    I am finally here to let you know that my K3 petition was received at NVC today, 3/12/08, and will soon be on its way to Lagos. Will let everyone know when the interview date is when I find out.

    If you want a K3 visa, that's the wording you're looking for but it is not the only possibility. It will be good to hear from the OP as to the wording of their NOA2 for I-130. If it says the same, that's good news for those who really want a K3 visa. Let's wait and see in a few days when it comes.

    As I have posted many times, my K3 petition did not make it to the NVC after an approval on both I-130 and K3 on the same day, Jan. 9, so called USCIS. They ordered my file back from NRC and found that it was still in that file. Adjudicator for some reason approved the I-130 for a second time and when I received that second approval notice in the mail, it contained the wording, "The above petition has been approved. The petition indicates the person for whom you are petitioning is in the United States and will apply for Adjustment of Status." The first approval notice for I-130 I received did not have this wording. The adjudicator said that my K3 petition was in the bin waiting to be forwarded to the NVC and should be there by the end of March, so after seeing what you said, Pushbrk, I feel more confident that my K3 will end up at NVC. I will keep everyone informed what I find out.

    All signs point to your K3 getting to NVC but all we really know is that your I-130 NOA2 has the appropriate wording for a K3 case.

    Exactly, and I will inform you when and if my K3 makes it to NVC, so maybe that will end some of the questions.

    I'm afraid it will take more than one answer to clear up much. Your case is on the cusp, in that your I-130 was filed well before the fee increase. I'm getting the feeling though that USCIS has seen the error of their ways and are now going forward with K3 cases as the petitioners intended. Their little hiatus was quite the travesty. Let's hope for the best and be prepared for less.

    Yes, I-130 was filed well before the fee increase, but my I-129 was filed after the fee increase, so therefore, it was free. Correct me if I'm wrong, but isn't that the whole question...whether or not they are allowing K3 to be forwarded to NVC if the K3 was filed after the fee increase? Of course, the answer is up in the air until I find out for sure that my K3 actually makes it to NVC. Please, if I am wrong in my thinking, feel free to correct me. I am hoping as you say.

  5. I'd just like to point out to all of you that we have word an authentic august K3 approval

    She said both I-130 and I-129F were approved. and her I-130 was sent on august 13 if i remember correctly.

    If that is all true, K3 is alive

    Here is another one. I filed my I-129 and it was received at USCIS on Aug. 20. Both I-130 and I-129 were approved at the same time on Jan. 9. It is now March and neither one of my petitions have made it to NVC. I called USCIS to find out what was going on at the beginning of Feb. They ordered my file back from National Records Center and found that my K-3 had never been separated from the folder and forwarded to NVC. They said they would be forwarding to NVC as of the last of Feb. In the mean time, the original adjudicator for my petition decided she would approve my I-130 for a second time so I called again to find out what was going on. She stated she made an error and did not realize it until it was already done. I told her I was not as concerned about the 2nd approval for I-130 as I was in where is my K3 and has it been forwarded to the NVC. She checked for me herself and said that the K3 was in the bin waiting to be mailed to the NVC, and that it would probably be the end of March before it arrives there. I will be checking both petitions to see which one makes it there or if both do and keep everyone posted. At the moment, the only touches my K3 received while it was back at USCIS was twice at the end of February. My I-130 was touched and approved again on FEb. 26 and then there was another touch on March 2, a Sunday. There is a possibility with all the touching going on with the I-130, that this is the petition that they are forwarding and I really hope that isn't the case because of the history Nigeria has in the way they deal with CR1 interviews and visas. I have seen only one VJr make it through one interview and be approved for a CR1.

    Kathryn: Just like edp333 mentioned, its my understanding too that the temprorary EAD thru JFK is only for K1 visa applicants. Kath, on the other note, I just read about your updated progress too (in your sig) as in getting the interview date and all... I m so happy for you guys. I really am. Wish you all best and hope things work out for you real soon. Please keep on praying for us too guys :-)

    Somehow I just knew you guys were having the best time, lol! It is great to hear that! Yea, we will have a great time too once USCIS takes their claws off our K3 petition and actually forwards it to the NVC. I can't believe they approved the I-130 for a second time, lol! As long as by the end of this month, my K3 is there, they can approve my I-130 50 more times if they want, lol! I will be glad when I can come to this thread and say I finally have an interview date.

    Oh well, until then toodles, and continue to have a blast!

    Here is another update. I received a second NOA-2 on the I-130 this morning in the mail so I promptly got on the phone with CSC to see what was going on. To make a long story short, I got to speak with the adjudicator who stated she made a "boo-boo" and did not realize it until after she did it. I told her I was not as concerned about her "boo-boo" on re-approving the I-130 as I was about where my K3 petition is and has it been forwarded to the NVC? She said, in fact, that it is in the bin to be forwarded to the NVC and to check with the NVC in 30 days. She said I should be looking at the end of March before it actually reaches the NVC. So again, we shall see.

    Hey it's not lost! That's something right?

    stupid question just for clarification... If our spouses enter the US thru JFK can they get the EAD stamp or is that only good for K1 visas? Anyone know?

    Only a small something. Becky was supposed to have personally sent my K3 to NVC last week. She lied and did not. It is, in fact, sitting in a bin waiting to be mailed to the NVC, so it is delayed yet 2-3 more weeks. Note, that it has been approved since Jan. 9. It should have been through NVC and have an interview date right now and I am STILL not at the NVC. It is starting to make me angry :angry:

    Good evening everyone,

    First of all, I want to extend a big congratulations to Gogo for his recent approval. It is about time guy!

    Secondly, I would like to update everyone on our case. I called USCIS as it has been two weeks since they said they had ordered my file back from NRC. According to the lady that answered, my file arrived yesterday and was now on "Becky's" desk. The lady said that Becky said she will personally be mailing our K3 petition to the NVC, so check with NVC in about 2-3 weeks. It should get there this time. So I plan to start calling on March 7. I estimate my husband will get a May interview date as the latest I have seen scheduled for Lagos on here is April 22. So I will update everyone once I find out our petition is finally at NVC.

  11. I had both I-130 and I-129F approved at the same time on Jan. 9. My K3 is being forwarded to the NVC now as they failed to separate the K3 from the I-130 folder before sending the folder to the National Records Center. It has now been retrieved and is being forwarded to NVC. So the cancellation seems to be only happening to some and not to others. I am thankful that they did not do that to me, as an interview for CR1 for Nigeria takes forever and when you do get one, most usually always go into 6-12 months of AP, so I thank God every day that my K3 was allowed to go through.
