  1. Has anyone had any success in expediting based on a clear USCIS error? We filed our I-130 petition online. We recently received an RFE saying:

     

    You did not submit a copy of the Form I-130, Petition for Alien Relative, at the time you submitted
    the documentary evidence. Therefore, U.S. Citizenship and Immigration Services (USCIS) requires a
    copy of the original petition and your signature to continue to process your petition.

     

    We called USCIS and spoke to a Tier 2 Officer who said that our file does have the I-130, but to follow the RFE to prevent delay. We have payment confirmation, NOA1, and I did screenshots of the entire online process documenting everything to show certain items must be ticked and filled in order to complete the application including digital signature and acknowledgements. Therefore, because we have an NOA1 and payment confirmation, this confirms we successfully submitted the I-130. He filed an expedite request to the service center but he did not ask for evidence. I am sending out the RFE materials (a filled out I-130) overnight as well as a separate document with our evidence showing a clear USCIS error. Do you think this is a clear USCIS error? 

  2. We filed the I-130 and then shortly after we also sent in our 129f application for a K3. We know its rare but there have been many rumors that it can speed up the application process. It does not seem to be working now like it did last year, but it is free to file so worth a shot. 

     

    This RFE is for our I-130 not the 129f. When we sent in our 129f, we also sent in a copy of our NOA1 for the CR1 as it is a requirement per the instructions. 

     

    So scratch the 129f as this RFE has nothing to do with it. It is the fact that we filed the I-130 online, the USCIS officer confirmed they have it, and now we get a RFE saying they do not have our I-130 form when it was done online. 

  3. I called USCIS and spoke to a Tier 2 Officer. He could not provide me with any information. I could not get an answer whether I need to send the entire I-130 application evidence and all or just the form. The RFE says the I-130 was not received when I submitted documentary evidence. He could not tell me anything other than follow the directions on the RFE but did confirm my I-130 is in fact on file. This is a nightmare! I then asked if I can Respond to Request via my USCIS account to avoid  going to the Post Office to overnight it during this pandemic and he said I could just put a stamp and mail it in. The USCIS website says it is highly recommended to get a tracking number when responding to RFE. I do not understand. I filed the I-130 online!

  4. We got a RFE :( I am assuming this is a request for initial evidence since our PD is February 2020. Our RFE does not make sense. They are saying they never received our I-130 form even though we did it online. The RFE also says if they do not respond in 60 days to contact them. Does this mean someone has touched our case early? How in the world do they not have our I-130 when we have a receipt notice that confirms our I-130 petition, confirmation of payment, etc. How would they even get our contact details without filing the I-130? 

  5. I am just so confused! How could we submit everything and payment without completing the I-130!? Hell, we couldn't progress in the application leaving dates blank so we had to put in the date of filing on certain items to show "PRESENT" such as dates of current marriage and employment. I am contacting them as soon as they open tomorrow morning their time to see what is up with this notice. I am still so confused why they are saying they did not recieve out I-130!

    We only returned that one page with signature to them, along with all the other things they asked for in the RFE :) 

    Are you saying this was the only thing they asked for (the signature)? That would be the first time I'm hearing this.

    It seems like they are asking for the entire I-130 as they said they did not recieve it and to ensure the I-130 form I send is signed with an original signature. This is the only thing they asked. Just seems odd that we completed it online.

  7. We just recieved a letter in our account for Request for Evidence. I am assuming initial evidence as our PD is February 2020. The request is as follows:

     

    You did not submit a copy of the Form I-130, Petition for Alien Relative, at the time you submitted the documentary evidence. Therefore, U.S. Citizenship and Immigration Services (USCIS) requires a copy of the original petition and your signature to continue to process your petition. The petitioner must sign the form on page 9 of 12. A photocopied signature is not acceptable.

     

    We are confused as we filed out I-130 petition online and now they want a hard copy. Has anyone had this happen to them? Do would just print out and complete the I-130 form manuall and mail it to them?

  8. Make sure to contact USCIS to double check your service centre. Our receipt notice said Nebraska and then in the end of February with all the transfers, our account updated and we found out we were "transferred" to Potomac. We were told it was not a transfer and that by default the receipt notice said Nebraska until it got routed to the appropriate centre. So we are in Potomac and not Nebraska.  From what they said, all IOE's get routed to Nebraska first and then they go to their respected service centre. Some receipt notices reflect the update and others do not. 

  9. Yes I have looked and applied to every job imaginable. I removed my qualifications from my resume so I now only have a high school education. Hopefully this helps when trying to get into retail, labor, etc. I just need something to meet the income requirement to bring my husband here. I also applied for a few jobs back in NZ, because at the same time I do not want to through my education away and maybe we just have to stay there. It is so much easier to get a job in my field in NZ. Costco is a good company to work for and I had applied for a cashier position.

    Then you should know that whatever result you come up with will be highly unreliable due to many reasons, one of which is you have to make many assumptions about the probability of users' updates on their timelines and their correctness. You also need a huge dataset to create proper statistics. Not to mention the other variables that are probably missing and/or incorrect.

    Eventually, you'll end up with something that has nothing to do with anything really :).

    @Niia and @Rosie91, and everybody else ... be patient guys.

    Of course I will know this would be unreliable, but doing whatever passes the time and I enjoy messing with data, fake or not 😀. I am also aware of what is needed for proper statistics so thanks for your input on that.
