Why would you attempt to travel with an expired stamp? That's your only proof of residency - since you don't have a physical greencard the extension letter means nothing. To use the stamp, it needs to be valid, not expired. Always get a new stamp every time the other expires, I believe you can get a new stamp within 30 days before the current stamp's expiry date.

Well, that's why I'm asking for help, for me wasn't clear until this situation. Thanks!

  2. Hello everybody I need your help.

I had a situation yesterday with CBP and with these documents. The situation is that I haven't had the GC because USCIS made a typographical error in the length of time allowed with LPR, which was 10 years but really should have been 2 years (it should be noted that USCIS successfully approved my application for residency, the error was typographical in the GC), thus, USCIS asked me to return that GC of the typographical error the next day.

So, I have been using the I 551 stamp from 2021 to 2023. The last stamp already expired in May 2023. From the day the error occurred (2021), I requested a replacement of the card, which USCIS gave me an answer this year (May 2023) that they were not going to replace my 2-year temporary residence card because my case was in the process of removing conditions, which I applied last year.

Perfect. I also received the letter I 797 in January of this year, which indicates in its first line "We have extended the validity period on your Form 1-551, Permanent Resident Card, (also known as a Green Card) for 36 months from the date of expiration. During this extension, you are authorized to work and travel. This notice, presented with your expired Permanent Resident Card, is evidence of your status and employment authorization...".

This year I have traveled internationally on two occasions with the expired I 551 stamp and the I 797 letter, I have not had any more problems than the airlines corroborating with other colleagues if these documents are correct and when entering to USA 99.9% customs send me to a second inspection.

The inconvenience arose yesterday in the second inspection, where the CBP officer questioned me about the expired stamp saying that it was not related to the letter I 797. He asked me if I had a letter that corroborated something about the expired stamp (?), he said he would make an observation in the system for the same situation that I mentioned previously and that basically I must have a new I 551 stamp in my passport.

With this long context of my situation, for travel and work purposes, is a new I 551 stamp required? In the event that this situation escalates in the future in the sense of entering to USA, what would happen when being with the CBP? What would happen if my entry into the country is not valid? What I can do?

    Thank you so much!

English is not my first language.

When is his surgery scheduled?  You can certainly apply for a visa, but there is a strong possibility it won't rise to the level of emergency........but you won't really know unless you apply....go for it..

Thank you! I'll research more about it. But understand could be not strong case.

‘Presenting as a job’??   Not sure what you mean exactly, but does not sound legit.

Not sound ilegit. Depend of how you read. But if you read the previous post, can have an idea about it.

Sorry to hear about it but I believe you will still need to apply for a B1/B2 visa to visit.

According to the website that are in charge of USA visa in Colombia,

    https://ais.usvisa-info.com/en-co/niv/information/faqs#need_earlier_appt

You can request an expedited appointment. To request an expedited appointment, first schedule a regular appointment on the closest available date. Then, sign-in to your account, click “Continue”, select "Request Expedite" and follow the instructions. Expedited Appointments will only be granted at the Consular Section’s discretion. Circumstances that may be considered for expedited appointments include:

    1. I need an earlier appointment and there are no available appointments, what should I do?
      1. An immediate relative's death, grave illness or life threatening accident taking place in the United States.
      2. Urgent medical treatment for the applicant or their minor child.
      3. An applicant for a student or exchange visitor (F/M/J) visa whose I-20 or DS-2019 has a start date that is earlier than the first available visa appointment.
      4. An unexpected need to travel to the United States for urgent business purposes that is occurring within 10 days after the first available visa appointment.
      5. An unexpected visit that is of significant cultural, political, journalistic, sporting or economic importance that is occurring within 10 days after the first available visa appointment

however, based on that I don’t think you will qualify for an expedite if it’s just to accompany him for his injury and treatment that isn’t life threatening.

Edit : do note that if you want to go over to take care of him while recovery it can constitute as ‘work’ which you are not allowed to do on B1/B2 even if you’re not paid for it because you’re taking away a job from someone that would otherwise be employed to take care of him.

Thank you for take time to answer me @Muffinji. Could you explain me a little more if you know about it, presenting as a job? Thanks!

  7. What about expedited appointment? Nothing to do tourist even is only 2 weeks to visit will be good to be woth him. Recovery time take months, and he's waiting for the surgery. This is more details... He's living alone in another state away from his dad. What about taking in consideration this things?

  8.

These are a bit silly but big mistakes, but this happened: I put my mother's maiden name on the two previous denied visas. What would happen if now in the format of the K1 place the last name of married?

I think that having both incongruous formats could cause me a problem, but I do not know. Could you help me? Thank you!

  9. This is the context, in my previous (2) tourist visa applications that were denied the last year, I didn't register my old name change, because at that time I thought it was for "alias, maiden, religious or similar".

Now I started applying for k1 visa (not been sent yet), and in "names used" I registered my name change because I have to show the birth certificate and the name change appears on that certificate.

If so, how does it affect my k1 request?

How can I respond when they ask me about this?

Really, is it a big deal?

It was my mistake, because I didn't consider that "names used" was to register even name changes.

It should be noted that all my documents appear with the new name, including my passport and ID.

    Thanks in advance!
