    They have given the month of December interviews to those DQ through March 5th. They are about 8-9 months backlog.

    You will get an email from NVC once you have uploaded all of your documents through CEAC and they are accepted. You will get an email and in the title it will say "Notice regarding your Immigrant visa case becoming Documentarily Qualified" In the body it will tell you that they are working with Mumbai to schedule your interview etc. Once you get this email then this is your DQ date of the email.

    Yes that is your DQ, but it you got that email then you would of completed the DS260 along with all of your other submissions of paperwork in CEAC.

We inquired twice about the production of his GC and got generic email responses both times. We were about to make info pass appt #3 (he had to do 2 info pass appointments to get a stamp in passport because of expired extension letter) but on August 27 his status in the system changed to "Fingerprints uploaded" so we were happy that it seemed they were getting ready to produce the GC. But then, a couple weeks later, it updated to "your case was approved and your approval notice will be mailed". We are in possession of both approval notices with different  approval dates. So we made several phone calls which amounted to over 15 hours on hold to finally speak with a Tier 2 Agent. He says that his system doesnt show the earlier approval, but the previous 2 lower tier agents both confirmed the conflicting info. I persisted and he hesitantly acknowledged conflicting info and said he would push for the GC to be produced. A day or 2 later, the system updated to "your case was transferred". Its been over a week since and we are still waiting on the letter to explain the transfer.

    We are wondering if we should just patiently let the process happen on its own, or should we make an info pass appointment to attempt to gain more insight? The info pass appointment location is 3 hours away and we aren't sure missing work for this would benefit us.

    The most concerning thing is we are about to close on a new home and the lender has already voiced concern over no physical GC. Yes we realize they still are required to accept his stamp and approval letter but we have already gone through one lawsuit with another lender because of this. We really want this to be over and wonder if there is more reason for concern over the delay.

    I would contact my local congress person!

    My husband was scheduled for a CR1 visa interview on November 05. Now, I went on usatraveldocs to make an appointment for him for biometrics. And somehow, out immigrant visa appointment was also rescheduled!!!!! 

     

    I'm scared, I don't know what to do. I called usatraveldocs and now they're telling me that the interview is scheduled for October 20th. I am so so confused and I dont know who to ask for help. I can't call the embassy, they direct me back to usatraveldocs. 

     

    Does anyone know what to do here? 

    When is your biometrics appt? Did you log-in to CEAC to see what it says?

    They are on Telegram..but the admins are bit over their heads. They think they know everything and kick folks out of the group for ridiculous reasons. Apparently they think if you have already interviewed you shouldn't be part of the group. I think those who have interviewed have more to offer..go figure! Sadly it has gone to their heads...but it used to be a great group to be a part of..good luck.

    Yes they have translators for those who do not speak very good English, but if he can manage then I suggest he does English as it shows he can transition to the USA. I am guessing they have Hindi for sure, but don't know about State languages.

And when the U.S. Embassy receives the case they also get all the pictures and evidences submitted with the i 130?  I’m pretty confused as the CO asked me submit more relationship evidences through a 221g when I already sent a whole lot of evidences pack with the i 130. 

    I would assume they do not submit everything. They have been known to misplace documents. I would send the same info at the NVC stage. I did this to be on the safe side!

    I am in a chat group where 3 people who had cancelled interviews from March 17th received an email to reschedule their interviews at the end of this month. They all DQ in Nov/Dec.

I read few interview experience recently, it is taking 5-15 mins only for interviews and less than 30 mins of total time spent in Consulate. The Mumbai Consulate has HUGE number of CO windows, so even if they are working 50% they will be clearing it fast. (Even my hubby was done with his Passport renewal and PCC in 15 mins recently in Jaipur. So expecting similar faster processing. I know they are totally different but still)

    b) The restrictions on Tourist / Work visa / Student Visas is going to help release the bandwidth to IR1/2/CR1/2 cases. This will be turbo boost. 

     

    It has been such a pain for the spouses to wait specially when they are in another country,  Covid numbers are increasing and economy is heavily impacted, hence praying everyday for a faster closure now for all of us.

    My husband already had his interview in February this year. They do not have a "huge" number of windows that they use. They typically have around (3-4) US officers total. (Non-Covid days)The process takes several hours. They were moving at a swift pace, but the process from arrival until interview can be lengthy. Check in, screening, submission of docs that are checked by Indian officers, and then finally the interview with the US officer. We spent 3 hours at the embassy as my husband chose to speak English and they do those last. I would say there were around 50 cases that day. They do not schedule interviews daily. There are a lot of folks waiting and the backlog is since November. Its is best to be optimistic, but also realistic.

    Before the shutdown there was a 3-4 month wait for IL, so basically they are 9-10 months behind. Folks who had DQ in December with Interview for March cancelled are now starting to get emails to reschedule.

    Follow the instructions. See Part III on the form about additional attachments for new forms. You have at least two.

    • Form 8965.
    • You need the statement choosing to treat your husband as a resident alien for tax purposes in 2018. He was nonresident and is not allowed to file a joint return, but there is an exception and it requires a statement signed by both. **
       

    There is no limit on amending as long as it’s in the timeframe allowed.

     

    You will find it easier to complete a new 2018 return from scratch as MFJ. Then you will have the correct numbers to copy to the 1040x. Several lines will change when you file joint. 

     

    **How to Make the Choice

    Attach a statement, signed by both spouses, to your joint return for the first tax year for which the choice applies. It should contain the following information:

    1. A declaration that one spouse was a nonresident alien and the other spouse a U.S. citizen or resident alien on the last day of the tax year, and that you choose to be treated as U.S. residents for the entire tax year
    2. The name, address, and identification number of each spouse. (If one spouse died, include the name and address of the person making the choice for the deceased spouse.)

    I was fully covered, but my husband was not as he lived in India and not the USA. I don't know if I am supposed to check this box. I read Pub. 519 and it says nothing about what do do for that check box.

    No supporting docs need to be included with the mailing of the amended return. If they want any documentation they'll send a letter.

     

    Note: Processing can take 3-4 mos. for an amended return. Give or take and with the shutdown they're probably backed up even moreso.

    On the 1040x there is a check box asking about coverage of healthcare. It only has one check box to cover both of us with the question regarding if we were covered. My original return i checked the box as he was NRA at the time. Do I check the box again? 

     

    I was fully covered, but my husband was not as he lived in India and not the USA. I don't know if I am supposed to check this box. I read Pub. 519 and it says nothing about what do do for that check box.

  16. My husband arrived this year and so I filed MFJ for this year since I now have his ss number. I want to amend my taxes from 2018 as that is the year we were married. At the time he obviously lived outside the USA while we were in the immigration process. He was also unemployed during in 2018.

     

    I have a couple of questions that i hope you can guide me :)

     

    1.) The 1040x has a box that says to "check" if you both had health insurance during 2018. I did have it the entire year, but my husband didn't as he was not in the USA, so am I supposed to check the box?

     

    2.) My husband is employed now, but was not in 2018. Do i put "unemployed" for Job title with the signature or his employment title now? 

     

    3.)Is there any other forms that go along with the 1040x? 

     

    4.) This is my second amended return for 2018, the first time I  amended my tax return status from "Single" to "MFS", and now I am filing MFJ to get the difference of the refund..will this be an issue?

    take everything and anything. It depends on the embassy and since you didn't complete your profile it is hard to advise.

    That is in incorrect. I’m on a chat group of 240 peeps waiting for Mumbai. Trend is 90 days to receive IL from DQ date. They just scheduled through DQ OCT 8th for January. Expecting for remainder of DQ for October to be scheduled for Feb interviews. CR1/IR1 and F2A peeps are in the group and about 50 got IL.
