Sadly, it was 1 day before our (big) wedding was supposed to be as it was canceled due to the COVID19 virus. Its rescheduled, but now he will have no friends or family able to come. Now we are even more glad we did the courthouse wedding 3 days after POE though!

Hi - yes. I filed in mid December and got RFIE early February. On 2/13 I was notified that they received my response. Today I was notified that my case is ready to be scheduled. 🙌

Hopefully something easy for you respond to quickly. I had and RFIE issued for my birth certificate that I had included in the aos package. Hope it doesn’t unduly delay your expedite request.

Welcome to the club!  Hopefully it's something you can take care of easily.  

USCIS received my RFIE yesterday and this morning I got the update that they received it, so that was pretty fast!  

It is not separate.  The EAD process stops until USCIS receives the long form birth certificate.  Make sure you the correct info within the timeframe thats on the the RFIE letter.

Hello everybody- I filed AOS in December.  Biometrics on 1/8. Today I received an RFIE 🤦‍♂️It was for my birth certificate that I know I provided in my I-485.  I already sent a copy of the BC with translation back to USCIS.   I would like to travel out if the country this summer so here’s hoping that my file is on hold and not put to the bottom of the pile!

I did my Biometrics on 1/9 and also no update yet.  My notice had a Code 5 and they took fingerprints of two of my right fingers (I guess since I was already in the system)  Don't know if that has any bearing on the reason for the slow update...

Hello fellow FB-3'ers!!!

I skimmed the posts and it look like I am in the real minority.  I'm currently in the US on an investors visa and have applied to adjust status for my wife and I.  Has anyone here received their green card via AOS?  If so, it would be great to hear about their interview experience and see their timeline.

I am close to submitting my AOS package to adjust from an E-2 Visa to Green Card via an approved family based petition.  I have a question on employment.  My E-2 is valid for several more years.  Can I continue to work at my company while I wait for my EAD or do I need to stop working once I submit my package and until the EAD arrives?

It doesn't make sense that I own a business and work in the the US, spend the majority of my time in the US and a leaving for a quick trip would open me up to fraud charges.   I have been waiting for 12 years so another 60 days is no big deal.  Was hoping to have my AP document to travel during the summer and now cutting it close.  I cant seem to get a straight answer so I think I am just going to wait it out.

If I understand your advice, I am able to file for AOS before 90 days of my last date of entry and it won't be denied for that reason by USCIS.  I am worried that I get someone who is not familiar with E-2 visa deny me for that reason.  

I guess the E-2 is a quasi dual intent visa... you can do it but need to file another form that waives some rights of the e-2 visa.  So have others filed before the 90 days and been approved? I have searched and not found others that adjusted with a E-2 visa under a family preference.  Anyone out there that can share similar experiences would be welcome.

ok thanks!  I am just outiside of the cutoff date for filing my AOS application.  Hope to see at least a few days of movement in the October bulletin.  I have been waiting for almost 12 years!

I am in the US on an e-2 visa and will be traveling abroad soon. My priority date will hopefully be current for me to apply to adjust status under family based preference.  Do I need to wait 90 days after entry date to submit my application? Or since I have an e-2 visa that has dual intent can I submit as soon as my date is current?  

In the US on E-2 visa with wife who has also been working. My priority date to adjust status is available soon as Family based preference 3. I am wondering if anyone else has adjusted status in a similar fashion and can share their experiences...When I file, what RFE documents should I expect?
