    its because people from my country ( like me ) think that we can have the entry in the US denied for any reason lol

     

    so my friend with this unemployment situation Is already thinking that they gonna stop him at CBP and arrest him for being collecting unemployment while overseas.

    How he is able to get it when not under normal circumstances?   it is the governor who is doing this under the PEUC in the best interest to get Florida back to work

    As far as the unemployment insurance part,  most states require you report 2 places (in the US) that you have made applicaitons to to keep your unemploymewith  coming in 

    and reporting this is usually done online with names and addresses of those companies for which you have made applications (for 3 weeks) with an in-office to Department of employment once a month to show in-faith trying to get a job.    Understand anything (because of the virus) can change at any time but it is going to take a long time for normal to return

    “Continuing to waive this requirement maintains Nevadans’ access to unemployment insurance benefits while Nevada gradually reopens with new safety precautions in place for workers and customers,” said Gov. Sisolak.

    “While some businesses are starting to reopen, we continue to see the unemployment rate rise and it makes sense to keep this measure suspended to assist Nevadans in continuing their unemployment insurance benefits, ” said DETR Director, Heather Korbulic. “Our agency will continue to work with the Governor’s Office and the Department of Labor and other federal partners in moving forward as we support families throughout Nevada and participate in the reopening of the Silver State.”

     

     

    this is what it says in the FL website:

     

    Governor DeSantis has, however, directed DEO to waive the work search and work registration requirements for claimants through July 4, 2020. However, answers to work search questions are still required to process your claim in the CONNECT system but will not impact benefit payments.

I think you could best help him out by helping him complete job applications.

     

    I know others have mentioned not making a claim the weeks he is away; but I don't think that's possible. I think he would lose the unemployment for not filing for consecutive weeks or have to have a hearing. He may be best helped by calling someone from unemployment in his state.

    Im trying to help him...but he just told me he is going overseas regardless

    at this point, nothing that I can do about him anymore...just hope he doesn't go to jail ! :(

    • You must have a minimum amount of wages earned in what is called the "base period," which is the first 12 months of the past 15 months from when you filed your claim;

     

    maybe that's the reason he got approved??

    As noted above, if he were to get an interview tomorrow or called back into work or whatever, would he be able and willing to do so? Flights alone in the current environment may make that impossible, or possible required quarantine procedures. I can't tell him what to do, but I do think it would be a very tough argument to make and it's his case to make if he tried. I would not want to be in that position.

     

    It's not about "canceling" unemployment. He just cannot make claims for the weeks while he was not available for work. So if he's gone for 1 week, that's 1 week of UC that he wouldn't get. He would continue to get it once he returns.

     

    Do what he needs to do. Just know the consequences so he doesn't get himself into trouble afterwards (a false/improper UC claim can have all sorts of consequences).

     

    The weirdest thing is that my friend was not furloughed. He has not being working since august 2019.

    Since his wife was pretty much paying the bills, he was just studying...

     

    His wife lost her job last month and their situation became really BAD....so he applied for unemployment and got approved ( I still don't know HOW he got approved if his last job was in July 2019 ).... he never lied on the paperwork...he made it clear that he only worked in 2019

    The above link provides some possible exceptions. The onus would be on him to show that he met the UC program's requirements.

     

    Do you know what state he is located in? As noted above, UC is dictated by the state.

    I was unable to find any (reputable) sources suggesting it's fine - only that there are exceptions and gray areas that one's specific circumstances may fall into.

    It is just because he really needs to go see his dad....

     

    If he "cancel" unemployment he would not be able to pay rent, or car payments. so he is really confused about what to do....

    not sure if this is the right place, just asking for a friend.

     

    He is a Green Card Holder receiving unemployment since May ( unemployment + cares act )

    His father got sick overseas ( coronavirus ), he plans on go overseas to see his father.

     

    Is he allowed to do that while receiving unemployment???  his plan is to stay there no more than 1 month

    will he have problem re-entering the US??

  10. Ok. this is just a "worst case scenario" situation, but to keep it short:

     

    Im a conditional GC holder, and I stayed 11 months overseas on a single trip. ( no reentry permit and  I did not have any problem at all reentering the US )

    Came back to the US, stayed 3 weeks, and went overseas again.

    I ll be staying overseas for 2 months and 1 week and then I ll fly back to the US for good...( I was supposed to be overseas for just 2 weeks, but I decided to do a new

    medical procedure  )

     

    anyway....I have to Remove conditions by October.....Im afraid that on my next trip to the US,  CBP will take away my green card because of my long absences..

    so my question is:

     

    - If they take away my green card, can I stil remove conditions??

     

    I have thousands of proofs that I did not abandon my residency, but Im just thinking about the worst care scenario happening.

    Do you think I'm gonna get in trouble If I travel now AGAIN, only 3 weeks after I get back after a 11 months trip.

    I will be spending no more than 1.5 months overseas...

    So I ll be removing conditions with a divorce waiver. soon

     

    I still have a joint account with my ex-spouse,

     

    I went to Wells Fargo today and they gave a paper saying that we have a joint account opened in January 2017 ( even tho my ex-spouse only added me to that  account in July 2017 )....and the paper show both our names....

     

    I honestly don't really use the joint account ( we tried to share it in 2018 but it ended up on with us fighting about me spending a lot of money with food. lol  ) , my spouse was the one using that account all the time....

     

    I always transferred money from my Personal account to that Joint account to pay our bills..

     

    Recently my spouse have been sending me some money ( few transactions FROM the joint account TO my personal account ) but other than that, It just just me send money TO that account to pay bills.

     

    So do u guys think I should even add that JOINT ACCOUNT to my ROC process???

     

    Should I send the letter from the bank only???

    Should I send the last 3 statements ???( the 3 last statements coincidently  is showing few $$  transactions between us,  the IRS tax return $$$ on both our names and the $2400  trump check )...

    Should I send nothing?????

    USCIS says 12 months. as longs as you can prove that your immediate family is in the US and that you have access to your house, etc in the USA

    but I think that depends on the officer that is interviewing you for Citizenship.....I 've read some cases about people who had few 5-months stay and the offices did not grant them citizenship

    I just wanna share my experience because I have been doing a lot of researches on the last 10 months and I always read stuff like "you cannot leave the US for more than 6 months without a reentry permit", etc. Unfortunately there are not a lot of information available about that ( there are information-- but I could not find people sharing their experiences -- so Im gonna share my case )

     

    Here is my experience ( Im not advising anyone to do that - Just wanna share )

     

    I left the United States 11 months ago without a reentry permit,  I did not know how long I would stay outside the country but I knew would be for at least a few months.

     

    So I landed in US ( Miami, Florida ) YESTERDAY  ( I had proof of all my ties to the US, all my medical records from my medical treatment overseas ) and I knew I would probably encounter some aggressive questions from CBP or even "lose" my green card //or  be sent to a Immigration judge.... 

     

    CBP: 

    - Good morning!

    - Good morning!

    - How long did you stay outside the US?

    - 11 months.

    - Why?

    - I was doing a medical treatment in my country.

    - What type of medical treatment??

    - Mental health, depression, I was supposed to be here last month, but with coronavirus....

     

    ( he was about to STAMP my passport...but then....silent....typing his computer for like 1 minute )

     

    - ok, You are all set!

    - Thank you!

     

    ( again - Im just showing what happened to me, not advising anyone to do that ). he did not ask me any proof of anything. Im a conditional green card holder.

    This stay will most likely affect my citizenship plans. So AGAIN, just showing u guys what happened to me.
