  1. Hi. I am currently filling out the I-864 and I am quite confused on part 3. (information about the immigrants you are sponsoring). We have a daughter and she is already a US citizen before we came here. Should I still include her name on the list? I read on the instruction that for items 4.a-28 you should list family members who are immigrating more than six months after the principal immigrant.

    I did. I asked for an updated affidavit with my father’s signature just to be sure. Thank you😁

My kids' bc has this when I registered them on the local civil registrar's office because they were born out of wedlock.

    I was asking if they got married after you we're born. Either way I believe that the affidavit is in the back of the bc or 2nd page. My kids we're born out of wedlock as well and the 2nd page of the bc is the acknowledgement. It says "Affidavit of Acknowledgement/Admission of Paternity". Check if your dad signed it. If he did then you're good. Make sure you have the PSA original when you go to your interview and double check if it matches your local bc. If asked during the interview why your last name is different on your bc tell them that you use your father's last name and your back up is the affidavit on the back of your bc. Remember to NOT give unsolicited info to the CO. Only answer questions you are asked. Goodluck!

     

    They're not going to ask you to change your passport. You are allowed to use your father's last name even if it is not what is in your bc based on RA. 9255 - REVISED IMPLEMENTING RULES AND REGULATIONS OF REPUBLIC ACT NO. 9255 (An Act Allowing Illegitimate Children to Use the Surname of Their Father, Amending for the Purpose Article 176 of Executive Order No. 209, Otherwise Known as the "Family Code of the Philippines")

    Yes they got married after I was born. I was able to get the AUSF at the lcr with my father’s signature and I even asked him to write an updated letter. Hope that would be enough. Thank you so much for your help.😁

    I renewed my passport in 2017. My bc hasn’t been annotated. I could get a PSA copy but the surname is under my mother’s name.

    Yes I was born out of wedlock.  I think my father executed an affidavit but I don’t where it is.  We’re still waiting on the NOA2. Are they going to ask me to change the passport on my mother’s surname?

    If you BC has you last name same as you mother, how were you able to get your passport in your father's surname, did he add his name to the BC and sign it?

    My father’s name is on the bc. As to how they were able to get my passport i’m not really sure. I’ve been using my father’s surname since I was in grade school and also when I applied for gov’t ID’s they did not ask for my bc.

    I’m not really sure cause I was only 10 when we applied for my passport. But when I applied for the driver’s license they didn’t ask for my bc. Would that be a reason for 221g later on? 

  8. Hi. Does the usem allow affidavits on birth certificate discrepancies? I just recently found out that I’ve been using my mother’s surname on my bc. However, on my official documents like passport, school records and driver’s license I have my father’s surname. I was born out of wedlock but I was able to use my father’s surname when I applied for a passport when I was 10. 

  9. Hi! Does the CRBA interview affect the k1? Just a little background, we met in november 2016 and became official the same month. Got engaged in december. During the CRBA interview my fiance was asked when did we became official. She said december which was supposed to be november. She got confused so she thought the question was the month when we got engaged. Does it have a bearing on our k1 interview later on?

    Create an account on my.uscis.gov/account and then send them the contact information but don't do it until you receive the NOA1 that way you can use the receipt number so USCIS can find your record. I'm sure you full name, SSN and birthdate would also find the record and should be included in any means you use to contact USCIS to correct this error. It's worth a try.

    I saw the contact information part, but needed more exact info on what you didn't fill out. If you didn't provide any info from the petitioner then your file can't even be accepted. They need a name, address etc from the petitioner to send the NOA's to. There's 3 options:

     

    1) Application gets sent back / denied since you filed an incomplete application

    2) RFE will come in asking for more information

    3) Case is thrown out, since USCIS has no info at all from the petitioner, so they don't know where they have to send the file/RFE to and who they are sending it to.

     

    I assume your address (you are the petitioner?) was on the envelope, so they might go for 1 or 2. I would give it a few weeks, and if you don't hear anything you can call USCIS to make sure your application is not there anymore and you can re-file.

    The only part that I missed out was the daytime telephone number,  mobile number and email address. But I was able to include my residential address on the form and envelope. 

  12. Hi. We just applied for our daughter's crba and I just have a concern regarding the proof of physical presence. It says that the US parent must be in the US for 5 years and 2 of which are after the age of 14. We submitted 5 years worth of tax returns ,w2's and old US passport but no school records since we couldn't find his transcripts. Would that be okay? Or would that be a cause for denial? He's a naturalized citizen btw.
