  1. There is no way to speed up an application for EAD.... sorry to say you will just have to wait for approval... sounds like a good job too..

    that's what i was afraid of, but i guess it's ok and there is really no need to worry or cry over it, eventhough 50k would really be nice especially for doing something i really enjoy and not having to drive to work. I have faith that if this one does not work out (i pray it does), then something else will come up.

  2. I have a question, and I know a lot are going to be saying "yeah, us too".

    but today I went for a job interview as a programmer and I really had to no clue how much the position pays but I assumed since it is in WV, that it would be something around 30k a year. The guy asked me what would my ideal pay rate be and what i would be ok with, so i told him my ideal would be 40k and i would be ok with 35k so he told me that the position pays 50k and i had a huge smile on my face that i could not hide and then he told me that i guess this would be more than ok for you then.

    the person conducting the interview asked me about my work status in the U.S. and i told him that i filed my paperwork for AOS and EAD at the end of december and that I should be getting my card in 3 months from the date of filing.

    I actually made all my paperword in december with a NOA date december 29th but i got an RFE and mailed it back to them and when i tracked it via USPS it says that they received it on January 22nd but it still did not update on the USCIS website.

    My question is, is there a way to expedite receiving the EAD document, cause the person that is interviewing me said that he needs that before he can continue evaluating my job application, and he said they can wait a month or so but i am worried that they might offer the job to someone else before i get my EAD.

    I know that if you receive an RFE, then you can get an Intern EAD from the date they receive the requested documents back from you.

    can i call USCIS and tell them my condition, and would they be able to do anything to help me?? and if so, should i call my local office or the chicago office??

    has anybody been in a smilar situation and what have you done.

    I pray to God it works out because the pay is really good and the position is down the street from my house so i would be able to walk down to it.

  3. If I find someone to Co-sponsor my fiancee to come and marry me on a K1 visa do they have to meet the poverty guideline on thier own or is thier income added with my own? Since I was wondering if we both made 15000 each wouldnt' that equal 30000 and easily exceed the poverty guideline?

  4. A little background on us...dh is here from France on a student visa. We met here and got married. We applied for AOS and employment authorization and USCIS received his application on November 6, 2006. He received notices this week of his biometrics appointments for the AOS and employment authrization to take place February 3rd and February 6th. So I'm wondering...

    1. What happens after he gets the biometrics done for the employment authorization, and how long is it likely to take?

    2. What is the next step after biometrics for the AOS, and how long is it likely to take?

    3. What happens at the AOS interview?

    4. What questions do they ask?

    5. What information do they ask for?

    6. Is there anything else we might need to know?

    I know these things have probably been asked many times over, but we would REALLY appreciate all the advice and opinions we can get so we can prepare ourselves as best as possible.

    I am surprised he has two biometrics appointments. I am also here on a student visa and filed for AOS and employment authorization and I only had to do one biometrics which is used for both of them.

    maybe when he goes to his first biometrics, he can bring it to their attention there that he is scheduled to have another one and see what they say.

    as for answering your questions:

    1) there is really no definite time for the employment card, but most likely 3 months at the latest

    2)after biometrics, you have to wait for them to send you a letter about your interview. this could take from 3 months and up, depending on your luck.

    3)at the AOS interview, they look at your file, ask you few questions, ask you to show proof of cohabitation and then tell you whether you were approved or not.

    4)questions such as when and where have you met, when and where was the wedding, who was present, have you ever met his parents, has he met your parents, and they ask for pictures of the wedding, old pictures, common utility bills, common lease and such...

    5)check number 4)

    6)you need to know how to be patient, and if not to panic if they send you a letter (referred to as RFE) asking you to submit additional paperwork even though you had already submitted them, alot of people had to do that.

    VERY IMPORTANT: if you ever get an interview letter, and then later on they send you a letter stating that your interview was cancelled, you should still need to go to the interview eventhough they say it was cancelled, alot of people received a letter saying that their interview was cancelled, so they did not show up and their application was cancelled.

  6. Wow that is crazy. I would try to look up the person it was supposed to go to and give them a call. If it is their’s then send it to them. It is illegal to open it but maybe you could make an info pass and go open it in front of them?

    What makes you say it is illegal? Who knows maybe the correct green card was inside...we will never know now?

    it is a federal crime to open mail that is not addressed to you, even if it was received at your home.

  7. The only person I know which may could co-sponser for me is my sister, how can I convince her to do it? When she signs the forms what is she agreeing to do? Is she accepting the responsiblility to care for that person the rest of her life or just until she becomes a USA citizen? I need some way to be able to convince her that this won't cause a problem for her later on. Please help me someone!

    you really want to get a joint sponsor who is not gonna give you a hard time cause you are gonna need some papers from him/her.

    the responsibilities of the co-sponsor are the same as the responsibilities of the main sponsor which is you.

    both will be financially responsible for the sponsored person and this will be till he/she gets U.S. citizenship or till the aplication is dropped (denied or he/she leaves the country). please note that the responsibility of the sponsor will not go in case of a divorce.

    The main idea is that the sponsored person will not go on means tested benefits (such as welfare and others) before he/she becomes a citizen and if the sponsored does end up on welfare, you guys are financially liable to pay it back.

  8. That really suck and I can imagine your disappointment.

    What I would do if I were you is actually try calling the person to whom the letter was addressed and indicate to them that you have received a letter intended for them and check if they received yours. tell them that you would be mailing it to them (and please do so) and ask them to be kind enough to call you (give them your number) and mail you your grenncard if they received it or do receive it in the future.

    the only bad thing about this is that it is gonna delay processing your file until you mail them back what they are asking for.

    now do not be alerted for this is a normal thing and a lot of people are required to submit additional evidence and it usually is either something you forgot to include or something that you already included but they did not notice it and in that case you would send it again.

    i know, i should have listened to you. i was talking to a buddy of mine and he said that if i show up to court and either plead guilty or no contest, the judge might lower the fee. now, he didn't know if i should say "no contest" or "guilty" but i am assuming that i would have to say no contest.

    now my question is that would i have to pay court fees for that? and would that look bad on my driving record if i go to court, i know that a speeding ticket already looks bad on my driving record but i am wondering if going to court to contest would look worse

  13. so today i had my biometrics' appointment in pittsburgh, so i got up early in the morning (4:30am), showered and got ready and I was on the road by 5:00am heading towards pittsburgh which is an hour and a half away but i wanted to escape the morning traffic there. i left my apartment in morgantown, and i hadn't driven half a mile when a cop pulled me over. license and registration, and then asked me if i knew what the speed limit was, and i told him that i thought it was 45 and he said it was 35 and he got me on his radar driving at 50. he went to his car and came back with a ticket and told me that i need to drive slow because there might be ice on the road. well, all the roads where clear, so i took my ticket and went on my way. the biometrics appointment went well and was quick, but throughout my whole trip i was worrying about my speeding ticket and wondering how much it was. so when i came back home, i called the number on the ticket and they told me that it was $137. for you people that read my post few days ago about driving to pittsburgh, you would recall people giving me an advise to stay in a hotel in pittsburgh in order to avoid traffic and all and i told them that i didn't want to do that because i did not want to pay for a hotel room since i cannot afford it. well i guess for $137 (price of my speeding ticket) i could have stayed at a very nice hotel in pittsburgh.

    lesson i got from is the following: listen to people's advise.

  14. Hi everyone. OK I made a dumbass move and forgot to mail in the second page of my I-130. So they returned it with a blue page/letter that said it (application) was incomplete. On the letter, they said, "the original petition/application must be filed out completely in order to adjudicate your case." So now to my question... are they asking me to send in the original forms completed? Or to just complete the original and mail in the copy? What I got from the visajourney guide is that I can mail in copies; so I mailed in copies, though they were incomplete. So copies or originals?

    You need to mail the originals of any application forms that you submit to USCIS, basically for any pdf that you downloaded from their website and filled up you need to mail the originals, make a copies of those retain those COPIES to yourself.

    as for other forms that you are submitting (forms that belong to you), for example marriage licence, birth certificate and such you would make a copy of those and mail the COPIES and keep the originals to yourself

    Don't stress until you get the RFE. Good luck for a speedy approval after you return the RFE material.

    I sure wish I knew why they email so many times. I received multiple emails from them everytime too.

  16. well, i was taking a nap this afternoon and my cell phone kept on ringing indicating I have received an email ( i receive my emails on my cell phone), the only problem is that it must have rang over 5 times. i got up from my nap and realized i was late for an apointment so i got in my car and started driving and i checked my cell phone and i saw some emails from some CRIS??? it didn't ring a bell so i started cussing spam email. then i hit me that this was USCIS, so my heart started beating fast, could be that i was transfered to CSC or is it an RFE, i sure hope it's not the latter. now, i am curious, but i was still on my to my apointment and i had deleted my emails from my cell phone. i just got back home and read my email and i saw that i received 8 emails (and still receiving) from USCIS and they are telling me that they sent me an RFE.

    damn them, 8 emails to tell me they are sending me an RFE and they do not even say what for??

    now all i can do is wait.

    PS....I just figured out that the famous actor whose Soundex code matches my husband's has been previously arrested for carrying fake passports as well as tax evasion. At airports.

    Oh Goody.

    I am not gonna worry about that because i have an arabic name (being from lebanon) and i know my first name and my last name will be red flagging right and left even though I personally have never done anything illegal here or overseas. I imagine that my name check is gonna be one of those that take a year or more to finish.

    I have said that in a previous post, but I have always told my parents that they should have named me a good old english name which have made my life easier.

    Well, the fact is it appears that indeed, a good many with arabic and hindi names get caught in the check. An understanding of this phonetic 'system' now explains, at least to me, why this happens.

    And for whatever its worth, my husband has a good old english name. Very english. So nothing is certain.

    Ok, maybe they should have given me a good old "French" name??

  19. sorry to disappoint you, but soundex is definitely not a system used by the FBI for name checks.

    Why would you say that?

    cause soundex is not a system, it is a function.

    example:

    SELECT SOUNDEX ('katy'), SOUNDEX ('katie');

    this would return a number specific to the pronunciation of katy and a number associated with the pronunciation of katie. in this case each would return "K300" which basically indicates that the two's pronunciation is close.

    Now soundex is not a system, it is just an algorithm that compares two strings and their associated characters to a pre-assigned values.

    Now, even though an FBI system might use this function in it, soundex would be a minute part of a system and is really unmentionable.

    i use soundex in almost every website that i design, and it really is not that big of a thing.

    I just wanted to make this clarification
