    Yeah that’s what I’m hearing from everyone. It just worries me because my husband’s interview was 2 years ago. May of 2018. We just had our 2nd update on May 5th in these 2 years. We haven’t been notified of the case being almost complete nor a second medical. Still, every case is different and it depends on the speed of the CO working on the case also. We are praying for the best and really hope all of us waiting for our spouses get reunited soon inshallah. 

    If you haven’t already you should do an inquiry with the Senators office. We got some extra information this way, the office for us was great, they were sending an inquiry every month. It also makes a difference in time too if the sponsor is a US Citizen vs resident. Inshallah they will catch up in this time and you’ll be contacted soon.

    I was checking regularly and it only updated when there was any inquiry either by us or the Senators office. It’s exactly as I suspected, anyone put in AP just is put in a queue and it’s taking about a year and a half cycle. I know because everyone who had an interview around same time as us (September 2018) was contacted around the same time as us. My husband went collecting everyone’s phone number and did a survey getting everyones details and it was all the same pattern. That whole year and a half it was just sitting at the embassy doing nothing, no “processing” is being done. It just depends how backed up they are on certain visas but they’re doing it in order. We were contacted in February so it makes sense for you having an October interview you were recently contacted.

    We submitted ourselves as that’s what I had researched. Upon viewing it there was the additional questions that was added to the DS-260 that weren’t there on the original we filled out as they changed the form. So we filled out the new questions and updated any information, signed and resubmit. You don’t pay again. The DS-260 is only reopened by the embassy themselves. You can use the online inquiry form on the embassy website to ask if you should do it. I just know in order to receive your visa and for re-oath/interview it needs to be completed.

    Yeah, we emailed the embassy in March and notified them of the expired status and they didn’t reply nor did they update it back to AP until yesterday. Also in the beginning of March we updated their DS-260 because it was open. So now everything is back to normal thankfully. Soon you guys will get the passport back with the visa inshallah. Hopefully this COVID-19 goes away soon. Thanks for the info by the way!

    No worries. They didn’t reply to us either, just they updated the status. Inshallah they reopen soon and we’re all contacted and then reunited. It’s been a long time.

    If your aunt hasn’t had contact with the embassy in awhile she should send an inquiry using their online form, there’s one for expired status, as the cases automatically expire when some time has passed with no activity. Just a little note saying still interested in immigrating to the US. Also check the NVC website you might find your DS-260 as “re-opened” this happened to us so we updated it, signed and resubmitted. It should always be in submitted status. Our visa class was also updated from CR-1 to IR-1 when they contacted us to re-medical. We probably weren’t updated because our AP is complete per the email we received. I just checked and it’s still the March date. I’m guessing with the embassy closed they’re probably catching up on other cases.

    I don’t know why your case updated but ours has not updated since March when they stopped working. As far as I’m aware they’re still not processing visas. My husband was in line for another re-oath or interview according to the Senators office. He had been called in for re-medical. Another person he knows was in the last group that got to pick up their passports but are stuck because there’s no flights!

    Congratulations! Still anxiously waiting here, my husband was asked to do his medical again and hand in passport but no change in status yet. I have 2 questions, was your husband asked to come in for a re-oath and did they contact you by email for this if so and to pick up the passport? Others he knows were asked to re-oath but not him.

    Yes my husband (was my fiance) received his visa shortly after the interview. He never moved abroad, and his home from when he was born till he arrived in the US was the same. I think because he had a fairly simple background it was easier to conduct the AP and approve him. Best of luck to you, do not loose hope!

    Yes I believe that to be true. A lot of women are given visas quicker because they are considered lower risk, they have not traveled anywhere, many not even having a job so not much to look up.

    Our case was in administrative processing since 8 months.. but we were very happy as we were getting updates regularly! We thought they are doing work on our case 😭 

    BUT ' recently they asked us to submit NEW MEDICAL EXAM.. we sent that and now after month OUR CASE STATUS HAS BEEN CHANGED TO REFUSSEED? DUHHH??? why is that so? I always heard they never refuse F4 Visa. My mother is very tensed. Idk what should we do rn. Please  heeelpp!!!!!😭😭😭

    Everyone’s status was changed to refused, it’s the new Administrative Processing message. They should issue an apology and should have made an announcement first warning people they were going to change it they caused a lot of stress, confusion and panic. I went into shock had a panic attack at work and had to go home! No one has an official answer but it seems to be an update on the Administrative Processing message. When you are put in Administrative Processing technically your visa is “refused” until everything is done.

    Lol I was at work when I saw, had to go home, I completely shut down, panicked and drove home crying I was in shock couldn’t think straight.

    True. I had a complete panic attack I’m still recovering. My head hurts.

    Here is our timeline so far. 

    July 26th 2019 - 1st interview ( I was with him at first interview)

    July 26th - Put into AP for not having medical exams 

    July - November - Husband did 4 months of drug monitoring 

    November 19th - Completed Medical Exam and sent to the Embassy

    January 19th - My husband's medical exam expired

    February 20th 2020 - Husband went to Second interview (interview went well, but no decisions. They told my husband they would be sending him more information, but as of today we have not received any information). 

     

    Up until today (March 3, 2020) my husband's case has been in AP. His case has been changed to refused. 

    Has anyone had experiences with refused updates? I have been told it is not a denial, so I am still hoping we will be together soon. I would just like to hear of other cases with similar experience

    Seems to be happening to everyone right now, lots of posts. My husband’s case suddenly said same thing today and I completely freaked out. Now I’m seeing others going through the same thing I’m recovering from the shock. For now anyway!

    Mine too was in Administrative Processing last night and today same date but “refused”. I was at work had a panic attack crying I had to go home. Seeing all your messages is giving me hope I’ve been inconsolable.

    You can stay as long as you are able to meet sponsorship requirements and maintain a residence in the US, I would not go more than 6 months in the year. You have to have a permanent address in the US where your spouse or fiancé would live. The longest I stayed at one time was a month, I wasn’t able to be gone longer than that otherwise I probably would have stayed longer. I filed the petition in 2017 so we have been going through it since then.

    Your only option is to wait. As a sponsor you have to show you can support your spouse/fiancé so unless you have another joint sponsor you have to stay in the US and work, maintain a residence. I have gone to visit my husband a few times but the times in between are very difficult. I’ve had to raise our daughter away from her father and taking plane rides across to the other side of the world with a baby/toddler is very challenging.

    Thank you. I know how you feel, we have felt the same. I think a lot of people have been stuck in Administrative Processing. If you look at the monthly visa issuing reports not many IR-1/CR-1 Visa’s have been given. My husband does know of a couple others who got their visas, one was 18 months in AP. At his medical renewal he asked others there and they were all on similar timelines to ours. More than 1 year in AP seems to be the normal.

    I see many who are in AP for 12-18 months and a few actually got approved after 3 months. 

     

    Those that filed from 2017, 2018, 2019 can you let me know if you got approved for K1 or CR1 and how long your AP was? It will help people gain a perspective. 

    I just replied to another post but I recently saw someone else got approved, they got the same email my husband got, asking to renew their medical and hand in their passport. They got their visa about 2 months after. Here is the link

    Hi. My husband received an email recently saying that his administrative processing is almost done and that he needs to renew his medical exam and hand in his passport. He just did the exam so we will be waiting anxiously for anymore updates. He had his interview in September 2018 then had been put in Administrative Processing, the only time we saw updates was when an inquiry was sent. Then about a month ago we noticed CEAC was updating on its own and then we received the email from the Embassy.

    If USCIS were to review and then revoke it, there would be a material misrepresentation bar. This carries a permanent (although waivable) inadmissibility.

    I’m going by what she explained, she doesn’t know why it was sent back, she said it was revoked but it’s not clear. She has to contact USCIS to find out what the problem is then go from there.

    What about ROC is being impacted by the current immigration climate? Do you have any evidence that more I-751s are being denied or more heavily scrutinized? Evidence of more IJs actually removing LPR status?

    I don't follow ROC as much as many other processes as ROC itself has ~97% initial approval rate (of which clerical and administrative denials are likely to make up much of the denials), so less help is often needed. But I have not heard of any changes here.

    I haven’t specifically looked at statistics  but personally experienced questions despite being an unconditional LPR. I initially obtained my GC through marriage and got divorced after 8 years of marriage. I applied for citizenship and in my interview in 2017 for naturalization my marriage history was discussed. Basically I think to assess my moral character, intentions etc. I ended up being ok and got my citizenship but the point is they still brought it up. Probably it’s not that big of a deal renewing a GC but for Citizenship they do ask you a lot about yourself.

    True but you still have to prove the “in good faith” part and in the current immigration climate who knows how nice your case reviewer will be. I doubt she has to anyway as they have been married 5 years.

  22. They have been married 5 years, if they came to the US recently she should have come on an IR-1 visa and been given a green card without conditions. In this case it’s no problem but as her sponsor he will continue to be held to the affidavit of support conditions even if they divorce. 
    If she came on a CR-1 Visa and was given a conditional green card it can be a problem, this is given if the couple were married less than 2 years when the visa was issued. You have to apply for the conditions to be removed and if no longer married they may deny it unless there are other circumstances, such as domestic abuse.

  23. The case may have been sent back to USCIS because they believe the petition was approved when it should not have. Perhaps some information was missing or perhaps some dates don’t match, it could be anything. USCIS may review the case again.
    You are required to stay in touch with the Embassy as the application will expire after one year. You have to keep enquiring, also you need to keep an eye on the NVC website where you submit documents as sometimes after 1 year the visa application status changes from submitted to reopened. It’s automatically doing this. It needs to stay in submitted status. 
    If it was sent back to USCIS you can contact them directly to find out why it was revoked. The Ombudsman through Department of Homeland Security is who you contact for cases at USCIS, they can investigate. https://www.dhs.gov/case-assistance
