    Find a place where you can get audio transcription . You can’t submit video but you can show the video to someone and the person can give you an affidavit stating what he/she watched,notarized affidavit with name place and date of birth phone number and address.When and where this person met you etc.

    I would honestly suggest to do the medical once you receive the update that your interview has been scheduled. I suggest you get all vaccines that you may still need from your primary care physician beforehand, so that your insurance covers it and then just go to the medical for the few tests that are necessary. If your local office takes a long time, you don’t want your medical to expire.

    USCIS does not view having a child together as proof of anything. To them, having a child together only means that two people had sex. Nothing more. It cannot be used as proof of living together or good faith marriage.

    Hanna  just who lived or live with the spouse qualifies to file VAWA, and second her she never lived  with him.You lived 20 days with your spouse then  you qualified to file VAWA.

    I had contact with Congress office, not Ombusman. I wrote a letter t to Congress office about my issue of out proccessing timeline. They replied that Vermont have pproved my case and they will send a notice about 30 days. I am waiting the notice coming.
    Congressman and Senator will help a lot.
    Donot hestate to contact them. Best of luck.

    Well there is no need to inquire if you are still within processing times because all that USCIS will tell you is exactly that. 
     
    You are currently considered outside of normal processing times for I-360 if you filed on or before March 15, 2017.

    Steps you can take (after being outside of normal processing times) in below order:
     
    -InfoPass appointment
    -Online inquiry
    -Write a letter to VSC
    -Inquire with your congressman
    -Inquire with your senator
    -Inquire with the ombudsman
     
    (If you filed I-360 after March 15, 2017 you are considered within normal processing times and that is all the information anyone will get from USCIS about your VAWA case)

    Sounds like he is a family law attorney then, not an immigration attorney. 
    Are you sure he prepared your VAWA petition correctly and with all the evidence needed?? This is concerning. USCIS does not send RFE’s anymore for newly filed cases, so you have to be confident that you have everything that’s needed.

    Hi all,I received an email this morning that said we have taken action on your case.I logged on to uscis website and It said we have ordered your new card and from this forum I learned this means my vawa is approved.I am so happy already.Filed vawa June 29 17

    You only contact the ombudsman man after you are already out of processing times and after you contacted your senator or congressman, made in infopass etc. 
    the ombudsman form asks you to submit proof that you went through all these steps already as the ombudsman is supposed to be your last resort after you have tried every other step possible.

    After USCIS received your package, they can request you more evidences for example birth certificate, devorce certificate if you didn't submitted with the package. It is request for intitial evidences. But after USCIS has reviewed your case and they ask you to submit more evidences like moral character, residence... It is REF. 
    It is my understanding after filling my vawa. 
    Pls ask more Sandra if you need something better for your case.

    3 months and about 24/6 days, October 24 would have been 4 months, my interview notice was dated October 20th. Whether its 3 months, (you can round it off to 4 months) I am just elated my journey seems to finally be coming to an end. I am happy I didn't have to wait another year or more for the interview.

    Yes. Make sure that you need to bring new medical to interview appoiment. Donot forget it, because it can delay your AOS approval.

    Uscis will not issue RFE(new cases) anymore asking documents such as police clearance ,copy of birth certificate,copy of marriage certificate etc, if the person failed to submit mandatory documents USCIS will deny the case without issuing RFE.  USCIS will continue issuing RFE if they need more evidences of abuse /bonafide marriage.

    - Make sure to have an updated medical for you and your children (less than 1 year ago). 
    - Go through the I-485 form that was filed and make a sheet of all changes that have occured since filing (I.e. updated addresses, employment history, marital status, etc.). 
    - Answer the IO’s questions briefly, don’t say things you aren’t being asked. Stay short and precise in your answers.
    - Tell the truth as you are under oath. 
    - Bring originals for all copies that you submitted to USCIS (I.e. marriage certificate, divorce decree, your birth certificate, etc.)
    - Bring a valid ID (passport or driver’s license, birth certificate for kids I assume)
    - I suggest to bring all original notices and documents that USCIS has ever sent to you. 
     
    The IO will go through form I-485 with you and also ask the yes/no questions. Respond truthfully always but be short. Don’t interrupt the IO. If you would like to hand them a document or say something, ask for permission.

    Hi Everyone! After 8 months of approved I-360 (March 2018), my kids and I finally received a letter for AOS interview!!! Thank God! 😀 I'm excited and nervous at the same time... nervous because I don't know much of what to expect in the interview. As I have read, is it really just formality with questions asked based on the I-485 application? how should I prepare for the interview? I hope you could give me an advise on the preparation because I have decided to just attend the interview with my two minor kids and opted out the offered services of a lawyer due to budget concerns. The interview is just a week away and I have been doing my research and prepare myself for the interview. I would gladly appreciate your input and advise. I would post on an update as well after we go through the interview and share our experience. Good luck to all of us and thanks in advance. 😊

    For initial rfe, they check to see if you meet all requirements by submitting the required evidence, if not, they ask you for it immediately after they review your file for the first time for completeness. In  about 15 -16months, when they open the case to make a decision, for example, when an officer is not satisfied with your proof of bonafide marriage evidence on file, then he or she sends out requests for additional evidence to prove bonafide marriage before a decision can be made, it is also called rfe but they specify the  word "additional" meaning what you submitted was not enough, in this case, you will have to respond with new documents that you did not submit before.

    I think the best way is you should submit a notarized letter to Vermont to ask about your case outside normal processing times.
    I had made 3 times of inforpass but i got useful nothing. 
    You can ask congress office to support you on your representative. I did it, very helpful.

    Sounds like this would have been an initial RFE. 
    USCIS is currently working on June/July 2017. They are taking at least 16 months to adjudicate your petition, so you won’t hear until at least March 2019. 
    This was an initial RFE, which is different. Regular processing times still apply. The 60 day rule is for RFE’s that are issued when they adjudicate the petition, not when they initally look over it.

    No I never sent I-693 because I knew the wait would be more than a year. I only brought it to the interview.

    Please don’t give out false information. The I-485 interview has nothing to do with the abuse/VAWA. They aren’t even allowed to ask about the abuse. It is just a standard interview that goes over the questions on the I-485 form. It is not dependent on the evidence submitted for I-360. 
    As Sandra stated previously. In her 20 years of filing VAWA petitions she has only ever seen 4 people not get an interview out of the thousands of people she has helped.

    I filed/renewed hundreds  of EAD, believe me I know the immigration Law very well, and the USCIS website clearly states to submit a copy of the l797, and the PAYMENT OF THE APPROPRIATE FILING FEE.

    This is not an official government website. Please be careful and don’t trust things on websites that don’t end in .gov
