  1. Okay everyone just updating this, I emailed CBP the day I posted this forum and they just got back to me

    I read they stopped giving out paper I-94s a long time ago, so I’m not sure why I received one? Unless I read wrong. I am just as confused. I wish everyone followed the exact same guidelines but just like everything else in this process - its completely willy nilly and up to whoever you may come across that day

  3. There is another forum where a girl did it successfully in BC. Just took awhile and some calls to higher up at the border. She had her marriage certificate and the officer called to see if the marriage was still on and she crossed. Like another poster said and I also believe truly it’s up to the CBP officer at the time. I guess at blue water bridge some of them are fine with it. 

    I also find it strange you crossed in Dec with no paper I-94 given to you, but I crossed jan and I was given one. Mine also says “multiple” on the bottom, don’t know if that means anything.

While that is correct (assuming the CBP allows to you come in the second time), you will no longer be in K-1 status. Hence, you can't AOS, at least not without a I-130 as spouse of US citizen anyway, and there will be all sort of issues. The best course of action is to get married as planned, file AOS along with EAD and AP, wait until AP is approved then you can travel all you want. 

     

    People also often get confused about the marriage requirement. All you need is the paperwork, takes a day or two at the local county office. You don't have to have a big wedding, or any wedding at all. Just get legally marriage and file AOS to satisfy the legal requirements and start the clock. The wedding can be later down the road.

  6. I’ve always heard that K1 is a one time entry visa and if you leave you can’t be readmitted to the US unless you do all sorts of paperwork.

    I crossed at Blue Water Bridge in Sarnia, ON a month ago. When I went into the office the border patrol officer told me I’m allowed to come in and out to and from canada as many times as I want, as long as I get married within 90 days and once I’m married that’s it- I can’t cross back anymore. 

    I asked if he was completely sure because I’ve never heard that before and he said yes. 

    Has anyone else heard of this? I called US border patrol or whatever today and the man on the phone was quite rude telling me about adjustment of status after marriage etc which I UNDERSTAND but we’re not married yet, to which his response was “well if that’s what he told you then it’s true”

    anyone have insight on this?

    Ours has been rescheduled from Wednesday to Friday. They sent two emails, one was the notice that it had been rescheduled and the other was an appointment confirmation with the new date and time. 

    This is insanity. Mines also Friday. I never got the second email but figured out how to find out what my new time was.

I’m at commissionaires right now and the woman explained what happened was that the US went against RCMP best practice and that you should and need to get both the certified and non certified but I won’t  need the regular police check. She knew exactly what I was talking about when I mentioned it

  9. I just stumbled across this forum, I am a k1 visa applicant.

    what exactly did you guys ask for when you went to get this done? I read this whole forum and am still a bit confused. 

     

     

    Am I asking for both certified (for visa/immigration purposes) and non certified criminal background checks under the privacy act with the RCMP? 

    I don’t mind paying the extra I assume as a k1 it might be easier cause we just bring everything with us id rather be overly prepared.

    Get the Canadian K1 P3 letter at http://photos.state.gov/libraries/canada/303578/montreal/Packet3-K1-MTL.pdf as this is your bible needed to complete and receive your visa. The required documents are included and use the P3 as a check list. Once you have completed or gathered the required documents you'll be ready for your interview. If it is not on the Embassy letter, it probably is not needed.

     

    Last but not least, READ the pages on the US Embassy website for you country so that you are up to speed.

    You can't hurry it along at all. You have to wait for P3 which takes 2-4 weeks from Ready. Comply with what they ask for in P3 (the actually one they send you) by sending them a copy of the signed P3 checklist, your DS160 confirmation and your Passport Bio. Then they send you P4. Then they tell you to register to schedule and you'll wait some more for interviews to open up, which only happens once a month during the last week of the month for two months ahead UNLESS you are lucky and you scoop up a cancellation. Get your medical appointment first so you can schedule the interview shortly afterwards.
