Write to the USCIS address on I-130 receipt. The letter should note the case number and purpose of the letter. Include a copy of the receipt and birth certificate.
Unsolicited evidence is always allowed
and I can just submit it online?

Failure to take this shot at a wide open net baffles me.
I was thinking the same thing I just wasn't sure if it was too late to submit now...

I don't see a need to add the birth certificate now. The baby will be counted in the household size on the affidavit of support, and you can take the Birth Certificate and CRBA to the interview. Can also be uploaded as a Civil Document at NVC stage.
Wouldn’t it be evidence of a bona fide marriage?

Yes
Limit RFE response to what was requested in RFE.
Is the baby a U.S. citizen?
Yes he is a US citizen but I do not know how to add a document onto our i130 ... or if we are even allowed to...? Can he show them the baby's birth certificate at the interview?
-
I was wondering if I should submit our new baby's birth certificate even if I already submitted the I-130 a year ago? I also got a RFE because I didn't submit the I-130a, can I just submit the birth certificate along with that? Will adding the birth certificate(after having already submitting the I-130 over a year ago) delay the overall process?

You're welcome! I honestly don't feel that you *need one but again I felt it couldn't hurt to include one so that's what I did. (It also just shows appreciation for their extra efforts, etc.)

"Dear USCIS officer,
Please find the enclosed revised and corrected I-130A form, completed in full.
I sincerely thank you for your time and for allowing me to fix my previous errors. If any additional information is needed on my part, please do not hesitate to reach out and ask.
Thank you again, XXX"
And I included my reference number, etc. There's plenty of available examples if you search online.
Hope this helps! 🙂
Would you say it has to be mailed or is it okay to scan and submit online? I see my online account is prompting me to upload the evidence - this is so scary because it says I only get 1 chance!😭😭😭😭

Hello there. Sorry for the late reply! YES -- everything went PERFECT with the RFE I-130A (re)submission. We were approved eight days after receiving! I was in genuine shock and elation. I ended up submitting a very short cover letter JIC and just rewrote everything by hand. For the USCIS provided cover letter I did also end up checking off "other" and just writing 'I-130A'. Again, don't know if this was absolutely necessary but I figured definitely better be safe than sorry.
Hope this helps! Good luck to you and your submission!
Great thank you! Do I need a cover letter? What did yours say?

I had similar issue… Resolved by me downloading and completing the latest I-130a, with no signature as I’m overseas, and my USC husband printing and mailing it back with the RFE letter.
Thank you so much

Can anyone please answer my second question re: the cover form I need to supply with I-130a redo? And is OK if I resubmit a typed out and signed copy of the I-130a form or should I rewrite by hand so it matches my original paperwork? Thanks in advance.
Have you gotten this figured out? Asking because I have the same issue and need to make sure I submit it right this time 😰🤞

Agree with @MrHanky the fact is you don't have to print it and sign it which is what most people will think they will have to do and worry that they didn't.
That's what will be most helpful to people.
The FACT is you can't submitted without the digital "signature" so why would people be worried that they didn't sign it? Because they think they need to physically sign it.
U must print it and physically sign it this information is incorrect. I just received a notice asking for a handwritten signature for the form

Correct you don't need to sign it, it's just a digital signature, which you already did when you submitted it.
A few things are confusing and totally understand why you got nervous, the instructions are for both paper and online but there are some differences when you do it online.
They need to do a better job with messaging in the online process.
But rest assured, you couldn't have submitted it without completing that part.
The only thing you would have to print out and put an actual signature on, is if the Beneficiary had a preparer or translator on the I-130A.
It's not 100% necessary to fill out those sections though.
Not true I submitted mine online and I got a notice saying I didn’t sign mine… don’t know how that’s possible since I would’ve had to signed when I submitted online …?😭

unforunately USCIS also uses the I 130 form when a person is here in the US (as in a K1 visa) and they are doing AOS to get their green card
so, the forms indicate the things like signed lease, joint accounts and all that to show the K1 fiancee is now married to USC and they have started to set up a home
but for a nonresident alien spouse most do not (and would not be expected to have ) those joint accounts and /or assets
Ahhhh that makes more sense now

He uses the card often
He also just deposited $14k in my bank account will that help or hinder us? @Mike E since that’s funny to you I’m not sure why… we actually do combine our money even living so far apart. This is a very real 8 year relationship so I’m not sure why that would be surprising that we have the same credit card account and he gives me money

My husband just had his interview today and passed it. The whole process took less than a year. Heaven bestowed upon us the greatest lawyer imaginable. And he got our I-130 approved with minimum evidence. We sent a few pictures, our marriage license, boarding passes/passport stamps, and then the basic biographic info. I also wrote a letter explaining our relationship history, as well as some of the evidence we submitted. This process isn’t as dramatic as some people like to make it seem. There’s A LOT of hope. Don’t despair…just submit the best evidence you have of time spent together. Best of luck to you.
CONGRATULATIONS THATS AMAZING 🤩!!!! IM SO HAPPY FOR YOU GUYS! I can’t wait to be able to post the same thing!🎉💗✈️🥳🤩

Pictures are fine, but they usually do not confirm duration of visits. It sounds like you have spent more time together in person than most going through that consulate.
Passport stamps from your trips together, and from your 2 month stay in Morocco are good evidence.
I don't know if @Jeanne Adil has seen this thread, but she always mentions the importance of the male Moroccan's mother's approval. Sounds like you have spent lots of time with family there.
Oh his mother and I are very close. I often hung out with her when he and I needed time apart. We have pictures together. She’s the sweetest thing. I text her but only with gifs and pictures because we don’t share a common language. She also cannot write in her native language due to no education. I’m also very close with his father and sister. We all text on a daily basis.

More can be added during the consular phase.
Btw some credit card issuers will let you add authorized users who don’t have SSNs. I added my fiancée as an AU to one of my credit cards and used that as evidence.
yes! I do have him on m credit card

ok great that's the answer I needed lol. I just wanted to makes sure I could add more in later. thanks

right now I have pictures with him and my children, his mom, dad, sister, brother, aunts, uncles, ramadan celebrations, birthday parties etc., 8 years of chats, 2 vacations in Colombia and 2 visits to Morocco and ill be going back for a 3rd but it will likely be after I apply. 1 visit to Morocco we lived in his sisters apartment alone for 2 months or so... should I apply now or should I get more first?

such as pictures? I am very overwhelmed and anxious/nervous to apply so I need very detailed straightforward answers. I feel like I have no idea what I'm doing should I just apply and add things later? is that an option? or will they deny me and make me reapply? what exactly am I submitting? why do I feel so lost when I have a masters degree in law? ugh I am so frustrated I haven't already applied and we have been together so many years 😢😭

Exactly 180 days from entry. This is confusing...how?
EDIT: Normally, visa overstays would not be an issue for a spouse visa case. But the jail time complicates matters. As you planned, file and see what happens.
180 days is a LING TIME to remember. He has other major issues going on and it was an ACCIDENT why are we focusing on something that ALREADY HAPPENED THAT WE CANNOT FIX?!!!??? What’s wrong with you people?? I’m looking for a solution if your here to antagonize find something positive to do with your life. Just because YOU ARE UNHAPPY doesn’t mean you need to try to make others unhappy also! Spread love not hate - I’ll pray for you hating people when I’m praying our visa gets accepted also. Smh this is crazy

Being a USC and married myself to a Moroccan, i tried to give advice from the question "can he still be approved for overstay in Korea?"
that being said, he is the one who must face a CO (consular officer) at the interview and answer questions concerning his ROK criminal report
to overcome a denial , he will need to show he went to ROK to seek asylum / he needs the documents to show he applied at the Korean Immigration Services or he applied at POE
When you express your intention to apply for refugee status at the time of immigration inspection, you will receive a written Application for Refugee Status Recognition. If you apply for refugee status at the port of entry, you must go through a pre-screening assessment. This will decide if your application will be referred to the refugee status determination procedure within 7 days.
then he needs to show proof he reapplied every 6 months for the 3 years he was there
he will need to explain the jail time
a visa approval or denial will be totally up to what he says during the initial interview and how the CO perceives him and his explanations
everything i posted earlier will give u info on what to do if CO denies the visa and either says "he can file a 601 waiver" or gives out a 221g to send the case back to the USA for a NOIR or NOID
maybe this was all too much info
get your documents together and apply
return to VJ if u need help,
myself
"been there /done that" without the jail time and Casa embassy can be hard on the process and emotions
Very sorry for your loss
You have been extremely helpful others not so much. I appreciate you taking the time to inform me about the realities of our situation and will be in touch soon. Thanks again 💞

Not a matter of how I feel- The TOS specifies that anyone may post on any thread. Since you’re new here, I was reminding you.
You specifically stated in teetering in a violation how does this relate??? I asked you to leave me alone since you’re not trying to actually help in anyway. You’re only harassing me at this point please stop. Thanks in advance

Most people who are persecuted in their home country would seek asylum someplace else. To avoid persecution. Like how US asylum seekers who are successful are generally not allowed to return to the country where they were persecuted. Make sense?
You are teetering on a TOS violation here. Anyone may post on any thread.
That’s how you feel I feel as though it’s you -We will find out won’t we?
Awaiting interview date

The NVC approved our financial support documents and I got an email stating I’m waiting for the US Consulate to give an interview date. I’m trying to fill out my timeline and I’m unsure of what area I’m putting the date of this email? “Left NVC”? Apx. How long does it take to receive a interview date from the US Consulate in Morocco?
