  1. We're on day 19 of our case status changing to "Case is Ready to be Scheduled for an Interview". I was looking on the Boise offices for closures and it says this..

    Schedule an Appointment

In order to visit this office or to speak with an immigration services officer, you must have an appointment scheduled by USCIS, or you must schedule an appointment.

Can we just schedule our appointment ourselves instead of waiting for USCIS to schedule it?

They will only accept the I-797, but not the card? That's really strange... normally one only needs the physical card.

    DMVs....ugh. Welcome to the US.

That was my thought as well. He brought in his social, his birth certificate and they still didn't accept that for the spelling. I think it's all silly and a waste of time and I might talk to the supervisor to see if the other stuff will suffice. I did notice that everything just has his first name and then middle initial. The I-797 form is the only document sent from USCIS with his middle name spelled out fully and of course they would get it wrong!

LOL so his name is A. Brain Smith?  I guess that makes you Pinky (Pinky and the Brain)

Anyway you have to send the card back and it can take them a while to send you a replacement... Every DMV is different depending on where you live but in general they use a system to verify immigration status in a database. The spelling must be exact for it to give confirmation. They need the confirmation.

How important is it for him to drive right now? Cause your options are 1- wait for the replacement which at its worst will be several months 2- go back to the DMV to the girl who was going to give him the license and get it, let him be Brain for a while. When the replacement comes go back to DMV and be prepared to wait several hours for them to correct it or 3- pretty much number 2 except check with the girl or her supervisor to see if they are actually able to give him a Brain DL (because usually they want all names to match or have some kind of name change documentation about the mismatch) and if they can and do would it be a lot of trouble to correct it. Maybe taking a misprinted DL now would cause more issues then its worth.

Sorry, they didn't spell out his full middle name. Just put his middle initial. Lol.. But yes, he's like Pinky and the Brain 😆.So technically, his EAD is correct, only the I-797  paper is wrong but that's the only one they'll use for his name. I was hoping I would just have to send in his I-797 back and say fix it and just keep the card since the card is correct.

    USCIS SAYS:

If your EAD contains incorrect information because of a USCIS error, we will make the appropriate correction at no additional cost to you. In these cases, you do not need to submit a new Form I-765 or a filing fee. Instead, you must submit:

    • The original card containing the error,
    • A detailed explanation of the card error, and
    • Supporting documentation on the correct information.

Submit this information to the service center or National Benefit Center that approved your latest Form I-765.

In either case, if we receive your application or request for a replacement EAD and you no longer have any basis for applying for an EAD or employment authorization, we will not return the card and will notify you that you do not have a current basis for applying for an EAD or employment authorization.

    Reference https://www.uscis.gov/green-card/green-card-processes-and-procedures/employment-authorization-document

Of course, then he will once again not have an actual card to show until they process a replacement. It won’t happen quickly.

So I just took a copy of my husband's EAD card and they only put an initial instead of his full name. The only thing that has it spelled incorrectly in the I-797. Do I actually need to send the card back or just have them redo the I-797? I don't know if the gal at the driver's license place is right or not, but they stated they could not put his name on his drivers license the correct way, even though he showed them his social security card  and birth certificate, that they could only go off what the I-797 showed.

HI! I'm a December filer (AOS - EAD - AP from a k1). Still waiting my EAD and in the meanwhile I'm starting to search for jobs.

In case of having a job offer can I ask an Expedite for EAD? Which are the criteria? Do you guys know if in case of negative response my processing time can be even slower? Thank you

We were in the same boat as you. We filed in October and still hadn't heard anything. My husband got a job offer and my daughter needed surgery so we had to expedite. When you call in and ask (and they will only speak to the Applicant), they ask you for the reason of needing an expedite as they have to order under a certain code or something like that. I've heard of people getting approved to expedite based on only a job offer so there's no harm in trying. I had to fax USCIS my husband's job offer letter. We faxed it off on 3/11/20 and the card came in the mail on 04/08/20.

  6. So once again, the government has messed up on the spelling of my husband's name on his NOA1 and on his EAD card. When he first entered the US they put his first and middle name together as his first name and now they spelled his middle as Brain instead of Brian. We never caught it until today when he went in to take his Idaho written driver's test. Do I email USCIS or call them to have this fixed?

The Boise field office is temporarily closed due to COVID-19. On the USCIS main website it says that all in-person interviews have been suspended until June 4th. You can check here for more infomation:  https://www.uscis.gov/about-us/uscis-office-closings  and here, for your specific office: https://www.uscis.gov/about-us/find-a-uscis-office/field-offices/idaho-boise-field-office

There have been cases, recently, for which approvals were issued without interviews. I don't know how often this is happening, but maybe you'll be lucky. Please, keep up posted and Good Luck!

So am I suppose to schedule the time and date? I thought they just sent you a letter telling you when you're suppose to be there as the app says they will schedule the interview and send us a notice.

  8. The status on our AOS case changed a week ago to "Case is Ready to Be Scheduled for An Interview". I still have not received anything in the mail, and was wondering how long did people have to wait until they mailed them their interview date and time. I know I should be bringing my packet that I sent in, in the case that the officer's can't find something. I need to bring proof of relationship such as joint bank account and pictures. Is there anything else I need or should bring? I would love to hear of other's interviews and how they went and were asked recently. Thank you!

  9. My case finally has changed since December when they received my response to their RFE on my husband's I-485. Now it says my case is ready to be scheduled for an interview. Does this mean it's been approved since I never received an NOA2? I know we have to go in for an interview to be FULLY approved but since it's ready to schedule, I'm assuming they accepted my response to their RFE?

  10. I had asked the Driver License office in my town of Idaho if my fiance (now husband) could get his driver's license but they told me he couldn't until he became a lawful permanent resident after our AOS goes through. I received an RFE on our AOS back in December and we're still waiting for them to process it. I was looking online and it reads that he can still get his license before the AOS goes through if we have an unexpired EAD card and proof that we applied for AOS. We have both so should he be able to get  license? He works construction and needs it to be able to get on their insurance. Thank you

Did you not have a receipt number issue as well? Your receipt number was not your actual receipt number which was crazy!!

My EAD took 107 days to arrive, in hand without an expedite. Granted the SSN took 4 weeks after that to arrive, however they arrived. I am just thinking that with the amount of activity we are seeing with EAD expedites, you may also be dealing with that. It seems everyone needs an expedite these days. Stay strong. With the current climate I can only see more delays.

I do totally agree with you that what tier 1 agent you get make a huge impact. I have hung up and call back in the past to get more info.

Yes, it's been a mess. I feel like every step we've had something happen so slow down the process. His social took a while too because they combined his first name and middle name together like it was all his first name at the port of entry so that slowed it down. It's been 165 since USCIS has received all my paperwork. 😭

I know the feeling lol, I just want to work so bad, plus with hardly able to go outside, I am trying not to lose my mind.

That's where my husband is at. And we live in a super tiny tiny town with NOTHING to do. We have a Walmart and that's it. He's losing his mind after 7 months of being stuck in the house and I'm at work for 9 hours of the day Monday through Friday so he's always alone.

I would say call non-stop. Also check under your EAD receipt number and see if there is any update there under the history. I had my expedite approved 35 days and they havent been able to give me a straight answer but I still call because some agents seem to have or provide more information, not sure but always worth a try and ask for tier 2.

That's what we're doing. Some officer's seem more knowledgeable and helpful while others are rude and give information completely different. But I do check our case history everyday. This visa journey is definitely been the most trying thing I've ever had to deal with so far. If I could do it all over again, I would have gone the CR-1 route. But I can't wait for the day I don't have to every deal with the government again lol

I faxed the job offer on the 16th of March and didn't get anything yet( Hope they are working on our cases right now.

We've been calling in weekly and at first they told us that they only had 3 people working in the office and they're only handling 10 cases per person so it could be April 1st before they got to our case. That was last Thursday. Today we called and we were told that they're shut down and it could be 50 days but probably longer.

  15. 5 minutes ago, Villanelle said:

When you say you faxed them his job offer I am assuming you mean you asked for an expedite via a phone rep- they got back to you and gave you a fax number- you then sent it via fax- correct?

If so Im not really sure if there is anything more you can do besides wait. Some offices are closed but not everything. "As of March 18, U.S. Citizenship and Immigration Services has suspended routine in-person services until at least April 1 to help slow the spread of Coronavirus Disease 2019 (COVID-19). USCIS staff will continue to perform duties that do not involve contact with the public. However, USCIS will provide emergency services for limited situations. To schedule an emergency appointment contact the USCIS Contact Center."

Your EAD expedite is not considered routine in person (I dont think) nor do I think it qualifies as something that would require an emergency in person appt. Did he do biometrics yet? He has to have biometrics done to get the EAD so that could be an issue if he hasnt done them yet...

Anyway there are 3 ways of asking for an EAD expedite. 1- at infopass (not going to happen right now so we will skip this).2 over the phone, 3 via help from local rep. The important thing to note is whatever path you take you can only follow up via the same method. So you cant apply at infopass and then inquire over the phone about it, any inquires must be through infopass if thats where you started.

The phone rep is the most convenient way to ask for the expedite but its also the most frustrating as you can never speak to the same person again. Check your case status online and see if there is any indication they got your fax and if they are processing it. Theres a thread called something like timeline after ead expedite request. Its many pages now so you should be able to find it but if you cant let me know and Ill link you to it. In it there is a lot of information on how people got or were denied expedites and what you may see as case status and what that means.

You can also try to get help from your local representative with filing an expedite request. They should have info on their website about getting help with immigration issues. Typically they have a release form you need to sign and give them so they can interact with USCIS on your behalf. Before the quarantine youd be able to go to their office but you may not be able to do that right now- but you can probably mail them whatever they need if they are still providing immigration help. Call them up and ask. The advantage to using a reps help is they submit it and follow up on it. They also get clear official responses that are documented where when dealing with a phone rep its impossible to prove who told you what and no one takes responsibility for the process. You have 2 senators and a house of rep representative you can reach out to if you shoose to. But first check the thread I mentioned and your case status to see where you may be at before sending another expedite through your rep.

He had his bio-metrics done on November 12, 2019. I talked to a phone rep who said that would email me after I called in requesting the EAD to be expedited. I received the email and followed the instructions and faxed them the job offer on the 11th of March. On the 14th it was updated to finally show that his fingerprints were taken and since then nothing. I knew I had a waiting game ahead of us but this feels so long it's unreal! And people who have filed around the same time I did have already received theirs. I guess this post was to mainly just rant and to see if anyone else has had any luck.
