE evidence (I-693) arrived on September 14th (which I already knew due to USPS tracking) after the first RFE, and my application has been approved and my card is being produced. When I queried the second RFE and asked why I was asked to send the same documents a second time, the agent stumbled over his words "erm..well...er...I think that what might have happened was...er... Someone didn't upload the documents to the system...and...er... Therefore the system didn't recognise we had those documents"

     

    Well ok then. Anything to avoid admitting blame I guess.

     

    Anyway, my Green Card is now being produced. Celebration time

    Nonetheless the 2nd RFE does not acknowledge they received the first medical and that it is deficient in any way. 
     

    Contact your congressman and ask for help , they will get you a pretty fast response…BEFORE deadline to respond. 
     

    Your interview was canceled because they had you on track to approve without an interview once they received new medical. 
     

     

    "Limited exam?" $280 is expensive for all the quotes I got here, I only went with them because they could fit me in quickly. And they definitely took bloods, no one said anything about it being a "limited exam"

     

    It's been 2 weeks since I contacted my congresswoman, I haven't heard anything back 

  5. Screenshots of both RFEs (RFE_01 is dated August 25th 2022, RFE_02 is dated October 4th 2022)

    My response to RFE_01 was a completed I-693, completed, dated and signed by a civil surgeon listed on the "find a doctor" page on the USCIS website.
    (note: due to the way this website displays the attachments, RFE_02 starts with the second headline "Why We Are Writing You")

     

    Also, the version of the I-693 that was sent is Edition: 07/19/22 which is the most up to date form (and is the one that is mentioned in RFE_02 with the one that has to be used after October 5th 2022), and therefore should have been valid for RFE_01 as well.

    Lol, you really think I misread what was asked for? While I appreciate the advice, I'm not going to be insulted like that.

  7. No vaccines declined, infact I had extra ones done at the medical in London to make sure they were up to date and completed. I already had my full covid-19 vaccination before the medical, with proof, and it was signed off on the DS-3025 form.

    The medical I had a few weeks ago, the civil surgeon literally said "I see you have all your vaccinations, so you are all good there" and again, I can see they are all signed off on the copy of the I-693 form I have.

  8. I received an RFE for my I-485 application, from a K1 visa. I sent everything required in the original packet, including a valid medical with full vaccinations (DS-3025 completed, signed and in date) from my medical in London, before moving to the US. The RFE asked for I-693 to be completed (another medical) and when I queried USCIS they said there was nothing they can do about it, I just had to follow the RFE notice. I had my medical (at cost of $280) and sent it via USPS to the address in the RFE notice. I have a tracking number, and the USPS website says it has been delivered on September 14th at 11:28pm, to the address I sent it to. There was no update to my online account for a few weeks, so last week I contacted USCIS and asked about the evidence I sent, they said they couldn't determine if the evidence had arrived at the USCIS field office here in Tucson, AZ or not, and I just had to wait. I logged in today to again check the status, and I have another RFE notice asking for EXACTLY THE SAME EVIDENCE I just sent to USCIS. I again contacted them, and all they did was keep redirecting me to what to do when I receive an RFE notice. I ended the conversation and contacted them again, hoping to get another agent. This time, the agent said he would escalate my case to a higher tier agent and I would get a response in a few days via phone call or email. I am contacting you to see if there is any legal action I can take if nothing happens. As I said, I included the required medical forms and information with the original I-485 application, and I can only assume it was lost somehow by USCIS which is why I was sent an RFE for the same info, but via I-693 form. I had another medical and sent the form to USCIS, with proof of delivery, and I can only assume they lost this too, as they have told me to have another medical and send another I-693 form otherwise my application will be denied. Any help or advice will be very much appreciated, has anyone else has a similar experience? If so, what did you do?

     

    Time Line:

    • I-485 packet recieved by USCIS April 11 2022
    • Interview scheduled for June 28th 2022
    • Interview cancelled without reason on June 3rd 2022
    • RFE sent to me asking for I-693 to be filled in and sent back, notice dated August 25th 2022
    • I-693 sent via USPS and tracking shows as delivered on September 14th at 11:28am
    • 2nd RFE sent to me asking for I-693 to be filled in and sent back, notice date October 4th 2022

    Remember with a new exam you have a new medical date of record and the immunisation clearance from London is void. For example if you don’t get in before October 1, you will need a flu shot because flu season (for immigration) begins 1-Oct. If any shot was waived because of an insufficient time interval, enough time may have passed when a new exam date happens. Take your DS-3025 record so the civil surgeon can transcribe all the shots to your new record (I693).

    As said above, this only applies if your medical is incomplete, such as vaccines. I made sure mine was complete as I knew it would be cheaper to pay for vaccines in the UK than it would be to pay for them here.,

    Maybe the problem was with the version of the form the panel physician used -- which was dated (lower Ieft corner) 05-2017 and signed by the doctor on Oct 28, 2021.  There was at least one newer version of the DS-3025 dated 03-2020 -- and maybe one dated in September or October of 2021, to cover the new COVID-19 vaccination requirement that took effect Oct 1, 2021, I'm not sure.  USCIS may have not accepted the information as presented, since it wasn't on the version of the former they were looking for?

    Good spot. Yeah maybe it is that? That's super annoying if it is, as you'd think the people conducting the medical would have the updated forms

    Of course I plan to get the new medical done, by "fighting USCIS" I just meant I hadn't heard anyone say anything other than they just got the medical done.

     

    I just wanted to check to see if I was missing something, as having a new medical won't (shouldn't) show anything different. A lost file (or can't be bothered to look for it) makes sense.

  13. I arrived in the US on K1 last December.

    My medical was done in the UK last October and I have a completed, signed, dated with all required vaccines on my DS-3025.

     

    The DS-3025 was obviously included in my AOS package. Originally had the interview scheduled on June 28th, but that got cancelled on June 3rd. Heard nothing from USCIS until yesterday when I received an RFE asking for a completed I-693 medical form, including vaccinations.

     

    I don't understand? My medical was done less than a year ago (and a lot less than 6 months before entering the US) and I had the extra vaccinations required at the medical (and I already had covid, which has been included on the DS-3025) which have been ticked and signed off on the DS-3025. Why are USCIS requiring me to pay for another medical that's going to have the exact same information as the DS-3025 I already sent them.

     

    I've seen in Facebook groups recently others have had the exact same RFE in the same situation but a few saying they don't want to fight USCIS. It's ridiculous they are treating immigrants like this, even though we have followed everything they asked us to do.

     

    I've attached the RFE and my DS-3025 proof of completion as reference

  14. I applied for SSN with my AOS paperwork. When my EAD arrived I went in to the office and they said I had already applied for one on the date my AOS paperwork was issued. I told them I hadn't received it. They said they would send another and to wait 2 weeks.

     

    2 weeks, nothing. I phoned the office and they were very unhelpful. Basically said I just had to wait.

    I waited another week and called back. They told me it had definitely been sent, I asked if they had proof of postage of personal important documents and they said no. The woman was actually helpful this time though and said she would reorder my SSN to arrive at their office and told me to come in 2 weeks to collect. 

     

    Waited another 2 weeks, went to the office and collected my SSN no problems.

     

    To say the SSA are incompetent were an under statement. I found that constantly being on their case about it eventually got me the SSN, who knows how long it would have taken if I hadn't made my self a nuisance 

     

     

     

     

     

     

     

  15. Thanks a lot. I think we just over thought the whole thing. She told me she finds taxes and stuff really complicated, so when I read the W-4 I thought it was pretty simple and I think she was worried it shouldn't be that simple because I seemed to explain it in a way she actually understood it.

    No luck for me, I was told "we don't make phone calls" and that was that. 30 days came since my application and they sent me a letter saying it hadn't been processed and I have to wait until I get my EAD or Green Card. AOS packet just recently sent off so it will probably be a while

    I came to USA on KQ visa in December 2021, and married US citizen in Feb 2022.

     

    I'm from the UK and everything to do with taxes here seems way to complicated for me (maybe I'm just over thinking everything?)

     

    Anyway, my wife (US Citizen) has filed last year's taxes and is now talking about filing form W-4, which I believe is about how much money gets withheld from pay in order to pay taxes (correct me if I'm wrong).

     

    We have just sent off my AOS packet and I don't have SSN yet (applied for when I arrived in the US but told it couldn't be processed and have to reapply after I get EAD/Green Card), meaning I'm not working right now and have no income from the UK (or anywhere) at all this year.

     

    On the W-4 it seems to be logical for my wife to tick 'Married filing Jointly' and it would seem we don't need to fill in any other steps on the W-4.

     

    Does that seem correct? My wife gets huge anxiety about this as she is always concerned she's going to do it wrong and get penalised by the government, and as this is my first time looking at a W-4 I just want to clarify it, and make sure I'm understanding it correctly.

     

    Any info will be greatly appreciated, thanks in advance

    Managed to find a number for SAVE verification department - part of USCIS that work with DHS I guess. They told me the SSA office need to phone them on the same number I did and they will sort out the verification issue.

     

    I phoned the SSA office and they told me, and I quote "we don't make phone calls".

     

    Basically I've had it confirmed by the guys that run the SAVE system that in my situation the SSA agent has to call them. The guy I spoke to told me the SSA offices will regularly let the applications (especially those on K1 visas) "time out" after 30 days when they get denied due to not being verified, when all they have to do is call the SAVE verification department and it can be sorted in under 5 minutes. They clearly refuse to do this, and who knows why.

     

    You said start over at another SSA office. Can I do that even if this application "expires"?

  19. Update for anyone who experiences similar:

     

    I phoned USCIS and they had no idea what I was talking about, or what the SSA was saying they required them to do. It very much seems like they are just passing the buck on to each other to avoid giving out SSNs. They said they would look in to it, but I don't have high hopes.

    It’s not going to go through next week or in 30 days. The social security office needs to send it off to have your entry manually verified by USCIS.  I’ve seen it reported a lot with UK passports. Your entry is recorded by a scan of your passport.
    If that scan records your entry as JOHNDAVID MOORE

    and your name is JOHN DAVID MOORE, then you don’t match the USCIS database and won’t match in 30 days. USCIS has to manually verify your entry if there is any kind of glitch like that. You’re likely in the database, but not under the exact name on your passport. 

    Everything on my I-94 matches my passport and that info is the same on all my documents from USCIS.

     

    If I call the SSA office and tell them that they need to send it off for manual verification by USCIS, is that something they will do? The other cases you've seen, were they able to resolve it?

    Thanks for this info. I can confirm my I-94 record states K1 as class of admission.

  22. Hello. I couldn't find anyone who's experienced similar to me.

     

    I arrived in the country Dec 12th 2021, and today I had an appointment at the SSA office to apply for my SSN.

     

    Today is day 40 after entering the country, so no where near day 75 of the 90. I had all my paper work and the woman at the SSA told me everything is in order. She then told me in her experience K1s applying for SSN rarely go through the system and get denied when she tries to confirm it on her system - and that's exactly what happened.

     

    I got told she will try again multiple times over the next 30 days, but that is the maximum they are allowed to hold my information for. After that, if it hasn't gone through I will get a denial letter and have to go back once married and have green card / work authorization.

     

    Seeing how K1s are elligble, it seems odd that the system would automatically deny the application? The woman seemed competent and even said that she knew K1s are supposed to be able to get SSNs but her experience was they rarely go through.

     

    Anyone had a similar experience, or have an insight on this? Thanks.

     

    PS - I'm in Arizona, not that should make a difference for SSN applications, and I even asked at my appointment and the response was "I don't know if it an Arizona thing"
