  1. Update for anyone who has this problem in the future:

About 5 weeks after having my congressman contact the DOS to ask why NVC still hasn't received my petition (its now been about 100 days since NOA2), they have finally responded and the California Service Center said they accidentally sent my file to the NRC (national records center) instead of the NVC. So now they have to request the file and then send it to the NVC which they said can take up to 6 weeks. Nothing has been mentioned yet about if they will reassign me a new NOA2 approval date or not since it expires in three weeks. Just wanted to let those know if this happens to anyone in the future, which I'm sure it will. I tried all possible avenues of contact and my congressman was the one who solved it. Start with them. or a Senator (mine wouldn't help me since the congressman already was).

Also, the only way to actually get in contact with the California Service Center yourself is to either submit a case inquiry on the uscis website(which takes about three weeks for a response) OR to call USCIS and make them have a tier 2 officer call you and if you LUCKILY answer the call they make to you one of the random 14 days after the request is made, they can also send an inquiry on your behalf to the California service center. DO NOT WASTE YOUR TIME talking to just anyone at uscis, they are absolutely despicable and useless individuals- as well as those at NVC who answer phones. Just FYI

When you spoke to USCIS, did you verify what was the day they have sent over your case to NVC?

One rep told me February 23, another told me she didn't see they ever sent it, and the last one I talked to hung up on me just telling me a tier 2 would call. I asked for a tier 2 to call two weeks ago and they never did so I don't expect this one to either :(

Hey, so I searched VJ for similar cases like yours and I found that a lot of people have had the same issue. I'm linking the threads here, hopefully you'll find them useful:

Here, the person on their timeline said the following: "Finally with much struggle & help of senator & reconstructing package we got a second approval NOA2"

I think you should reach out to your senators, if you didn't already.

Thank you so much for this! I've done the same thing as the first person, emailed everyone, contacted my two senators and congressman. My congressman is the only one who is actively trying to do something right now. One senator called me and told me they won't try to help me unless its been four months! It was the dumbest thing ive ever heard. Hopefully the other senator tries to help. I called uscis the other day and they said someone made a service request to contact the california service center about it, I think it was because my congressman contacted the DOS. They said itll take until may 27th for them to respond. I'll keep trying!

If the other senator doesn't get back, contact the second one. I had to contact both of the senators in my state until I saw any movement on the N-400.

Good idea. A rep from the senator just called and told me they can't help me because they called nvc and we're told it can take 4-5 months for Nvc to receive and process the case. What a useless human being. At least my congressman is actively helping me and a service ticket was made to contact the California service center about it

Have you contacted both agencies ( uscis and nvc) and what was their reply ?

Yes. NVC says they still don't have it. I also contacted their research department and they just said they've contacted USCIS to locate it. USCIS says they don't know, and it's impossible to be transferred to a tier two officer so they keep making tickets to have one call me but it's not working out.

Only thing I can think of is contacting your senators, representatives and the USCIS ombudsman?

Have you tried all of those?

Yes :) my congressman contacted the department of state and they reached out to USCIS. I sent my senator my information Monday so I haven't heard back from him yet. And I haven't heard back from the ombudsman after two weeks.

We got our hard copy of our RFE today. Turns out I messed up in the chaos of printing everything and never sent in page 7 of the i-129f. I'm amazed that it made it past the USCIS adjudicator the first time around and was actually approved. Seems like a pretty easy catch lol. After we were approved and sent back to USCIS from the NVC I went through my scan of our submission and noticed it wasn't in there. Was really hoping that it was just me being dumb with scanning and that I actually included the page in the submission. Guess we know now!

This is interesting. I was going to reach out here and say I was approved February 22, and my case still hasn't reached the NVC. I have no idea what's going on.

    Should I get a lawyer?

Great news! I'm glad to hear that Warsaw is being so accommodating.

May I ask you, do you know of anyone who had to wait a long time for the USCIS to transfer their case and how to solve this? It's been 78 days and counting, I've exhausted all avenues it seems to get in touch with both uscis and nvc and I've had no luck still with my case making it to nvc. What do you think I should do?

See above your quote.  This is a different filing type but they still see USCIS to NVC like we do.  And what Greenbaum said might be what is going on with yours.  It might have been "received" by NVC but missing something so it was sent back to USCIS and yeah in limbo.  Or it even might have bounced around like the first quote.
I would suggest like Greenbaum says, just hold off for a bit and wait until the 90 days pass.  Or give it another week and email about case number inquiry to see if they give you one (NVC that is).  I am purely going off of forum research though and not from personal experience.  I would keep checking your current case to see if it updates the NOA-2 date (with a new one for this process).  If you see it updated, then you know what happened and you can get an NVC case #.

Thank you so much for taking the time to do this for me. I'm having a really rough time already with the closure of the Russian embassy and trying to figure out how I'll be able to get an interview and dealing with this on top of it.

Bless you and your family. You have a very kind soul ❤️ and have a wonderful day

I was perusing old posts (K1 and CR1) and it looks like maybe the status is not updating, even though NVC received it.  I know that sounds strange if you tried to call NVC and they are clueless.

I am going to keep digging to see if i can find other stuff, after my shift.

Thank you so much for helping me. Ive submitted my approval notice to nvcresearch@state.gov but it's been two weeks and they haven't gotten back to me. My congressman also contacted the state department about it a week and a half ago and they have just said they will contact uscis about it. I just feel sick about it all. I made a consultation appointment with a lawyer to see if they can help too

  11. Sorry for posting this again, but no one was very helpful on my other posts. My I-129F was Approved on February 22nd and NVC still hasn't received anything. I've called uscis and nvc multiple times asking what's going on and they were never helpful. USCIS said to wait 90 days and if nvc still doesn't have it then they will submit a service ticket to California service center to ask about it. I'm afraid the service ticket will take a long time and by the time they find it, it'll be expired.

Can anyone give me advice please?

I’m not writing this to ask any questions or anything, I’m simply stating how I possibly feel that things will need to go. I am considering working with a law firm to do a lawsuit against the Manila embassy in the Philippines. After reading too many updates and seeing videos on YouTube and other sources, I am beginning to feel that unless I and others take action things will not happen with k1 visas at all. I’m tired of the lies coming out of the Philippines government and the fact that they don’t seem to care about anything with vaccines or the people. And to be honest I really don’t think our current president will do anything either because of the fact k1 visas are done the legal and correct way and he only seems to be concerned about the illegal people so I think we have been duped by him. I’m sure I will probably get some negative comments about this and people have the right to their opinion and you can disagree with me if you wish, but I will ask that you respect my opinion and how I feel as I’m sure others feel the same way.

They just filed the manila one. I'm sure they will do another though. Go to siskinds page and email them about your interest.

Sorry but it is NOT so. It is the Russian government that asked the ambassador Sallivan to leave, and forbid the USA embassy in Moscow to hire Russian people. Which simply led to shortage of staff for interviews. There are 200 people left at the embassy instead of 1200 in 2015. It is not the American government that doesn’t want to issue immigrant visas, it is Russian government that expelled 75% of American diplomats from Moscow .

so the lawsuit is simply a waste of money... USA is not responsible for unfriendly actions of third countries ...

You can believe what you'd like. Good luck!

I’m sorry to put put my word in, but you have no chance in mass lawsuit against who? It’s not the problem of American embassy , it is Russian government that expelled American ambassador and cut 75% of American embasssy staff. Who are you goi g to sue ? For what ? What is the requirement to the embassy you want to pose?  It is not that American embassy doesn’t want to interview , it is that Russian government expelled diplomats from Russia and there are simply 200 people at the embassy left.

It's the american side that decided to halt visa services

Hello guys, today we have some very sad news: US embassy in Moscow announced that it will stop issuing all visas except for diplomatic ones. Any ideas what we can do? I’m very frustrated

little update: they stop issuing all non-immigrant visas, but will continue to process some very limited number of immigrant visas.

    Where did you hear this?

    And do you mean indefinitely?
