OMG for once the embassy was actually faster than we expected. We got my appointment letter today. April 12th in Copenhagen. We were hoping it would be sooner but at least now we know. I do have a question for you guys. Do you think it would be a problem for me to go to the states in the meantime? I don't have anything but the appointment letter to show that I intend on returning to Denmark. No job, school or house.
jsut would say for now
congrats

Hello All,
Please I need help on something very basic but very confusing to me right now. To all or anyone that has already applied. Am filling out my 1-130 application right now but am confuse of what name to right for my wife as her last name here. We got married few days ago in the Philippines and on our marriage license it still reads her maiden last name. So what name do I write as her last name on this I-130 petition and on her G-325a, my last name or her maiden name? Please if anyone can help me with this small issue I would really appreciate it.
Use the last name she'll be using on her passport,AND ALL LEGAL documents she used before the marriage
does she have a passport already w/ her maiden name??
good luck

You don't have to have known someone for two years, but you have to have physically met in the past two years.
thanks buddy but
someone just messaged me tht i might be asked n grilled in interviwe
actually i m frm india
most of marriages take place tht way
everythng is legal n pure in our case except the meeting only 1 onth before and knowing each other for hardly a month before marriage thru matrimonial site
hope evrythng goes well
thanks ,

I thought that I read that a visa must be used in a certain amount of time after it is approved. Is this true? If it is true how long is the time limit on a CR1 visa?
anywhr 6-9 months might be less also
varies with case

Another post got me thinking that this might be possible...
OK, first of all, before anyone gets twitchy, I AM NOT GOING TO DO THIS. Nor do I IN ANY WAY suggest that anyone do this - I think it's morally questionable and maybe illegal as well. But since this is a forum, I'm just kind of curious what everyone thinks.
Is it really impossible to send in the I-130 petition before you get married? Don't the petitions sit in a box for several months, and then when the adjudicator finally looks at it, if something is missing, doesn't he/she then send out an RFE? Couldn't you send the marriage certificate at that point? Especially if you had a lot of other supporting eveidence of an ongoing realtionship...
Or would they chuck the whole thing if they see that you sent the main petition before you actually got married?
Your thoughts...?
this is so funny what you wrote
but,
i wish it was possible
its just a wish
it isnt possible dude!

YES !! The NOA1 arrived in the mail today !!!!!!!!
I know it's just the start, but I'm relieved and thrilled and so excited about him getting here !!
The notice date is February 28 ... does that make me a February Filer? Hope so.
Thanks to all of you for the moral support and encouragement! Nothing like being powerless to make you a little nuts.
I have an expectation of a gradual, yet distinct, mental decline after waiting 8+ months to be approved. By June, I'll be having conversations with door knobs.
By September, I'll be blubbering to myself when no one's around.
congrats
good luck for the real waiting now !

At the moment, I'm a 15 year old Australian girl engaged to a 20 year old US citizen. I'll be turning 16 on the 13th of April, and I'm wondering how I can go about getting a visa to be able to live with him. When I turn 16, I'll be legal in my country, and also in his state. To get married we'll need consent from my parents, which is no problem, as they've already agreed. I know it sounds controversial, but I'm really worried about which visa path I take, because I don't want to screw anything up for myself and not be able to come over to the US.
Also, my father said he called the American consulate here and said that since I have no work experience and no skills, I don't have a much of a chance of attaining any visa. I'm actually curious to know if this is true or if he's lying to me. Sorry to be so dramatic, I'm just kind of in a pickle here. Advice/suggestions very welcome!
Additionally, if anyone knows about the total fees they've had to pay and how long it took them, that kind of information would be really great too.
girl why dont u take a student visa or something to united states n then get married to him
tell your partner to support u ,
why u wana take strange steps be careful before doing anythng which can ruin your life n career
good luck

I wont get cover contraversial part of this, Im sure you will get enough of that from the other people here.
Work experience and education are not considered in family imigration visa such as the K-1. They are considered for other types of visas.
You need to be considered legally able to marry. Even though 16 is the legal age in some places for marriage, you might run into issues with that. Waiting another two years until your 18 before starting this process might be a good idea. There may come questions about the legitamcy of the relationship since you are still not considered an adult. It wont be very fun to wait 6 months or more for the interview and pay all the fees only to get denied because of your age.
You need to have met each other within the two years prior to filing the I-129F form. You will need to provide proof of the meeting. Anything from photos, to reciepts to boarding passes will help.
Your fiance (or willing co-sponsor) will need to be also prove that he/she makes 125% of the poverty guidlines. Or has enough assets to meet that level for 3-5 years.
Fees total about $1000+ over the whole process, but not all of it has to be paid at once. It is proposed that the fees will increase in 2008. Inital filing is $170. Visa interview and medical could cost $200+ depending if vaccinations are needed. AOS after you get stateside is $500-$800 depending if you decide to file for AP and EAD as well. later on, you will have to pay a fee for removal of condtions, but thats two years after the AOS.

You have already had your I-130 in process for 5 months and the I-129F is generally filed after receiving the NOA1 for the I-130, as a faster path to a visa and being reunited with your spouse. This is not the case with yours as you have already let 5 months pass and IMO would be a waste of money as you should be looking at an approval on your I-130 soon.
hello aussiewench,
pls let me know if u have an idea should i apply for visitors visa at this time i have an very important exam coming along
if i dont give it then mine 1 yr will waste
can u advice pls
thanks

Hi cutest_girl,
Since it is about 5 months now since the I130 was filed, I'd realistically expect the NOA2 this month, and add in another month for the NVC to get all the other docs from you. The NVC seems to be taking 6 weeks to process the paperwork (assuming no RFE's) , before they punt it over to New Delhi (which is pretty fast in India). If things go at the regular pace, I'd think New Delhi should have the papers in June.
In the meantime I'd give the visitor visa idea a chance too. My wife did, and we are glad we tried since we were able to be together in the US for 6 weeks. I just heard from her that her CR1 and K3 visa interview dates are in the end of April in Mumbai, so we're excited!
In our case the NVC part of the CR-1 case was longer than most people generally experience - since I was not in the USA for most of January and February, and the paperwork got delayed by me.
vasu
thank you vasu
pls kleep me more informed since our dates are almost equal u are just one month exactly ahead of me
i will let u know if any thing of my petition on my side
good luck !
Good luck with the whole process... its an odd ball ride to be sure.

Thanx guys for your support.
My husband phoned the call center before sending in our petitions and 'they' informed him that it was not necessary to send anything or mention this in our petition. So guess we should have know better and been proactive, rather than just believe this.
Yesterday he phoned 'them' to inform them of my change of address and 'they' said that 'they' could not change it because 'they' did not have the papers with them. He then enquired about how much longer before we hear anything and was told that for the 1130 it could take anything from 6 months to a year. He then promptly asked what about the I129f, and was told that that is a fiance visa. hahaha. He continued the conversation and tried to explain that it was indeed a K3 spousal visa, which as we all know is also applied for with the I129f form. So much for getting there quicker.
Needless to say the conversation did not last much longer, and he told me that he is NEVER phoning 'them' again.
So we are nearing the 180 day mark, and my husband will contact his congressman at that time.
Today is one of those days that I keep wondering why, why, why did this happen. I am stuck in limbo and it is killing me.
Thanx for letting me vent
sweetheart no use calling them i have already crossed the 180 day mark tired of calling was of no use
but you r sure in better boat coz u applied for k-3 and i didnt
so just relax tensionfree
i got my noa-2 today ..
