    but one man was told he was approved and given the Welcome to the US letter and then 6 months later his USC got notice that the visa was denied

    read and read and read the posts on the portal site for morocco and remember when people quit posting or keeping up a timeline,  usually they got bad news

    everyone seems to share good news

    yes maybe could be in AP, each case is not the same of others my case is different jeanneadil , the man you said that got denied maybe they found out something in security or background checks, so like i said each case is different....

    so,  if her job lacks stability like a good solid education to back it. ( and previous work history in a chosen field)  they will not depend on the sponsor to support them or him to work in the US if he lacks education himself

    and Casa can and has denied multiple times

    so why they have not denied yet, of course no reason to deny if any reason to deny they would have done it before instead keeping the case in the consulate with 3 interviews also USCIS review reasons for deny at the end of my 3rd interview they told me i do not need to provide no documents and that they have everything , income requirements are met with qualified two joint sponsors.....

    when he submitted that proof they needed proof of the income as she had to have work

    she has not been working here long so i would think (just a guess) that they are doing the necessary AP to decide if her job is adequate and long lasting 

     

    not a big age problem anymore in Morocco / they are seeing this gap a lot 

    she is still age bearing and only had a cyst removed / i apologise as this is very

    painful and not just a cyst as i say but it did not affect ability to have more children

     

    Abdo:

    you will just have to wait and see if the embassy accepts her income as adequate and none of us here can tell you if they will or won't

    just don't give up but maybe give it another year of US work to satisfy the income.

     

     

    thank you jeanneadil, we will never give up it was so hard leaving each other after living 5 years with each other we looking forward to be together again, also do not forget we have join sponsors that makes 100 thousands a year, they accepted it as my sponsors, also my wife is working too, we just have to wait to see what is their decision...

    What did you say?  Was this a US wife?  How long since your divorce was final?  Have you applied for US immigration or tourist visas before?  What was the outcome of these applications, if any?  Have you ever put married on a US visa application form when you were single, or single when you were married?  Seems strange to have three interviews, we rarely see that even in high fraud countries like yours.  If there's more to your story, sharing some of it might help us give you better advice as to what might be going on here.  There could be scrutiny because of the age difference, but since you lived together for so many years they may be focusing on something else that is making them question your relationship.

    i got divorced 2015 jan divorce was provided to consulate , it was not from us wife, i never applied for us immigration before this is my first time, also i got married with my current wife on her second time visit, after that she stayed with me for almost 5 years in morocco i did a resident for her so she can be allowed to stay , i only traveled to qatar for work and it only was for one month and came back to morocco that was on 2013 i think, i never was arrested before all my background is clean i provided criminal record from court and from police station all clean, they did not ask too much about my wife, but they asked more about my ex....what do you think ?

    me and wife lived almost 5 years in morocco since 2015 to 2019 june, we got lots of proofs and evidences together she even has moroccan id as a resident, now she is back and working in usa after they required domicile , we sent everything to them it was accepted, plus they have two join sponsors they accepted them plus my wife is working and already have domicile so i am done with documents no  large age difference

    they only asked me same questions that immigration officers asked me before, normal questions it was for maybe 20 to 30 mnts thats it, so i do not know why no decision yet or maybe background check can you tell me what is background check ?

  7. hi guys my visa category IR1 my case never returned, first interview  was march 2019 , second was on august 2019, 3rd interview was on NOV 2019 with two moroccan men, at the end of interview they told me i would receive a decision in next couple days, they kept my passport since SEP 2019 , they have everything they need , but still have not heard from them yet ? any ideas thank you.

    No way to know. The only ones who know would be the consulate. Keep an eye on your case status. Could be approved, could be denied, could be AP again, no possible way to know until the consulate themselves give you a solid answer

    i had 3rd interview two weeks ago, my case never returned, they told me they would send me a decision in couple days also they kept my passport

    Do not attempt to file a mandamus on your own.  Unless you are very versed in legal garb and have some knowledge of law.  If you can't afford a lawyer you can contact catholic charities they connect you with someone who may be able to help.  Many have helped others with immigration including mandamuses in the past.  

     

    I would not recommend filing if you AP is under 6 months.   Some attorneys have even recommended a year.  I have never seen a case returned due to background checks not being complete but they could return the case due to not enough evidence of bonafide relationship which is like catch all if no evidence is actually found.  

     

    I have seen a handful of successful mandamus cases on facebook. Most have used Hacking Law.  I'm not really sold on filing one as of yet between the cost and the probability of the case being completed soon anyway I'm not sure if I want to risk it.  We are in the process of planning our next trip I would like to use the funds for our vacation instead.

     

    Administrative Processing is absolute torture no-one here can really give good advice and are not very helpful especially if they have never been through it.   We have our good days and bad.   I just keep praying that through this the government will then have everything they need to prevent any issues in the future and they will have all the assurity they need to see my husband is everything I already know he is.   

     

    thank you for your helpful information i am on AP 8 months now, let me tell you my story so you can understand my situation , we got married on second time of her visit on 2015 my wife started living with me from 2015 to 2019 in Morocco never go back to USA, my first interview was on march 2019 case was put on AP because of my wife domicile my wife had to go back to USA to resume her domicile on june 2019, she got a job established her domicile my wife sent me all evidences for her domicile documents were sent to Consulate and accepted , they called me for second interview at end consular officer asked me for new joint sponsor, my current one makes 70000 a year he is LPR, i do not know why he requested another joint sponsor when i already have qualified one, anyway we found another joint sponsor who is US citizen qualified its her cousin, i sent all required documents for the new joint sponsor, proof of citizenship, pay stubs of 2019, tax 2018, W2s, drive license and affidavit of support to the consulate on september 2019, the consulate called me october 16 2019, asking if my wife is in morocco i said no my wife is in the US working,  because the consular officer wants to speak to her to make a decision on our case, the lady asked me for phone number i gave it to her but they have not called my wife yet a few weeks later i sent a letter to US consulate via aramex it has my wife work schedules still no call i emailed them they said the case now is on review and that they received all information and that they will contact me to finish visa processing case also they kept my passport, but have not heard from them yet..also my medical expired 14 sep 2019, my question if he wants to speak to my wife to make decision is that mean the case is complete and ready to make decision ? and how long the review takes i understand review is part of AP...

    I do know you can not use the Moroccan sims card and phone number here so by giving the CO who called the US # ,  they have verified her residency requirement

    BTW you are only going thru this for under 2 years /  i was 6 years to get the visa and i lived in US,  made 5 trips over a month each and had enough income to satisfy the AOS.

    You sent the chats, but did you get a new cosponsor as they rejected the LPR

    yes i sent the new joint sponsor who is US citizen, because they rejected the LPR one, yes maybe just to verify a US Phone number, but i know for sure they already have this info when i sent proof of domicile last july 2019, she already domiciled and have a job, bank account, drive license,voting card and letter, phone bill,gym so on.....they have everything now. also they kept my passport..

    my wife already got a job they already have job offer documents plus bank statements , so they have joint sponsor, plus my wife is working they have all required documents now.... what confused me the lasy from consulate called me she said consular officer wants to speak to my wife on the phone cause he wants to make decision what is that mean ? they told me this 16 october 2019 on the phone ....i provided phone number but no call

    A Writ of Mandamus is not do-it-yourself.  Filing a lawsuit against the US Government in federal court is not a do-it-yourself task.  You need to be able to cite specific laws, etc.  There is no practical way to sue the US Government in federal court without a competent lawyer.  

    It seems like you have problems meeting the I-864 requirements.  The fact that your first JS was rejected and you were asked for a second JS is a  red flag.  

    Additionally, you stated that they asked for a second JS in March 2019.  You said you lived with your wife until June 2019.  It seems there may be a domicile issue also.

    Instead of trying to sue the US Government, you might want to get someone to review your case.  Seems like there are things that are being missed.

    my first join sponsor makes 70000 a year he is LPR from arabic country, so consular officer in my second interview he said he does not find him sufficiant, so i sent him another join sponsor who is US citizen qualified it seemed they accepted him following our telephone conversation with consulate are ready to make decision, they called me on 16 october they said that the consular wanted to speak to my wife on the phone because he wants to make decision so i gave the lady my wife phone number in the US but he never called my wife been waiting for the call nothing yet i got the following messages below and tell me what do you think ?

    You do realize this will take time to go thru the court system AND could result in the embassy giving you a decision NOT IN YOUR FAVOR

     

    they asked for your chats from 2014 and 2015 / they are allowed to ask for anything that reinforces your claim of when you met and started this relationship   The Casa embassy just sent a case (after the case was reaffirmed by USCIS a year ago) back to the USCIS for a IR1 when they could not produce any of the chat history for 2013 that was claimed as meeting by the 2 involved.  Basically you have to be able to prove what was stated in the application about meeting and chatting.

     

    Get that chat history and prove what you need to prove to the embassy

I used to think that filing a writ was a waste of money, but over the past year I've seen at least 5 cases (in Casablanca) where a visa was issued after a writ was filed. All of them used the same firm, Hacking Law.
