Is this based on the advice of a licensed physician?

No, just because I have a lung tumor and I have that proof though. But they never said that I need to separate rooms and because I cough and my husband needs to get up early it’s our decision.

Yep seems you did not take your Medical Records.

Didn’t think this is so complicated interview.

Which a home visit would make apparent, and if so a denial is certain. You are living in the same dwelling like room mates, not spouses, are hiding it from USCIS.

If you have 3 years of marital union with your spouse or 5 years as an LPR. But filling N-400 can force USCIS to decide your I-751. Which seems likely to be denied.

    1. When did you marry?

    2. When did you become an LPR?

2018, and I got conditional green card in 2020.

we don’t share the room just because of health condition.

3 years of marriage (living in marital union, which is doubted by USCIS now)

    AND

3 years of having Green Card (being LPR) - have you been LPR since September 2020?

There's also other requirements, these are just basic ones.

Plus N-400 depends on I-751 approval.

Fix I-751 first, that would be my advice.

Thank you yes I meet the above requirements. Will look to see what I can do at this moment. Appreciate it

That raise the question if you will be eligible for 3 year filing rather than 5?

I’m eligible to file applications for citizenship after three years of marriage

Actually we already reached 5 years of marriage as of now.

    1. Did you guess or did you answer as did because you thought they were the correct answers?

    2. What evidence did you submit the shows you live in the same dwelling as your spouse?

could be. You might also get a home visit.

    hire a lawyer

You can remain in the U.S. until a final order of removal from an immigration judge. You can also file another I-751 before your final removal. Your lawyer will advise you.

The decision is not made yet so I can apply for citizenship maybe?

and what if I gets denial after they review? If so. Can I remain in US until I appeal on the court?

I guessed and should’ve just said the truth that we don’t share the same room since Covid.
I submitted the utility bills, insurance cards, phone bills, bank statements and letter from family. joint tax return and so on.

  7. Today I went to my interview for I-751 and has a young officer asked a lot of detailed questions like what did you husband wear last night and what breakfast did he eat? I answered wrong as I didn’t prepare for this type of detailed questions.

I was separated from my husband and was asked first and then my husband was the second to answer but there are a few questions we answered differently.

and the officer said in 2020 bank statement there was only 8 dollars deposit to the account that it shouldn’t be as my husband uses that card for groceries all the time.

anyway the case now became the interview is completed but the case must be reviewed.

I don’t think my case will be denied but will I need a second interview? What should I do please? In case it gets denied I can still remain in us and appeal? How does it work please?

This is what i don't get from other applicants,or even from my friends. No matter how many times i study the ROC instructions, there's no sentence saying to submit passport copy.

Well,i submitted my ROC on Wednesday without passport copy.

But let's wait for other people who might experience the needs of passport copy.

Thank you all! If that’s the case, I don’t need to replace my passport now? I can let it expire and after the COVID gets better I can replace my passport then?

  9. Hi all,

thanks for reading my question. I submitted my case to remove my condition on my green card in 7/2020, my passport will expire 2/2021, I have two questions.

    1. I didn’t include my passport in my removing condition package I sent to USCIS, and instead I included my green card and state ID. And my passport is in another state and with the quarantine, Do I need to fly there to get it so that I can replace my passport? I locked I the drawer so no one can open it and mail it to me. Or I can wait after the COVID to pass and probably replace it later next year.

    2. Once I replace my passport, do I need go let the USCIS know that my passport number changed? Since I had included my passport in my initial application for the green card but not when removing condition.

    thanks,

Once you get a license in that state, you are now considered a resident of that state. It is illegal to hold a license in 2 states at the same time, you should have turned in your license from your previous state to get your new one issued. They usually void it by stamping it, or punching it with a VOID stamp punch. If you are currently holding valid licenses in more than 1 state, I would fix that problem first.

Thanks. I don’t have drivers license in the state I married my husband and I only got state Id since I didn’t learn driving back then. So I will record my time spent at my daughters house.

  11. I married a US citizen and in august 2018 I got the conditional Green card. After that, I visited my daughter’s house in another state and stayed there for a few months to take care of her. And I got driver’s license in that state too. I visited her a few times and each time I spent a few months. And does it count as residing? There is a question in I 751 asking if I have resided in other addresses after I got conditional green card, and I’m wondering if I need to include my stay in my daughters place in the form’s last page where it says additional info. If I do, can I explain in the letter I stayed in my daughters place is because she was pregnant and then she had a newborn?
