    I have the greatest of news for everyone!!!!!!! :dance::dance::dance::dance: BOTH OF OUR PETITIONS WERE APPROVED THIS EVENING!!!!!!!!!!!!!!!!!!!! :dance::dance::dance::dance: Hallelujah, Praise God, finally!!!!!!! I check the website about 4 times a day and I decided to check one more time since in California it was 5 p.m. I saw that the date on both petitions had changed to today's date. First I looked at my I-130, it said APPROVED!!!! Then I said, Please God let this one say the same thing...it also said APPROVED!!!!! Now I am settling in for the wait for the K3 to make it to NVC. So now I can join the rest of this group in the next thread and leave this one, YEA!!!!!!!

    My name is Deb and my husband is from Nigeria. I was reading through your list of people that have already had their interview in Lagos. There is one that you are mistaken about, and that is Kingsley and Tomeca. Tomeca and I are close friends and their interview is scheduled for March 10 which happens to be my husband's and my wedding anniversary, so they have not actually gone through an interview yet. I just found out 1 1/2 hours ago that my husband's and my petitions were approved, both I-130 and K3, so we will be getting interview information shortly as soon as they ship our K3 out of California which I understand can take anywhere from two weeks to a month. I am just happy to be out of USCIS hell hole I don't know what to do, lol! It was a long ride that I thought would never end, lol! Hope you get your approval soon!

  4. Thanks Osakeme for the welcome. I received an RFE on Dec. 12 and sent it back already. They have resumed working our petition as of Jan. 7. I am kind of worried though because the I-130 was touched on Jan. 7 and Jan. 8, but not since then, and they haven't touched my I-129F since the beginning of December. If they have resumed working on our petition (which happens to be way out of their processing times), why did they stop working on it as of yesterday???? I am worried that they have moved on to other people's petitions and decided to push mine to the side for now. I was under the impression that once they receive the RFE that there would be a fairly quick approval after that. Has anyone else had experience with RFEs and if so, how long did it take from the time they said they resumed your case to your approval???

    Most people I know are preparing to go to naija for the holidays and I wish I could quit my job and jump on the next flight home. It is too cold in NY and I need some warmth. :D

    I want to say that I am happy for C and J that they are finally coming to the close of the journey of being apart. Good luck in your interview. I also want to update everyone on our petition. Seems I will be joining this group soon as I received an email this morning from CRIS that they received the evidence they asked for and have resumed working on our petition. Does anyone know approximately how long they usually take before approval? On the email, it states that I should expect a decision to be made in the next 60 days. Do they really take that long or are they giving themselves plenty of leeway???? I am hoping since they only asked for one thing that there will be no more reason for delay on the approval. I am really hoping and praying for a decision by the middle or end of this week. I don't believe that the petition is with the adjudicator yet as only the date for the I-130 changed to today and not the I-129F. When they were actively working on our petition at the beginning of last month, both dates changed every day as they were working. I think the information was only only entered into the computer by the person in the mailroom and maybe by tomorrow, it will physically be in the adjudicator's hand.

    Hopefully I will be back later this week with good news for everyone! I really appreciate everyone who was so helpful to me on this website. It really helped to have a sounding board and someone to go to for information. I would have made so many mistakes had it not been for this website and the other people who were seasoned petitioners. Thank you to everyone for your help!!!!

    I am here to update you on our case. I received email this morning from CRIS that they have resumed working on our petition as of today, so G&A, I may be owing you that latte after all. Since they only asked for one thing and they have it now, there should be no other reason to not approve both petitions. Maybe I will hear of approval by middle or end of this week. I think I need to throw a party if this happens, lol. Everyone is invited. :)

    Something is telling me that you will be approved by the end of next week...if this is the case...you owe me a latte

    LOL, I would like to feel a lot less special...I just don't feel we're compatible anymore, lol :lol: I feel a divorce coming on :lol::lol:

    If whomever or whatever is telling you that I will be approved by the end of next week is true, I would make a pot of latte for you and hand you the pot with a straw if that were to happen, LOL!!! I do hope they make it snappy and get this over with.

  8. Yay Deb sounds like you're really on your way now!!

    For all of you who are sad about your petitions being stapled together.. count your blessings.. they approved my I130 eons ago and threw out my I129F because there was no longer a pending I130. I'm being forced into taking a CR1 although the USCIS website shows my I129F as "pending" hahahaha.

    Things with the NVC are going slow. My hubby sent his info to me 3 weeks ago and I still didn't get it and it's all original documents (the NVC requires that for appointment posts on a CR1). From what I can tell with researching in VJ CR1's thru lagos never get approved the first time. All but one so far has gone into AP for at least 6 months. I'm hoping to have the case finalized at the NVC around March... Maybe an interview by Dec or Jan 2009.... AP till June 2009 and hopefully he'll be here by the end of June 2009. How's that for slow?

    Someone from Ghana was denied a CR1 pending a DNA test on their american born child (husband is Ghanian, wife is US born Citizen.. child belongs to them both). Even though it is a spousal visa and the child is already american with a birth certificate to prove it, they have to provide both mother and father's dna proof that they are BOTH the true parents. My husband and I are planning on going ahead and getting the DNA test before hand so they cant put us into AP just for that.

    Good luck to you all. I'm sure the majority of you all will have your spouses home in your arms by the end of the summer. I hope to be able to say the same thing this time next year about myself.

    LOL, Kathryn, slowly but surely I suppose. Still stuck in the oblivion we all know as USCIS hell. I wish they would get it together and get my information into the computer and give the darn RFE to the adjudicator so I can leave the "dark hole", lol. Yes, I know...patience, Deb, patience, lol. That is one virtue I am beginning to dislike at this point :wacko:

    I am so sorry that you have had to put your married life on hold yet another year for stupidity. Seems to me that was USCIS's mistake and not yours and why are they making you pay for their mistake? For that reason, I think they should refund the money you spent on the I-129. Hahahaha...like that will ever happen, lol. Just a thought...

    I am still waiting on them to resume my case after RFE. I called yesterday and I was told that my RFE had not been entered into the system yet and to call back next week if I don't receive an email first about them resuming our case. I informed her that I received the RFE in the mail on Dec. 26 and sent what they wanted back on Dec. 26. My RFE was delivered to their RFE mailroom Dec. 27 and gave her the name of the person who received it. She said they probably got a lot of RFE's in the mail during that period and because of the holiday's everything is a bit slower, but should pick up now. So if I nothing from them by next Thursday, I will call again. Just wanted to update everyone.

  10. Hello Everyone,

    I called this afternoon to check on both I-130 and I-129F. My I-129F was filed in August and the lady told me they are now working on July I-129F's. My I-130 received an RFE on Dec. 12. I received it in the mail on Dec. 26 and sent it back to them on Dec. 26. They received it in their mailroom on Dec. 27. She told me that they had not entered the received RFE into the system as of yet, but to check back in a week, and it should be in there by then. She told me that once they have entered the received RFE into their system, then it is sent back to the adjudicator right away and they will resume work on the petition right away, so I will check back in one week unless I get an email from CRIS stating that they have resumed the case before then.

    Just thought the piece of information I received from the lady concerning the I-129F would be of interest on this thread since that is what you are interested in. I was also told that they are now approving both I-130 and I-129F at the same time, so I will let you know as soon as I know what they do with mine.

  11. No, the postal system is not that slow in the US. USPS is actually very good. There is a little slowness between Dec. 16 and December 27 or so because of the Christmas cards and packages that get mailed. But don't expect the RFE in the mail for a week or two. It takes a while for the USCIS to actually mail it out after the generate it (generation also generates the email). USCIS is sloooooowww. Once USPS has it, you'll have it an a few days depending on where the USC lives.

    I got an email from USCIS on Dec 26. They said they mailed a notice requesting additional evidence, but until now, we haven't gotten anything from them.

    Is it normal because of Christmas und New Year Holidays? Will it take a normal post in the US 5 or 6 days?

    Apparently, all of the US-Systems work very slow

    Urge is correct. Email told me they sent out an RFE for me on Dec. 12. I got it Dec. 27 in the mail. The postmark on the envelope said Dec. 20 so it took 7 seven days which is 2 days longer than it took for the other two NOA-1's, probably because one of those days was Christmas, so wait just a bit longer before you call them.

    I'm a bit sad, I still am waiting for an approval to move on and I feel heartbroken.

    Why does it take so long I can't understand it. Our lawyer sent a registered mail to USCIS asking about the delays. But I really feel down.

    Any of you are still waiting for a NOA2 in the May/June/July filers?

    Yes, I filed May 18, 2007, and am still waiting for an approval. I had to call them because I was beyond their processing times and they started working on mine at the beginning of December. I got sent an RFE on Dec. 20. I got it yesterday and sent them what they wanted the same day. They now have what they asked for, so I am looking for my approval very soon now. Give them a call using the "RFE trick" and find out the status of your petitions. If they see that they are out of processing times, your petition will be placed on an adjudicator's desk to be reviewed. That is what I did and I am almost there now.

    You won't know what evidence they are wanting until you receive the RFE in the mail. When you get it, it will tell you what they need. Just follow the directions and mail them back what they are requesting. I got my RFE in the mail yesterday and sent the evidence they wanted as well yesterday by express mail. Don't worry too much about it. I pray once you give them what they want, they will resume working on your case quickly and your approval will be coming soon.

    You are welcome Amoro. I had noticed last month when I was checking what I had sent in for my I-130 and found that I only sent the first page of my divorce decree (Deb kicks own butt). They wanted a copy of the entire decree, especially the page with the judge's signature and my ex's and my signature showing that it had been finalized. By only sending them the first page, it showed it had been filed, but not finalized. I made copies of every page and had sent them that last month, but since they had not requested it yet, they evidently did nothing with it except throw it away. They have it now, so hopefully my case will resume quickly and we will see our approval. I hope and pray you get a quick approval after you send them what they want also.

    On December 26, 2007, we mailed a notice requesting additional evidence or information in this case I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please follow the instructions on the notice to submit the requested information. This case will be in suspense until we receive the evidence or the opportunity to submit it expires. Once we receive the requested evidence or information and make a decision on the case, you will be notified by mail. If you move while this case is pending, call 1-800-375-5283 to update your address."

    What should I send them as Evidence? I hope I will get our approval mail soon.

    Please pray over our case and give us your recommendation about our Evidence!

Even though the website said they mailed the notice on Dec. 12, the letter was postmarked Dec. 20 and I got it today which is the same amount of time it took the other two notices they sent at the beginning. Anyway, they wanted exactly what I thought they wanted...the exact thing I caught myself at the middle of November and made copies and express mailed them what I found was missing at the end of last month. Let that be a lesson for those just starting their journey. Even if you catch a mistake after you have already sent in your petition, don't send them unsolicited evidence until they send you the RFE because I can see that they just throw it in the trash and never put it in your folder, even if you put your case # on a cover letter and highlight it in yellow with both petitioner and beneficiary's names. I expressed mailed everything they wanted this afternoon and they will have it tomorrow morning, so I am relieved and happy now :) So finally, I hope, we are on our way to our approval. I hope by this time, they guys that were in my group have all now made it to their separate embassies and have their interview dates in hand. Good luck everyone! Will give another update when the resume our case and also when we receive our approval.

    I'm so glad it was what you thought and not a complete surprise. Now that you have sent the requested information, I pray they approve your petitions soon. We still don't have an interview date. Our petition was sent to the embassy from NVC on Dec 12th. My husband will go to the embassy tomorrow to pick up his packets and hopefully the interview date. He was sent home last Friday, as were all the others who showed up, because they were told they did not come on time. He was there at 6:30 a.m. They told him to be there tomorrow at 7:00 a.m. and he told them he will be there at 6:30 a.m. like he was on Friday. I pray that things go better and he gets what he went for. Hang in there, Deb. It's all going to work out!

    Hope you had a merry christmas. Everything is good here. I called he embassy on Dec. 20 to inquire about the RFE now that I think about it. I looked at the case status online and our case was touched on Dec. 20 and 21. I think they went ahead at that point and resent the RFE because it was postmarked Dec. 20, the very day I called. In any case, I am glad I got it, it is sent in, and now the wait begins again, but hopefully for not too much longer. Since that is all they asked for, there couldn't be anything else to hold up the approval. The guy said over the phone that once they get what they asked for, they will approve both petitions together. I pray that tomorrow Kingsley will call you with good news of the date of his interview. I am so happy for you two. You are such a cute couple! I wish all the luck in the world.

    Unfortunately, we are still waiting for our interview date. We have to wait for them to get back to full staff levels, which won't be until the week of Jan. 6th from the holiday slow down that started on December 20. Some from our group have got their visas, plenty are at the embassy stage waiting like me, some are still struggling to get to/through NVC tho.

  18. Newlyweds who have never even lived in the same country yet, won't be able to provide anything but affidavits.

    Not necessarily true.

    I did have life insurance, trust, will and joint bank account for my wife.

    Wasn't for the I-130 [K3/K4] but for the embassy interview and later when doing the AOS.

    Thank you. The thread is about filing the petition. Unfortunately, by the time there's a visa interview, most aren't really newlyweds anymore. By the time of AOS, they've lived together in the same country.

    We sent just marriege certificate, we did not have all those things by that time yet, we were just starting our life together in my country.

    But now after almost an year living together we have thousands of pics, travel tickets, hotels reservation, car loan we got together, bank account, credits cards, insurance etc etc.

    I have a box full of papers ready to take with me.

    We got a RFE for 130 but it was about wrong size pics and my husband previous marriege divorce papers.

    I got an RFE that they emailed me and said they sent on Dec. 12 and here it is Dec. 20 and I have not received it yet. Did you call a week or two after you received the email, and if so, did they tell you to wait 30 days? I called today about mine and he told me to wait until after Christmas and if it still has not arrived, to call back and they would resend it. Thanks for your time.

We have a huge snow storm headed our way. It is supposed to start sometime after midnight and snow until Sunday morning. Maybe 6+ inches. Doubt I will see anything from USCIS until next week.

    I must admit, they have me scratching my head. I didn't think they would approve the I129F after so long. I fully expected to have them give me the same story they gave kathryn (divinemercy) :( *that still really really sux kathryn* Now I wonder which will get to USEM first, my original K3 petition or my newly submitted CR1 :D

    That is really weird that they would choose to do that to Kathryn. Hers was approved in July. Yours was approved in August and they approved yours????? I am joining you with the scratching of the head. It does really suck that they did Kathryn like that. I am surprised they are letting you go ahead with the K-3. So which one are you actually going with cuz I notice that you have already paid your I-864. Can you still go with K-3 even though you have gotten this far with the I-130? I guess u can. Whichever makes it to the embassy first...

    You sent stuff three weeks ago without being asked for it? Well, if it was something required that you forgot initially, definitely have copy of that ready for when you get the snail mail. They almost never add things to a file that you send in unsolicited. It would be too hard from them to track (even more now with the huge pile of petitions they have to wade through). They would even have trouble getting your response to the RFE in there without the original barcoded RFE letter serving as cover for your RFE respone.

    I am writing with an update on our petition. I looked on the USCIS website tonight and found that they sent an RFE for our case. I can't imagine for what because I checked and double checked everything before I sent it, but once I receive it in the mail, I will let you all know what it was for. Just another delay on being with my husband. :crying::crying:

    Thanks Tomeca! I am hanging in there the best that I can. It was probably the stuff that we discussed earlier didn't make it into my file even though I sent it last month and they had 3 weeks to put it in there. I think I wasted my time and money doing that, but oh well. We are all at their mercy. We have to do what they ask in order to be with our husbands, so I have to suck it up and keep going.     Hi Urge,

    Yes, I happened to go through what I sent last month to make absolutely sure that I sent everything that I should and I found that I had not copied and sent every page of my divorce decree, especially the page with the judge's signature. (Deb now kicks own behind!!!) I sent it express mail with a cover letter with my WAC number in the subject line and both our names in yellow highlighter so it couldn't be missed. I would think that they would have some semblance of sense to see yellow highlighter on a cover letter highlighting the WAC number. Can they not enter the WAC number and names into the computer and find out where the petition is and include it??? I wouldn't think it was that hard, but maybe for them it is. Anyway, they mailed out the RFE yesterday and surprisingly, our case was touched again today for some reason...who knows? I will still keep everyone updated on what the RFE was. I have a copy of everything sent, so no problem. I am ready.
