  1. hi all just wondering if anyone else was told at there Biometrics appointment that they will get there EAD card in a couple of weeks?? i don't recall reading that anywhere else on here. if you were also told this please respond thank you...

    I have read few people on here saying that they were told at their biometrics appointment that they will receive the EAD card in a couple of weeks but i think it came down to that the people at the biometrics did not know what they were talking about.

    after all, the EAD is not issued by your local district office were you get the biometrics but it is issued by the Natioanl Benefits Center.

    so just ignore what they told u there, it usually takes between 60 to 90 days to get the EAD from the time you filed for it.

  2. Well, I thought everything was going smoothly until I cross referenced the adress given on our Biometric appointment letter and the adress listed on the USCIS website. Could there be 2 different locations? One for Biometrics and one for the interview?

    Yes there are two offices in pittsburgh, one for the interview and one for the biometrics.

    You need to follow the address given to you on your biometrics letter.

    My biometrics letter stated that i had to go to the one on 800 Penn Ave

    I need help. I am in the Columbus Ohio area and I have an appointment for my medical examination on Saturday but I think it is too expensive this medical office wants $252 for the exam. My husband has been trying to find someone else but he couldnt I work during the day so I dont have time to call all the offices listed. Is there anybody who knows one of the doctors in this area who doesnt cost that much? I would really appreciatte your help. Thank you very much! (F)

    $252 is actually very very cheap. Before i had my medical, i called several Civial Surgent offices to see how much they charge and i couldn't find anyone that would charge less than $250 and i would have had to go to Pennsylvania to take it, which is an hour and a half away. so i ended up taking in in WV where i live and it cost $399 which included the physical exam, the blood test and one vaccine.

    but seriously, $252 is very cheap so i would go for it

    Hope all is having a wonderful day! I know we have a thread dedicated for everyone waiting for an approval but I just wanted to see how many ppl are still waiting w/a Dec NOA1 date?

    My date is not until Jan even though my receipt notice had a Dec date but it was a weird situation (I think). Thank you in advance.

  5. My wife has her Biometric appointment next week. Does anyone know if you can file for EAD at this appointment at the Pittsburgh Office? If so is this any fast than filing along with the I-485?

    EAD has to be mailed to the chicago lockbox, the same place you mailed the I-485.

    most of the people including me send off the EAD application along with the AOS application.

    btw, I too am going through the AOS in pittsburgh, so check my timeline in the future to get an idea on how fast they are processing applications.

  6. my rfe on-line too said additional evidence, BUT my letter said initial evidence! my initial evidence was a 1099 form. a birth cert. could certainly qualify as initial, but I do not know.

    just a quick piece of advice-make sure you make a copy of EVERYTHING USCIS sends to you-I even print the emails I get-just to be safe! I made a best case and worst case scenario-best now! worst mid-April.

    i just found a copy that i made of my rfe letter and it does indicated on the top "request fro INITIAL evidence". this sucks man, I really hope i do not have to wait for an extra month now before i get my EAD. it has been a month now since the last time they touched any of my applications, so i guess it won't be for another month now.

I did not make a copy of the yellow page I received from requesting additional evidence but i just checked the email I received about it and it says:"We mailed you a notice requesting additional evidence". so i think that it is safe for me to say that they did not need "initial evidence", and therefore my processing resumed when they received my return to the RFE vs. starting the count from 0.

  8. They look at line 22 of your 1040 to determine income.

    You can take a new I864 with you to the interview and ask the adjudicator to consider your case without the cosponsor. They might be agreeable to this.

    i guess i would need to take an update version of I864 anyhow since my interview will most likely be after April 16 (i have not received an interview notice yet), but i guess i should also take an updated I864 from my joint sponsor too right?

  9. It depends on what the RFE is asking for. If it's for an initial evidence, then it restarts. But if the RFE is only for additional information, then the 90 days does not restart but is just tolled until NBC receives your response, after which, the 90-day time period resumes from the point of interruption.

    I found this document to be helpful in explaining the process. Scroll down to page 4, specifically, where it explains the processing of EADs, with or without RFEs (i.e. like supposedly making sweeps at Day 60 to identify pending EADs which have yet to be adjudicated.)

    how would one know of the RFE is for "an initial evidence" or for an "additional evidence"? would my rfe letter indicate that?? i think i had to mail that back so i no longer have it. my rfe was for my wife's Birth certificate; we sent the short version of birth certificate vs. the long one so we had to resend them a long one. i have a feeling that this would qualify as initial evidence which would suck.

  10. i have received an rfe after i sent in my package for AOS and EAD, and when i got the notice of RFE, it indicated on it that the now i have to wait 90 from the time they receive my respond to the RFE before i can contact them in case i do not get an EAD.

    my question is, does receiving an rfe really delay the time you get your EAD?? i know that technically it would, but was wondering in reality if that happens or not. i am getting close to 60 days from the first time i filed and wanted to see if i should expect soon or i had to reset my waiting period?

My wife and I just finished filing our joint tax return for 2006 and we noticed that our combined income was $16552, which is $52 over the 125% poverty line. but our adjusted gross income is less than that and it would take us below the 125% poverty line. which one does uscis look at when checking to see if you meet the 125% poverty line? the net income or the AGI??

    the reason I am asking this is when we filed for AOS, we used a joint sponsor because we did not meet the poverty line for that year, but since we already filed the taxes before we get our interview and we might meet the requirement, i wonder if we would still need the joint sponsor??

    i know they ask you at the interview for an updated affidavit of support, but i was wondering if we should indicate it to the interviewer that we actually met the poverty guideline on our own and see if we can go about not using the sponsor..

    any ideas??

  12. And with them not posting until all the DOs report; I wouldn't hold my breath. Tuesday is Mardi Gras. I doubt that New Orleans will be up to date. The city practically shuts down. My daughter gets a week off from school.

    All that being said...I feel your pain. My last update moved back two months!

    well, i guess with our luck, the 17th of this month was on a weekend that is followed by a federal holiday on monday and therefore the processing times have not been updated. hopefully they will update them tomorrow (even though i doubt) or on wednesday at the latest so that we can see where uscis is at.

    i know i have been advised to be patient, but i still cannot help myself and go check uscis's website every couple hours to see if they updated them. i know this won't do me any good and will simply drive me crazy, but it's either check my status online or checking the processing time, and since i know that my status is not changing anytime soon, all i have left is the processing time. lol

    I have a very good job offer that I don't want to lose. Company wants me to start on March 1st, but not sure whether I will get EAD before that. I have an AOS interview on March 15th, and not even sure whether they will stamp it for me that day. I just want to know whether my EAD timelines are even close to get or not even dream about it.

    i filed around the same time as you and i have not received my EAD yet, but again i read a lot on this message board that the employment card usually comes between 60 and 90 days of filing, which would make it sometime in march.

    I too had a good job offer but they said they cannot offer me the job until i get my EAD.

    what i would do if i were you is explain your situation to your future employer and explain to them that most likely you will get your employment card around mid-march and see if they would be ok with that.

  15. Hi. I'm just looking for a gut-feeling about how much trouble we are in here:

    Me: US citizen

    Spouse: Canadian, has been working/studying in US for 11 years on F1 and TN.

    1) A few years ago, spouse entered grad school, got F1.

    2) We got married last summer

    3) Immediately after the wedding, we left and re-entered the country twice.

    4) Spouse is in status for another year - F1 running out but has OTP now for a year

    5) We are now trying to do Adjustment of Status and eventually get green card

    So, I understand now that the potential problem is #3 - spouse came in on a visa that does not have immigrant intent after we were married. (At the time, she had been erroneously advised by her school's foreign students counselor that this would not be a problem).

    We have engaged an attorney to help us through AoS. The attorney scared the daylights out of us about the possibility of the AoS going south because of the two illegal entries. We're freaking out a little bit here.

    In you experience, how likely is it that we're going to have trouble here?

    if after re-entering the country she still attended school as a full time student, then there is nothing wrong with that.

    as in the case where she re-entered the country and was not a full time student but doing the opt, then i am not sure about that and what the implications would be..

  16. Don't stress the processing dates, they basically #######. Completely meaningless. Honest!

    My AOS case was processed several months earlier than was indicated by the "now processing" dates for my DO. As you had an RFE you can trust those dates even less. You're still so early in the process, just relax and try to forget about it for a while. I know its hard, but honestly best way is to cut down the number of things you check, and those damn processing dates should be the first thing you dump. ;)

    i think what rebecca said, that it is helpful to see if you are out of the processing times, then you can contact uscis without them telling you it is still too early. and even though your call might not get you anywhere, but i think it will still be noted by them.

    Kind of obscene.

    WAW, this is really shocking and sad, did you try making an infopass to see what is going on with you EAD? this is very ridiculous, i would go crazy after not working for a whole month let alone a whole year.
