  2. 😬 GOOD LUCK! I'm filing my 2019 taxes now. I'll probably send my thing in like 2 weeks or so? 

     

    Was there any specific order of putting the documents together like we did for the previous filings? 

     

    Do you mind sharing what exactly did you send? 

     

    I spoke to an attorney yesterday and she suggested sending everything from the beginning of the marriage to present date BECAUSE when I filed I sent documents for the past 2 YEARS (24 months). What did you do?

    But it is the best that you do since you can't really ignore the RFE even though it is weird and especially you can't really provide more. Maybe a lwayer can probably write a letter of explanation or so, I guess.

     

    Do you know if there is a time limit within which you have to reply to a RFE?

    So far I've been handling my case by myself from the very begging and everything was going smooth. I'm thinking maybe it would be worth it hiring an attorney 🤷‍♀️😑

    Thank you @Athens !!! Did you submit this for the initial I-751 or as a response on a RFE

     

    I did submit lease agreements and extensions of the lease as well as a letter from the management office confirming our residence and an affidavit from the building's super attendant.  

     

    I submitted my spouse's Tmobile correspondence under "other" proof of address evidence just to show that we receive mail on the same address.  I also included a letter explaining as of why we don't have joint cellphone bill (his company pays for his phone).

    And they failed to acknowledge receipt of the following other documents I submitted

    1. Health and life insurance which shows my name and my spouse's name.

    3. Joint Costco membership card.
    4. Individual credit card statements.

     

    As they have mentioned not to submit copies of documents previously submitted. Should I submit the other 4 again? Looks like they lost these documents.

     

    Also, In addition to the above documents, I'm going to provide the following financial documents

    1. 6 months of Joint Credit Card Statements (Shows only my name in the statement, but my spouse is on it as well).
    2. Individual, Bank Statements (Checking and Savings) for a duration of 2 years showing the same Home address.
    3. Shared Utility Bill (Car Parking) for a duration of 2 years showing both names.

     

    Do I submit these documents the same way I submitted my application packet?

    BELOW IS THE RFE LETTER. They are basically asking for the same things. I don't understand. Compared to other people that I know, who have gotten green cards, I think I have sent more than enough.

    Unfortunately I don't have anything additional from what I sent 10 months ago. We don't have a kid, we don't have a car, we don't have a joint phone bill because his company pays for his bill and we don't have joint health insurance because we've been changing jobs frequently and we couldn't be on the same plan. 

    Do you think if I send the same documents, but with new dates for the past 10 months it will be sufficient??? AWAITING FOR YOUR ADVICE :))

    2.4.   Joint credit card account summary stating U.S. citizen spouse and petitioner as primary cardholder and authorized cardholder, respectively, along with summary of mileage awards accumulated through use of shared credit card

    2.5.   Joint credit card statements showing purchases for the past 15 months

     

    3.     Additional Evidence of a continued life together and bona fide marriage

    3.1.   Copy of our Japanese family registry filed with the Sapporo, Japan city office, with certified English translation

    3.2.   Copies of passport photo pages, and visa stamp evidence of our trip to Japan in 2016

    3.3.   Flight itineraries for our trip to Japan in Summer of 2016

    3.4.   Hotel itinerary for our stay together in the town of Nikko, outside of Tokyo

     

    Does this additional evidence appear to cover all our bases? I'm also including a brief explanation of the evidence, to tell "our story" to the USCIS examiner. I've included the explanation at the bottom of this post.

     

    I also had some other questions I was hoping to get some clarification on:

    • We originally submitted evidence of a joint health insurance plan. Since submitting our original application, we have changed our insurance plan. Should I include copies of our new health insurance cards? I'm afraid I won't have time to request a new certification of coverage - would the cards be sufficient? Should I just leave it out, since I already provided evidence of joint health insurance?
    • For the certified translation of the Japanese family registry, is it OK if my wife translated the document herself as long as we include the USCIS certifying statement? Does it need to be notarized? They accepted her birth certificate translation for the K-1, but I'm thinking this might be different?
    • Should we include photos from our trip together back to Japan? Unfortunately we don't have any photos of us with her family, and precious few of us together.
    • Should the cover letter be placed on top of or underneath the RFE notice?
    • The USCIS form filing tips suggest the use of sticky tabs to assist in locating items listed as attachments. Do they mean post-it notes? So I'll just stick them onto the bottom of the different sections? I'm worried about them falling off or getting folded while in transport.
    • Should I label each piece of evidence with petitioner name and A#?

     

    Thanks in advance for any feedback, advice and other pointers!  For added information for anyone willing to read more, I've pasted the brief explanation of evidence below. Thanks again!

    I started renting the apartment at our current address in August of 2012 by myself, while (wife) was in Japan waiting for her K-1 fiancé visa to be approved. Following her entry to the U.S. and the end of the first one-year lease, we continued renting the apartment on a month-to-month basis, without a formal lease. We re-signed a one-year lease in March of 2017 following the landlord's request to increase the monthly rent from $XXXX to $XXXX. These respective rent amounts are reflected in the check carbon copies I provided in my original I-751 application, and in the more recent carbon copies provided in the present response.

     

    2.2.   Carbon copies of rent checks for the months of March, April, May, June, and July of 2017

     

    3.     Evidence of combined financial resources, including joint ownership of assets

    3.1.    Joint checking and savings account statements showing deposits and withdrawals for the period of our marriage

    Our joint checking and savings accounts constitute our sole bank accounts. Neither of us maintain separate or individual accounts. The statements included in this response reflect deposits made on behalf of both of our employers, withdrawals made from various ATMs, as well as purchases made on our shared debit card, for the period of our marriage (May, 2013) until now. Payments for our shared utilities (electric, gas, and cell phone) have also been made solely from our shared checking account.

     

    3.2.   Life insurance policy of the U.S. citizen spouse showing my wife, (name), as the sole beneficiary

     

    3.3.   Joint federal tax returns for tax years 2013, 2014, 2015 and 2016, with relevant W2 forms

    We chose to apply specifically for this JAL credit card in order to accumulate mileage points towards regular trips to Sapporo, Japan, my wife's home town. I have included all monthly statements to which I had access on our credit card's online account site.

     

    3.5.   Joint credit card statements showing purchases for the past 15 months

     

    4.     Evidence of a continued life together, and relationships with spouse’s family

    4.1.   Copy of our Japanese family registry filed with the Sapporo, Japan city office, with certified English translation

    We booked separate flights for our trip. My wife's flight was booked through JAL, and was paid for using our accumulated credit card mileage points. We did not have enough points for two round trip tickets, so I booked my flight with a separate, less expensive airline. I also came back to the U.S. one month before my wife since I had to return to work.

     

    4.4.   Hotel itinerary for our stay together in the town of Nikko, outside of Tokyo

    We spent one week in Tokyo, spending several of those days staying with my wife's sister, (name). We then took a trip to Nikki, outside of Tokyo, for two nights before heading to Sapporo. In Sapporo, we stayed with my wife's mother and father, (names). This is the reason for not having included a hotel itinerary for the duration of our stay in Sapporo.

On Oct 21, 2019 I received a RFE stating that " the documentation submitted is insufficient because it is not enough to demonstrate that you and your spouse have remained in a bone fide relationship since your marriage.."     We don't own any property. We don't have phone bills together (I use the company phone). We don't have any memberships anywhere (I'm sure Netflix, hulu, and HBOnow don't count). We don't have any kids. We don't have any loans/debt either jointly or otherwise.

    We've been together for 7+ years, married for 3.5 years. Met in college. My case number is LIN19901727XX

     

    I replied to the RFE in a day with the following:

     

    • Signed letter from the apartment management company stating he has us as residents since Jan 2016 (couple of months before our marriage) to August 2019. We lost our copy of the lease, and apartment management company didn't want to dig through their paper records in their offsite storage location (lazy), but agreed to send a signed letter on company letterhead.
    • Apartment lease acceptance letter, signed by property manager, stating our lease has been signed, accepted, and executed, and what our move in date is for 2016 and 2017. (2 letters; one for 2016, one for 2017 when we renewed our lease)
    • Complete lease from 2018 - 2019.
    • Certificate of Rent Paid received from MN state for 2016, 2017, and 2018. (showing both our names)
    • New lease signed from August 2019 - July 2020.
    • Water/Trash bills in spouse name for 2 years (24 total. Website doesn't have statements older than 2 years)
    • Internet bills in my name (24 total. Website doesn't have statements older than 2 years)
    • Auto Insurance letters from the company going back to 2016.
    • Letter from employer stating we are each other's beneficiary for Life/Disability Insurance and 401K.
    • Letter from life insurance company showing joint coverage and limits.
    • Joint Health Coverage documentation for 2016, 2017, and 2018.
    • Joint eye/dental insurance documentation for 2016, 2017, 2018
    • Joint Tax Returns from IRS website for 2016, 2017, and 2018.
    • We have two cars in my name. They were purchased before our marriage in 2016. I sent copy of title and explained why they aren't jointly owned.
    • Pictures with friends/family/travel for last 3 years. (30 total)
    • Copy of sister-inlaw marriage certificate (I was one of the 2 witnesses).
    • Travel stuff for 2019 (tickets, hotel bills, pictures)
    • Random assortment of medical bills received at our address for the last 2 years (about 12)
    • Letter, signed by both, explaining why we don't have phone bills together, car ownership together, and why we don't share a CC or checking account. It works for our family.
       

    I did not send any affidavit from friends/family. Personally I think they are worth less than the paper they are printed on.

    I am thinking this is plenty of stuff. I honestly don't even know what else I could send. I don't think we even have anything else. Now, for some reason, I am freaking out that they will deny the petition of send me another RFE asking for something we don't have. I hope they accept the reply to RFE and not waste our time scheduling an interview. I got the letter on Oct 21. I sent the evidence back on Oct 23, and it was delivered to USCIS Nebraska on Oct 24 (and signed by L.Miller, the same guys who's name was on the RFE letter).

    • Copy of our Marriage Certificate
    • Copies of our joint tax return for 2017 and 2018
    • Copies of our tax transcripts for 2017 and 2018
    • Copies of our W2's for 2017 and 2018 showing same address
    • Copies of bank statements from our join bank account for the past 24 months
    • Copy of our joint account debit cards
    • Copy of our apartment renters insurance showing joint policy
    • Copy of my spouse's life insurance policy showing my name as the beneficiary
    • Copy of our original apartment rental contract showing joint cohabitation
    • Copy of our renewed apartment rental contract showing joint cohabitation
    • Notarized sworn affidavit letters of support from family and friends
    • Letter from the Building Management Office confirming our tenancy and joint cohabitation
    • Copies of electricity bills for the past 24 months showing joint account

    BELOW IS THE RFE LETTER. They are basically asking for the same things. I don't understand. Compared to other people that I know, who have gotten green cards, I think I have sent more than enough.

    Unfortunately I don't have anything additional from what I sent 10 months ago. We don't have a kid, we don't have a car, we don't have a joint phone bill because his company pays for his bill and we don't have joint health insurance because we've been changing jobs frequently and we couldn't be on the same plan. 

    Do you think if I send the same documents, but with new dates for the past 10 months it will be sufficient??? AWAITING FOR YOUR ADVICE :))

    Good Faith Marriage, insufficient evidence. You provided the following evidence that the marriage as entered in good faith:

    -auto-insurance

    - Bank Statement

    - health insurance

    - letters

    -photographs

    -travel documents

    However, the documentation submitted is insufficient because you submitted limited evidence. Aside from a shared address between you and your spouse displayed on multiple financial documents, you submitted no other evidence of joint occupancy with your spouse at the same residence. Such evidence  might include: mortgage payments, a shared deed to a property, a lease/rental agreement, or property taxes. In its' entirety, the evidence submitted is insufficient to prove joint occupancy with your spouse at the same residence. 

     

    To establish eligibility for removal of conditions of residence, please submit additional evidence to show you and your spouse entered the marriage in good faith and continue to share a life together. The evidence may include the following :

     

    - Children: Copies civilly registered birth certificates, adoption decree, court guardianship records stepchildren, school/medical records listing steparent)

    - Resided together/share responsibility: leases both names, deeds and mortgages in both names show joint ownership, copies of you/spouse driver's license or identity card

    - Combined financial resources/ joint ownership of assets: checking/saving account statements, property/live/health insurance documents, federal/state tax returns (w2), utility bills or loan/credit card account statements.

    - Estate: will, trust, durable power of attorney.

    - Affidavits from third parties who have knowledge of the bona fides of your marital relationship.

     

    Any other relevants documents  not already mentioned. Please do not send copies of documents already submitted. 

     

    So looking at the above of what they want is really a documents showing my name on the property/lease. Little background, my husband has purchased his house before we met. So then we decided to move in together in the same house. But my name is not on the house, we did not think it was necessary since we were planning to move in the future. 

    But my husband is adding me to the property,  would that be sufficient? do you think we should add more evidence? 

     

    we are also expecting  a baby due in May 7 .

Just provide updated form of document which you already provided and write a letter explaining you don’t and kids and loan, it will be enough I guess, you can send the renewed lease if you have one. Does your spouse work ? They basically said he/she doesn’t have responsibility in your communal life. 

    Yes, he does work. LOL .. where does it state that he doesn't contribute? I missed that part.

    Do you think I should send affidavits from other people or have the same 3 people just reconfirm that we are still together? 

    Sometimes I think the more you provide is worse 🤦‍♀️
