    I hope you are right with this. I mean I did read about the USCIS threatening with furloughing 70% of their staff again. I also see naturalization ceremonies happening but no interview appointments for GC applicants, although some field offices are open again.

    I am currently adjusting status from F-1, married to LPR. We initially filed with a joint sponsor because my husband did not meet the income requirements of I-130 at that time. Now our sponsor has been layed off due to COVID-19. He now gets unemployment money and will get his old job back when the lockdown is over. My question is: do they request an actual proof of income from the sponsor at the interview or is everything we sent with the initial application enough? Thanks in advance!

    I could really need your help/experiences on this one. I am currently adjusting status from F-1 being married to LPR. As my husband is not eligible for insurance through his employer, we tried getting insurance over the Health Insurance Marketplace of NYS. After going through the rather complicated process they found my husband eligible and me not eligible for enrolling over the marketplace due to “not being lawfully present”. How they got to this ruling, I honestly don’t know. Even more so, as they accepted my documentation in the first place.  I provided them with the NOAs for the I-130 and the I-485. Although my F-1 is void by now, I applied in time for AOS and never overstayed. However, the only possibility for me to get insurance over the marketplace now, is appealing this decision.  The whole appealing process kind of freaks me out, as I really don’t want to have any troubles and I don’t know what I sign up for with this. On the other hand, I don’t see any other chance to get health insurance. If anyone could share experiences or thoughts on this it would be much appreciated.

    Sure! My sponsor is a dentist here in California and the CDA (California Dental Association) released an advisory a few weeks ago telling dentists to only perform emergency procedures. At the same time I received a really sizable job offer, and then I used that to claim both financial hardship due to my sponsor’s reduced work schedule, and financial loss due to being unable to accept the job offer. I also wrote a cover letter talking about how me being able to work would cause a positive impact in my local economy and help stabilize my family, etc.

     

    I also faxed them the letter, the RFE request, the CDA advisory, and my job offer a total of 9 times over 4 days.

     

    All in all I’m really happy this did the trick, having the EAD is a huge quality of life improvement and a relief. I’d be more excited about the AP if it wasn’t for COVID.

    Jan 21 2020 - Accepted fees

    Mar 05 2020 - RFIE on my I-485

    Apr 01 2020 - Expedite request for EAD

    Apr 01 2020 - Expedite request denied

    Apr 21 2020 - RFIE response received

    Apr 27 2020 - Case is ready to be scheduled for an interview (I-485)

    May 04 2020 - Expedite request for EAD (again)

    May 13 2020 - Expedite request approved

    May 15 2020 - I-765, I-131 approved, Card is being issued

     

    Now just waiting to receive it :D

     

    Do I need to wait until I have the card in hard to start working, or can I already start?

    Thanks for your answer! Unfortunately, my job offer is not at all connected to that sector. :( Even with creativity ;)

    As for the legal status: if you are here with F-1 and you met all requirements, they grant you automatically a so called grace period of 60 days. Within this period you can remain in the US beyond completion of your studies. However, if you’d leave the country in this period they would not let you back in on the grounds of your old F-1. As you are not out of status in this grace period, you can apply for AOS. Bottom line:  you’re not out of status until the end of your grace period.
    This is just my experience and I am not a lawyer.
