  1. Hi all, just... confused about how to file. 

     

    My wife came on a K-1 and we married in May 2019 (which is reflected on my W2). Until then, she was working in Canada, and has no US income for 2019. 

     

    If I understand correctly...

     

    1. she is considered a dual status resident alien despite not having her green card yet, and we should file MFJ

    2. she doesn't need an ITIN, as she has an SSN

    3. she does need to provide her 2019 Canadian tax forms, although she would not owe taxes on them

     

    Do I have all this right? 🤔

     

     

  2. Just received my wife's EAD/Advance Parole (she's on a K1 AOS waiting for her green card) and would like to schedule travel for the holidays so she can see her family. 

     

    For those with NEXUS, does that affect the process at all? Do we follow the normal NEXUS procedure and then the officer will send her to secondary screening, or would this let us bypass it entirely? 

  3. Found by searching passport - so now we get

     

    "SAVE has returned your case to Maryland - Social Security Administration, SSA (Single Signon).

    What Do I Do Next?

    Please contact  Maryland - Social Security Administration, SSA (Single Signon) to get more information about your case status."

     

    It doesn't say "Case closed," so I can't tell if this is good or bad 😕

So.. fiancee went in, apparently clerk did not say there was any problem finding her, but either way they made copies of her documents, and she got a letter stating up to 4 weeks to verify authenticity of her documents. So.. confused; it sounds like they did find her in SAVE, yet we have to go through manual verification? 

  5. Landed 3/29 (3 weeks ago) - fiancee is going in to apply for her SSN status, as we're getting married on May 10. 

     

    However, when I look her up in SAVE using her I-94, it simply says "No cases found that match the search criteria" - does this mean they will not be able to find her when she applies?  Should we wait until I can find her in SAVE?

    I also can't find her using her Alien number (assuming it's the Beneficiary A number on her NOA). 

     

     

  6. Updates:
    We drove a U-Haul from Vancouver through Peace Arch a few days ago. :) Our experience: 

     

    We got to the border at 5am or so. Google Maps got us lost - refer to the signs to get to the crossing.

    At the first gate, we were directed to park in a separate area and go into the lobby for processing.

    They asked what we do for work, where we're going to live, etc, and took both our passports. 

    We had our cat with us; immigration glanced at her but didn't ask for any paperwork or ask questions about her. We did have her vaccination paperwork just in case. 

    They did take a quick look at our manifest (I had listed boxes with a couple of example items per box, such as "Kitchen 1 - utensils, plates" "Living room - Video games, books"). 

    They also looked in the back of our U-Haul for a few minutes while we waited in the lobby.

     

    No one else was there and we were in and out in ~30 minutes.

    How did you have it delivered?

    We had the expedited delivery and picked it up from our local post office.

     

    The tear isn't *that* big (there's no way you could pull anything out or even read anything that's in there), and from everything I've been told we should be fine... I"m just paranoid haha! I think so many of us are...

    Just about a month ahead of you.  Crossed on Feb 16th got married on Feb 22nd and got my SSN on the 22nd.  Had applied on the 19th for my SSN but all the info was not in the system yet.  Also got my drivers licence two days ago and waiting for the actual marriage cert. any day now so that we can send in the AOS and all the other forms to be able to work and travel!!  

    I wonder why we would be different, but our lawyer said that SSN is not necessary for marriage, and that she would actually get it with her EAD? (which we're filing for with the AOS)

    So she won't actually have an SSN for months... 

  9. Our approved K1 passport is en route, so we are now trying to plan our wedding (and the continued mountain of paperwork..) for early May.

     

    We intend to wait the 2 weeks after landing and then file for her SSN, but I was wondering if we need to have the SSN in hand for the wedding? My understanding is no, but that it may cause difficulties in the future? Right now we're thinking we could apply on April 15, so she would get her SSN before the end of the month. Just want to know how careful we need to be about this. 

  10. Also, we were changed to "Administrative Processing" already, but that's normal... right?

  11. While I'm thinking about it.. the clerk  (the one that collects your paperwork before you're printed) wrote "Missing Documents" and sent my fiancee to get a photocopy of one of her documents. Is this going to be a problem?

     

    She wasn't actually missing any documents, but had a slight mix-up that the sadist of a clerk refused to let her check. The only thing she was missing was a photocopy. The interview itself was extremely quick and she was approved...

    Your lawyer is making it more complicated than it needs to be. 

    Thanks - hearing all this does help. I was originally just going to provide two months, but I'm going to go ahead and give her six (along with my returns) and a couple other things just in case. Do we hand these all in together, or will they specifically ask for proof of domicile during the interview?

    Like NikLR said, pay stubs (that you need for the I-134) are proof that the USC resides in the US.

    Our Packet 3 referred us to the generic checklist (https://ca.usembassy.gov/wp-content/uploads/sites/27/2016/07/Packet3Instructions-K1.pdf).

     

    I do have an immigration lawyer I'm using for this process, and they recommended quite a few documents (in particular the utility bills). So far my experience with them is that they err on the side of caution. My I-129f does show my address and employer history, so I'm hoping they won't even ask for it? 

     

    We currently have our paperwork divided into Petitioner, Beneficiary, Evidence of Relationship, and then Proof of Domicile, so I'm guessing we don't even have to give them the Domicile stuff unless they ask for it?

  14. For those who have had or are about to have their K1 interview, was wondering what you were doing for Proof of Domicile in the US.

     

    Are you just including it in your packet, or is it something they request during the interview portion itself?

     

    I currently reside in the US, but I'm at a bit of a loss as far as 'proof' since my lawyer is asking if I have utility bills. I have my mobile phone bill, credit card bills, my tax returns, pay stubs, a recent car purchase, my banking account, California Real ID, etc. all with my current US address.. should I be concerned that this is not enough? I currently don't pay for any utilities like water/power or anything like that. 

     

  15. Went ahead and got the photos redone. Thanks all. :)  Now I'm just gathering together the mountain of paperwork..

    Is there anything to do near the Embassy? Her appointment is at 730 so she's gonna have quite a few hours before her flight back...
