  1. Hello everybody.. 

     

    my interview is coming up and i only got an email telling me to schedule the appointment, once i did i got the confirmation for it.

     

    now, since i didn‘t get a letter whatsoever that states what i have to bring (it only says to bring my passport)  i am taking the following documents just in case.

     

    • 2 passport pictures

    • Passport

    • The joint sponsors paperwork I-864 +

    I-864a

    • Their last 3 years tax return + the W2

    • A few bills and copies of their driving license 

    • On top of that i‘m going to bring the bill of sale from our business

     

    So the consulate did not ask me for any of these papers.. i just wanna be prepared for everything they might want.

     

    Any suggestions on what else i should take?

     

  2. Hey, i hope someone an help me with something. My joint sponsor has problems filling out the 864 form.

     

    so he has a wife and claims his brother in law on his tax return. That makes a household of 3

     

    he is going to sponsor me as well as my child. But my child and i have seperate petitions. Which means he has to do two seperate 864 forms.

     

    but since only one of us is listed on each 864 form it makes a householdsize of 4 on esch form even tho its actually 5 ( him, his wife, brother in law, me and my child) the instructions arent very helpfull 🙈

     

    it says don not list more than one on each form...

    All cases go through some form of administrative processing after the interview. Additional paperwork review would probably mean a little longer processing period.  Sometimes officers tell the applicant they are approved....sometimes, they don't.......Regardless, approval is not official until the status changes to "issued"......

    so, my interview is coming up. In a different post i already explained that we have submitted everything the consulate asked for. Now since i believe i need a joint sponsor ( i‘ll have the paperwork with me in case they ask for it) will they review that while i‘m there?

    I‘ve been told it‘s better to just take it instead of sending it in if they ask for it (they didn‘t, yet) 

     

    so my question is, will they tell me on te interview date if i get the visa (cr1) or does it take longer to review the joint sponsors paperwork even when i hand it over?

    Your revised plan to be prepared with them AT the interview is much better, IMO.

    I said i have a joint sponsor if needed. But they were only going to send me the stuff if i get asked for it. Since nobody asked for it, there was no need for the joint sponsor to send paperwork to me. But they are gonna do it anyway now.

    The documents are all there ! Nothing else was requested !!!! Why do you not understand that i am assuming i need it but i dont know it for sure

    Like the other poster said, it's up to the CO to decide. It can be shorter or longer but in general it is a year. You wouldn't know until they tell you how long. 

    Well i just talked to my aunt.. her and my „uncle“ went through the exact same.. it was done within 5 days.. i am using the same consulate they did..

    Why should it take soooooo much longer?

    i haven‘t done anything wrong? 

    It‘s not that they requested something that i won‘t have with me! I am just assuming!

    Imagine i‘m older not using a computer, not reading all of this?! I did everything correctly so far! I can technically not know if or what else they might want!

    Thankfully DCF even with this delay will still be much quicker than Consular processing !! 

    Exactly.. they have worked hard for everything they have now. The joint sponsor is my husbands sister i know her but still. They are willing to do it but only if this is the only way we get the visa. I am thankful that she‘s going to do it and i won‘t put any pressure on her.Everybody seems to think it is easy to find a joint sponsor but this could become a huge burden for that person willing to joint sponsor.  If i get the paperwork after the interview, than this is how it is...

There is not likely to be another interview or personal attendance required if they are just waiting for a joint sponsor AOS.  The delay will be dictated by how long it takes for the joint sponsor to get you their paperwork. 

    And honestly , if the joint sponsor can fill the form out correctly, there is no reason why you even need to look at the documentation. No e reading through the tax returns .. just pass it all to the Consulate. Preserve the privacy of the joint sponsor .. maybe tell the m that you won’t be looking at the information yourself , just passing it to the officer.

    I answered your question, 1 year. At the visa interview, there are only 2 outcomes: approved, or denied. If they cannot approve your case, they will issue a 221g, which is a denial. You will have one year to submit the additional evidence for them before the case is returned to the US. After you submit, there is no time frame for them to get back to you, could be 1 week, could be 8 months.

    Then you need to get that affidavit and bring it.  You WILL need it.

    How many times do i have to repeat that my question is how much time is given to turn in the joint sponsors I-864? That is all i want to know.. if someone knows it, fine! If not please stop telling me to find a different joint sponsor. I will get the paperwork AFTER THE INTERVIEW IF THEY SAY I NEED IT! No problem with that

    Because that determination is made at the interview. If you have no US income, you will need a lot of liquid assets. Remember assets only counts in the ratio of 1:3 when converting to income. 

    I know.. that‘s why we have a joint sponsor if needed. I just wanted to know if there is a time frame, like if they will say :“ come back in oneweek with the documents“ or something like that

    You won’t be approved on the basis of a business you are “about to sell”.  Approval absent income requires highly liquid assets that are in the US.

    I know this. We will have the money from selling the business as assets. But here where we live.. not in the US. And we are a family of 3 and we don‘t have 80.000$ in assets.. that‘s why we have a joint sponsor.

    Option 2 is not an option..there is absolutely no need to live separate since we have a joint sponsor if we need one.

    Because he has no US income. We own a business outside the US that we are about to sell. We did of course send the last 3 tax returns and everything that was requested. But the income won‘t continue. That‘s why i assume we need a joint sponsor.

    i don‘t know why the consulate didn‘t tell me yet.. i am pretty sure they will at the interview.

    Oh my god.. this forum is really frustrating.. we have submitted the I-864 already.. and they did not say i need a joint sponsor! I am assuming!!!! If i had quite some money, i wouldn‘t want my family to know either! Some people just are like that and i don‘t blame them!!! They are willing to joint sponsor if REALLY NEEDED!!

    If you got asked for one then it's up to you how fast you can provide them with one and how fast you can forward your required papers back to them. Which most likely will put you in Administrative processing. 

    AGAIN... I CAN NOT FIND A DIFFERENT JOINT SPONSOR I DO NOT KNOW ANYONE ELSE IN THE US! I HAVE A JOINT SPONSOR! BUT AS LONG AS IT IS NOT REQUESTED THEY DONT WANT TO SHOW ME THEIR FINANCES! And i understand this!

    Lol.. it is not easy to find someone that is financially responsible for another human being.. i would never do that for anyone. 

     

    As i said it is not requested yet and i do understand that the joint sponsor doesn‘t want me to see their whole financial situation. 

     

    If it is really needed they will tho.

     

    but that was not my question. My question was how much time is given to turn in the paperwork. Please only answer the question if you know it. I don‘t need to find another joint sponsor.

  19. Hello everyone...

     

    i have a question AGAIN.. so, my interview appt i coming up and i was wondering, since the consulate didn‘t request a joint sponsor yet (which i‘m pretty sure we need) how much time do we have to get the joint sponsor‘s paperwork after the interview? Like do we have to go there again with the paperwork? Or do they keep my passport and we mail it to them and then they decide? 

     

    Might be a dumb question but i‘m nosey...

     

    and yes i could take the joint sponsor stuff with me right away but the joint sponsor want to wait and see if it‘s really needed first.. i can‘t do anything about that 🤷🏼‍♀️

    Yes you need joint sponsor. 

    You need 864 from him for each of you as each petition needs it’s own  864 .. each petition is separate. 

    For each 864 the household will be joint sponsor + spouse+ brother in law (only if he is claimed as a tax dependent by joint sponsor ) + one immigrant only. 

    You don’t add two immigrants to the one 864 when they are on seperate  petitions as yours are ... 

    so his household size will be either 2+1. or 3+1....  

    Your husband will also need to complete an 864 for each petitioner even though he won’t meet the income level  

    My husband already did the I-864 We own a business and turned in the last 3 tax returns so there was no problem. But the business is outside the us and will be sold end of august since we are panning on leaving. The consulate should know that we won‘t have and income after that. That‘s why i was wondering when they request a joint sponsor.

     

    my husband said that his brother is not qualified to be on the joint sponsors tax return. So it will be 2+1 ( we had seperate petitions my son and i)

    Does your joint sponsor claim his brother in-law as a dependent on his tax returns ? 

    Is the brother in laws income being included in the household income to meet the financial level , or does the joint sponsor meet the level on his own ? 

    Have your documemts been qualified at the NVC without a request for a joint sponsor ? If yes , then they have been accepted as us and a joint sponsor is not needed at this time 

    It is a IR1 and IR2

    we do DCF

    the brother in law does not work. 

    I don‘t know if he claims him on the tax return.

     

    the joint sponsor makes way more than 37000$ so that won‘t be a problem. I just have to tell him how to fill out the papers...

     

    well.. my husband is my sponsor and he has no job right now in the us.. i really expect them to ask me for a joint sponsor at the interview. 

     

    So far, they didn‘t request a joint sponsor

    I 864 Part 3 Item 29 would be 2 (you and your child), so that number would go on Part 5 Item 1, he puts 1 for Part 5 Item 2 for himself,  then his wife goes in Part 5, Item 3, and the brother-in-law would go on line 5, so total household size should be 5 in my opinion.

    Okay that means he has to have the income for a household size of 5 (30,200$)in the list? Even tho his wife works and he doesn‘t really sponsor her?
