    You may use Form I-864EZ if ALL the following conditions apply:

    1. You are the person who filed or is filing Form I-130, Petition for Alien Relative, for a relative being sponsored; AND
    2. The relative you are sponsoring is the only person listed on Form I-130; AND
    3. The income you are using to qualify is based entirely on your salary or pension and is shown on one or more Internal Revenue Service (IRS) Form W-2s provided by your employers or former employers.

     

    If you meet ALL of the above 3 criteria, you can use EZ, if not, than you use the standard form.

    In aggregate means in total. The answer to this question is yes.  He has been illegally present in the USA for more than 1 year.

    IM PRETTY MUCH DONE WITH THE DS260, I JUST HAVE A FEW QUESTIONS INREGARDS TO SOME QUESTIONS AND I WANT RO MAKE SURE I ANSWERED THEM CORRECTLY BEFORE SUBMITTING.

     

    A LITTLE BIT ABOUT MY HUSBAND, HES BEEN HERE SINCE AGE 4, 29 NOW. NEVER LEFT THE COUNTRY, DID NOT ENTER WITH A VISA SO HES HERE ILLEGALLY. ONLY ARREST WAS AT AGE 18. NO VISAS PRIOR. WE DO HAVE OUR i601 APROOVED

     

    THEIRS 4 QUESTIONS...

     

    1. HAVE YOU EVER BEEN UNLAWFULLY PRESENT IN THE US FOR MORE THAN ONE YEAR OR MORE THAN ONE YEAR IN THE AGGREGATE AT ANY TIME DURING THE LAST 10 YRS? I ANSWERED NO (I HONESTLY DONT UNDERSTAND THE QUESTION, I EVEN GOOGLED "AGGREGATE" LOL)

     

    2.CAN YOU SPEAK/READ LANGUAGE OTHER THAN YOUR NATIVE LANGUAGE? ANSWERED YES (ENGLISH)

     

    3.HAVE YOU EVER BEEN UNLAWFULLY PRESENT, OVERSTAYED THE AMOUNT OF TIME GRANTED BY AN IMMIGRATION OFFICIAL OR OTHERWISE VIOLATED THE TERMS OF A US VISA? I ANSWERED YES (SINCE HES BEEN HERE SINCE AGE 4 (UNLAWFULLY PRESENT) EVEN THOUGH THE OTHER PART HAS TO DO WITH A VISA)

     

    4. HAVE YOU EVER BEEN UNLAWFULLY PRESENT IN THE US FOR MORE THAN 180 DAYS(BUT NO MORE THAN ONE YEAR) AND HAVE VOLUNTARILY DEPARTED THE US WITHIN THE LAST THREE YEARS? ANSWERED NO (HES NEVER LEFT) BUT ALTHOUGH HE IS UNLAWFULY PRESENT, 

     

    5.HAVE YOU EVER BEEN ARRESTED OR CONVICTED FOR ANY OFFENSE OR CRIME EVEN THOUGH SUBJECT OF A PARDON, AMNESTY, OR OTHER SIMILAR ACTION? ANSWERED YES (SINCE HE DID GET ARRESTED AT AGE 18, WE WILL BE SUBMITING COPIES OF HIS CASE BEING DISMISSED)

     

    ANYWAY, ITS LONG BUT I TRULY THANK YOU FROM THE BOTTOM OF MY HEART, THIS IS VERY CONFUSING AND DONT WANT TO MESS UP, PLEASE HELP. WOULD LIKE TO SUBMIT ASAP.

    yes waiver is aprooved. 

    I log into the CEAC account and I see the Affidavit of support there, so im guessing that's where ill fill it out??

    Im pretty much done with his DS260 but have a few questions before submitting... ill start a new question.

  7. So i am confused, while working on my husbands DS260 their is a question on the previous travel information part:

    "have you ever been in the US'?

    I answered yes because he lives here since age 4 and never left the country, did i answer it correctly? I said hes been here 25 years.

    I have not finished the whole application quite yet, if i answered it incorrectly then i can go back and change it.

    This was over 10* years ago and his Case has been dismissed. That’s what we sent in with the i601a and it got approved thank God.

     How do i get the email address? Ive searched the website and find nothing. Ive tried NVC inquiry but somehow his birthday isnt accurate... 

    i called them last week to give me an invoice id in order to even begin his DS260 online cause lawyer never mentioned it. Weve wasted years with her, we started in 2015 and barely got our waiver aprooved. Which were happy about but i do feel confident to do the rest on our own. Attorney doesnt get things done quickly. I feel dumb weve waited this long. Happy i found this website.
