    Yes, it was all at the same time. And that makes me feel so much better that it was combo. How long did it take to come in the mail? Today is day 14 after case approval and still nothing in the mail. 

  2. I'm still waiting for a response for our AOS FRE, which they received December 18th. My husband's AP was approved on the 11th of February but we haven't received anything in the mail and the case status for his EAD still says "Fingerprints taken". He has a job offer, and has had quite a bit since he's arrived in the US, but of course, with no EAD, he has to turn them down. Is it worth submitting something to expedite his EAD or should we just wait since were almost hitting that 5 month mark?

Does this mean such applications are processed in Illinois? Or are they then sent to a centre local, appropriate to the residency of the sponsor (in our case New York).     I'm waiting for our AOS, EAD/AP right now. Here is my timeline:

    • August 27, 2019: Husband arrived in the US from UK 
    • October 5, 2019: Married 
    • October 8, 2019: Sent AOS in mail 
    • November 11, 2019: Biometrics appointment 
    • December 5, 2019: Received RFE on AOS 
    • December 18, 2019: USCIS received our response to RFE 
    • February 11, 2020: AP case was approved

    We are still waiting for EAD and AOS. I'm hoping the AP and EAD come in as a combo card and soon. The wait sucks lol.

    This is how my taxes turned out. And it took away almost my whole refund. I deleted my progress and had family help by having them enter it in thinking I've done it wrong and it comes up with the same thing. In form 1040, it added my income and his together in line 1. Then in 7a, it shows his (foreign earned) income as a negative and 7b as just my income.

    Yes, would she need the father's permission for him to leave England to come visit here in the US?

  6. Not sure which forum this goes in but my husband moved over last year on a k-1 from England. His parents and youngest brother were planning on visiting next June of 2021, however, his parents are having issues and now it may only by his mother and youngest brother (who is 9 years old) that come to visit. Would his mother have to have his permission to come visit. It would only be two weeks at the most but his dad is almost in his 70's with really bad Parkinson's and would never be able to watch and take care of his brother.

    Go back through every question under Foreign income in the Less common Income section which is the last section on Income.  Qualify him as a Bonafide resident.  I know it works because I have already done a K1s taxes for 2019.

    Okay, I was able to do it on Turbo and it shows that his income is - in front of it but it did take away practically my entire refund. I put him as the physical presence because when I read on the Bonafide, it said that he is intending on returning to his foreign country. For some reason, Turbo tax won't let me just put his income unless I put a negative in front of his income but then it doesn't show at all on the form 1040.

    If you go through the Less Common Income section of TurboTax and answer the questions, it will fill out Form 2555, put the exclusion on a filled out Schedule 1, and enter it as a minus number on the 1040. You will require at minimum a 1040, Schedule 1, and Form 2555. If you got interest paid on any bank accounts, then there is a Schedule B in your return as well. 
     

     

    Okay, so when I don't put a negative sign in from of his income, it says we qualify for the Tax exclusion and it shows both our incomes but in line 8a it's not coming up as excluded

    But  a $3500 swing sounds like you have made a mistake. Print a copy of your 1040 From the program. Check the following lines:

     

    Line 1. Total of [your salary income] PLUS [his foreign income]. Is the total correct? 

    Line 8a. His income with a minus sign in front of it. Example:  -18,000

     

     

     

    So on H&R I was able to put a (-) in front of his income and it worked, bringing back my refund. On Turbo tax, it will not let me put a (-) sign.

    Assuming the FEIE applies and the earned amount is under ~$100k, I wouldn't be too worried with the exact amount as it will all be excluded anyway. This doesn't mean don't do you due diligence to get the best number possible, but don't freak out if it turns out not to be exact.

     

    Nice! Yeah, it added ~$5000 the first year my wife came over. Certainly not as good as her working, but it was a big help in getting us going with her life in the US.

    I got on the gov.uk and have exactly what he made but when I put it in, it takes my entire refund away... 

  11. I don't want to fill up someone else's post.. My husband moved here on a K1 from England on August 27, 2019. He worked while in England until he moved here in the US. I've been trying to do my taxes as MFJ with Turbo and then with HR Block. When I go to enter my husbands income, it asks about Bona Fide residence period. He moved in the middle of the year so I'm lost as what to put here (this is using HR Block). When I tried Turbo, it cut my refund by over $3,500 after entering in my husbands income. Now I'm seeing what HR does however it's not letting me enter in dates... or maybe I'm doing something wrong.

    This is were I'm at. My husband (who came on K-1 from England) worked and never received anything about taxes. We looked it up on gov.uk. So I go into Turbo and enter in my income and then his based on that website as MFJ  and it just cut over $3,500 in my refund.

    Pick the third choice. It doesn’t matter. It’s a TurboTax question, not the IRS asking.  The IRS needs no actual form like your W2 showing the foreign income.

     

    Perhaps you entered his income twice? Maybe did you add it earlier when it was asking about W2s? Did you say you had a W2? Yes. Did you say he had one as well? No he doesn’t. 

    That's what I'm thinking I did too by entering it in twice.

    So the P45 is like the W-2? And his only goes from January 2019 to August 2019. I used the money converter on Turbo to estimate what his wages were in US dollars but when I enter that amount and then it shows the summary at the end, it says "It appears he made this amount" which is double what I said he made.
