- Uploaded the i864A for js's spouse and her docs in js's Additional AOS support documentation
- In js's i864: Part 5: Household size has included his married spouse.
- In Part 6 "Income you are using from any other person who was counted in your household size": js's spouse was put down as Person 1 with current income
Did you submit the I-864a under the tab "add household member"? It looks like you added this file under the "joint sponsor" tab which is incorrect.

That is true. Travel history is important if you travelled frequently before without trouble then they probably take things easier. Also, our lawyer told us he can mention (if asked) his visa application is consular processing and therefore, he must leave the country for the interview and completing the visa application.

Sorry if this is a bit long winded...Quick background - we just sent off the petition for my Canadian Husband last week, so we just started the process.
My husband was recently laid off due to restructuring of his company. He's in the process of looking for work, but the economy isn't great where he is so it might take a while. In the meantime, he is planning on applying for EI (employment insurance) on the 28th when his current job ends. He called EI and since it can take up to a month to process (and he won't be able to visit ones he's on it), he decided he is going to fly down to visit me for 2-4 weeks. EI said this would be fine, as long as he's back once it gets processed and he starts getting EI money.
Now my worry is, without a job, what should he bring with him as proof that he's going back to Canada? He is going to bring his mortgage & car finance paperwork down to show he has monetary ties to the country. He also has some important medical appointments booked for this summer in Canada. And he has plenty of money in savings to support his trip down here.
I don't know how to prove that he last to continue to stay in Canada in order to receive payments from EI while he looks for work. We only just sent off the I-130 petition, so we have a long wait ahead of us still. Any suggestions on what he can bring with him to prove ties to Canada?
And a side note, does this qualify us to request an expedite for his financial hardship? I know they're hard to get, just wondering if it's worth trying.
Thanks for any advice!My husband crossed the Canadian border (airport) two weeks ago for a 3 day trip and the officer at the border did not ask him a single question! I was so worried that they get picky about his trip and he had his house and car papers as well as a letter drafted by our lawyer. However, none of these came to use! So, I think you shouldn't worry so much. It will be fine.

But I think you should still submit the online inquiry despite what they told you over the phone. Maybe they take that more seriously and look more in depth into your case.
I think it was here at visajourney that I read someone had submitted a document that was showing on his CEAC but not on the NVC side...something like that....maybe your situation is something similar!

My co-sponsor has a family size of 4 (including my husband) and she made 90 ~95k on average for the past three years. Maybe showing continuity in income could be a deciding factor. For instance, the form asks only for the past year's tax transcript but I decided to include everything for the past three years.

The ones he did in his childhood he does not have any record of. Yes, a pharmacist told me he can do a blood titer for those vaccines and it will show if he had those vaccinations and he won't need to repeat.

I submitted a joint sponsor and your case will be on hold until you submit the joint sponsor even though the tone of the message is as if the decision is in the hand of immigration officer at the interview.

My husband does not have his immunization records but we know he has received all the required vaccinations. What should we take for the medical exam if don't have the immunization records?

If you at least have your case number from uscis through noa1 - you can also contact nvc with that. If you don't, if I were you I would also demand all written correspondence came from USCIS to be sent to you as well, as they don't need it and you should at least get the copies.
Exactly, the lawyer does not have the right to keep these info from you. Your lawyer is clearly abusing your lack of knowledge about client-attorney rights. He may also be hiding some of his mistakes in document submission that could delay your case. Become proactive and demand your case info so you can follow up the updates yourself.

We got married in SC and we have a piece of A4 paper where we went to an office to record our marriage. On our wedding day, we had a marriage officiant who got our signature and later on, we received a certificate with a seal stamp that we present as our marriage certificate.

My case was also got documentarily qualified today! So as a reference for others, I only submitted I-864 for the joint sponsor and included the tax transcripts and W-2s for the past 3 years as well as her pay stubs for the past three months. We did not submit I-864a even though she filed her taxes as "married filing jointly" because her income alone was enough.

Yes but they have to cancel the consular processing and always risk not being admitted because of misleading the US immigration. Also, they can always do that with a visitor visa why should they bother with a TN.

That is ridiculous. You need to ask for the case ID and invoice ID and login online to your NVC account and see what is happening. I don't think the lawyer has the right to keep these information away from you. I wonder why you don't have an email address on file so you will also be contacted for any case updates.

I didn't know anything about AP. I thought the approval at the interview is the final step and there is no reviewing process after that!

I personally have not tried this however TN visa requires nonimmigrant intent. That would be a little difficult during the IR1/CR1 process.
True but at the same time, the applicant must leave the US for interview at the consulate and there is no way he can turn his work stay in the US to immigration based stay.

What is administrative processing? I thought after document submission we get a "case complete" notice and then interview schedule.

Congrats! I know how painful the wait is :)!!! Did they ask you for I-864a? As I said in the other post, I did not submit I-864a since this form is only needed if the joint sponsor income alone is not sufficient. If they asked for it then, I guess you should take the signed forms (and other documents) with you to the interview in case the officer gets picky about that!.

No, I decided not to submit I-864a even though I gathered all the documents and I was ready to submit them. According to the instruction on USCIS website on multiple places, the I-864a is only needed if the joint sponsor's income is not sufficient then I-864a form can be added to increase the overall income. So, I decided to think logically instead of staying on the super-cautious side and just hope the immigration officer who is reviewing my files knows his stuff.

I am sorry for all the trouble that you have to go through but why do you say it was not listed anywhere about the police certificate? The instructions for DS-260 clearly states you need police certificates for any country you lived in since age of 16 I believe.
