  1. Is there any specific Affidavit I can use to help prove the relationship. No kids, shared lease or bank so I must use the Affidavit.

    The question is, do I just make up my own and print it out and have it notorized.. or is there some special Affadavit I must use?

    And what could be considered other relevant documentation?

    a marriage certificate would be the most important thing to submit if it is based on marriage that you are filing

  2. What all do they do during the Medical Interview? As in is the applicant gonna have to get naked and spread um.. things like that.

    all they do is check your blood pressure, check your ears and listen to your heart beat and then ask you about your famili's medical history and look at the vaccination record and see if you need any extra vaccines.

    they will draw blood from your arm to do the HIV test and syphlis test and will inject a needle in your hand for the TB skin test if you had not had one in the past year.

    YOU DO NOT HAVE TO GET NAKED OR ANYTHING.

  3. I am sending my application tomorrow morning and have one last question. I am filing I-130 at the same time as I-485. on form I-130 on section 22 it asks about the USICS office where I am filing for adjustment of status at. I am sending these two forms to the lockbox in Chicago but I live in West Virginia and the closest Local USCIS office is Pittsburgh, PA. So what should i enter on section 22 of form I-130?? should I enter Chicago or Pittsburgh?

    We were trying to save a little money, but I guess she's going to have to stay at least 3 days in Manila - 1 for Medical Day 1, 1 for 24-48 hour wait, and 1 for the follow up.

    yes, that is correct. you can check and see with the cival surgeon to see if he/she would allow you finace to have her ski test checked by another physician somewhere else and that that physician would report back to the civial surgeon. i am not sure if they would agree to that or not.

    one another thing you can do is that you can have the TB skin test done by a doctor who does not have to be a cival surgeon and then you would take the result with you when you see the cival surgeon. All that the civil surgeon checks for is that you have had the TB skin test less than a year ago and if you did thn you should be fine as long as you report the result to him

Why not use both the cousin and her husband - they are in it together - taking the worst case scenario even though she is only sponsor - because they are married both can be sued for recovery in most states. Since you are trying to split the incomes if you still choose to do so - you will need to provide W-2s to separate her income from his.

    Hanster - if the co-sponsors are jointly co-sponsoring then you do not need to submit W-2s (just the IRS transcripts) but if you are splitting their income for his or her portion then you will need to provide W-2s - make sure you calculate it also so you know how you arrived at the figure that meets the criteria.     I was just trying to minimize the number of forms that needs to be filled by my cousin and her husband.

    I am gonna ask them tonight to fill the I-864-A form for him as a co-sponsor.

  6. If my fiancee is going to get her shots here in the US, does she still have to go to Day 2 of the medical? I posted in the Manila thread, but no responses....

    if your fiance gets the TB (tuberculoses) skin test, then she needs to go back after 48 hours to have them look at it to see if there was a reaction. this will only take 5 seconds for them to look at it and you will not be charged.

    it is important to go back to them in the required time they tell you (24 or 48 hrs) and have them inspect where they did the skin test and if you do not go back, they will not issue you the medical exam record you need.

  7. my cousin who is going to be my joint sponsor had filed her taxes jointly with her husband and i kinda skimmed through the tax transcript form IRS sent her and it did not seem to speperate her income from her husband's income. we looked at her w2's and her income alone is enough to support 3 people over 125% of the poverty line. we do not want to use her husband's income as living in the household because he is self employed and it would be too much hastle.

    can we just use the tax transcript the IRS sent us even though it states their combined income? or do we have to make a copy of her W2 form. in addition, should we sent the original tax transcript the IRS sent us or should we send a copy of it?

    When sending any forms in to them for tax and such, they can indeed be copies as you always want to keep your originals unless asked for specifically by USCIS.NVC, etc.

    But as the form was one that was filed jointly, you will want to include the W-2 showing that income they are interested in, in this case your cousin. You can contact the IRS web site to get copies and usually takes about 2 weeks to get, or make copies and send them in. Be sure to include transcripts, and tables as requested. Make sure to sign anything they request to be signed with an original signature, and make sure to put case number on all sheets in the upper right hand corner in case they are separated.

    I thought copies of the W2s are not needed if you are submitting an IRS transcript of the tax returns. I thought that only if you are submitting a copy of your own tax forms that you filed then you would need a copy of the W2.

    so since my sponsor is married and filed for taxes joinlty with her husband, then she needs to also include a copy of her W2s along with the IRS transript of their joint tax return? is this it?

  10. I am here in the states on an F1 Visa (it comes with an I-20 form) and I am getting ready to file I-130 and I-485. I was wondering if the F-1 visa does have an alien registration number so that I can include it on the forms or not. I thought somebody had said that F1 visa does not have an A# but I wanted to make sure and double check.

    if anybody knows anything about this, please let me know.

    Your A# comes from the USCIS when you file the forms. I was also F1. I sent in all my paperwork without the A# then the receipt notices came updated with one.

  12. I was filling out my I-130 form and I don't know what Alien Registration Number is .I asked my wife and she said that she doesn't know . Is this something I can leave blank and just send it in ?

    If you never had been assigned an A number, simply answer it "NONE."

    What if I have an F1 visa and am looking into filing the I-130. does the F1 visa have an Alien Registration Number or would I still put N/A on the I-130?

  13. It is really simple. It has to be a copy of a certified copy of the marriage certificate. That is the document that proves you have been married and the marriage has been recorded by the government into their official " book of life ".

    They give you a liscense which allows you to marry and then they give you a certificate which says you have accomplished the marriage.

    So, does it have to be a certified copy or not?

    I am gonna make it easy for all of us:

    After you get married, you will receive by mail a letter from your county clerk and it will contain a marriage certificate (it certifies that you are married to your spouse).

    make a copy of this and you will submit this copy when you file your application

  14. I'm not in the AOS stage yet, but I think you need to make sure that the copy of the marriage certificate is a "certified" one.

    Also, I think you need to include an additional copy of the passport and the K1 visa for the I-765.

    If you are applying for AP you need payment ($170), copy of the passport, K1, I-94 and 2 more photos - and I think these are different from the rest (3/4 frontal -right ear visible)

    I checked all the papers and requirements and it does not indicate anywhere that the copy of the marriage certificate has to be certified. did anybody submit a copy that was not certified?? and did you have any problems with that?

  15. I was just reading the instructions again (for the I864) and it doesn't look like you need tax transcripts for that either. It states:

    "You must provide either an IRS transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years."

    I know they revised the requirements relatively recently, so there is a lot of confusing information out there. But looks like the current I864 doesn't require tax transcripts :)

    Also, for self-employed:

    "If you checked box 22(b ) (self-employed), you should have completed one of the following forms with your Federal income tax return: Schedule C (Profit or Loss from Business),Schedule D (Capital Gains), Schedule E (SupplementalIncome or Loss) or Schedule F (Profit or Loss from Farming).You must include each and every Form 1040 Schedule, if any,that you filed with your Federal tax return."

    All of this is on page 8 of the instructions.

    the problem with my case is that i have a joint sponsor so it would just be easier to have my joint sponsor provide me with a tax transcript vs giving me copies of his W2s and his tax return.

    I also wonder whatever happened to those forms that we submitted to the IRS, r they lost or what? and whether i can call the main IRS number and ask about them or i need to try to find the number to the location i filed which is Austin Texas

  16. I just called the IRS on Thursday afternoon, Dec. 7th. They kept me on the line and faxed them in about 15 minutes. Go to the IRS page for the phone number, it was quick, easy and they provided great customer service.

    I actually filed for my tax receipt transcript (form f4506t) with the IRS on November 17th and i still have not received them back yet.

    I had sent it in the mail. There was a phone number on the form that indicates you can call to order over the form but when i called that number to check on my transcript it did not have the option.

    should i continue waiting or should i file again??

I was reading a post yesterday and I was looking at the timeline of the person writing the post and it indicated that he/she had a biometrics exam when filing for EAD and then another one for for AOS. it looks like the person filed all these together but the timeline indicated he/she had two biometric exams.

    In my case, i will be filing I-130, AOS and EAD all at the same, so do I need to include 2 payments for Biometrics, one for the AOS and one for the EAD even if i am filing together?

  18. what you can do is have someone translate your vaccination papers. Mine were also in french and I had them translated long ago and they used them. I know that a lot of the vaccine names in french are very close to the english names so the surgeon himself should be able to read and kinda get the idea, or you could even offer to read it off and translate it to him infront of him/her.

    they are a bunch of thieves though, i had to pay $400 for my medical exam, including a TB skin test and chicken pox vaccine.

  19. Did your husband file a I-130 petition for you as well or jou just filed for an Adjustment of Status?

    Actually I am the husband. We have not filed our papers yet, we are still waiting on the transcript of tax receipt for the IRS before we file. but we will be filing the I-130 petition and the adjustment of status.

    The I-130 is filled for your husband saying that you are married to him and he wants to give you a green card.

    the I-485 (adjustment of status) is filed by YOU saying you want to change your immigration status from F1 to "Permanent resident"

    you can file all these forms at the same time.

  21. It might be worth a brief consultation with an immigration attorney, as you don't provide a very full picture of exactly what happened and there can be complications that we don't know about. I'm also not sure about the ramifications on your student visa, as in whether or not you can continue to study.

    But if you entered with intent to be a student, not to marry and stay, you will probably be fine to Adjust Status. AOS is the only method by which you can stay in the U.S. without having to be processed elsewhere.

    Definitely read the guide on Adjustment of Status, it is very helpful :) Good luck, and congratulations on your marriage.

    I also entered the U.S. on an student F1 visa and am in the process of filing for Adjustment of Status. I briefly talked to an attorney (it was a free consultation) and he said that as long as I am NOT out of status (enrolled full time in college) then I would not have to leave the country. So if you are in status (full time student) when you file for adjustment of status, then you do not have to leave the country.

    You would need to file for adjustment of status I-485 and your husband needs to file for you the Petition for Alien Relative I-130. There are some other forms that are required by these two that also need to be filed as well such as Bigraphic information (for both you and your husband), Medical Examination form (I-693 and I-693 A for vaccination), in addition, your husband needs to file Affidavit of Support I-864 and if you want Employment Authorizaton Document I-765 if you want to work before you get your green card.

  23. My wife and I are looking to file for adjustment of status based on Marriage. We submitted form 4506t to the IRS to request a transcript of her tax returns and we sent this in on November 17th (3 weeks ago) and we still have not received the Transcript yet, the joint sponsor also submitted the same form to the IRS last week and still has not received their Transcript. I thought I read somewhere that it takes up to 10 days to get the transcript back for the IRS and 21 days is way past that. I am hoping it gets in soon, but since we are almost half way through the month of december, we were thinking of actually submitting out Adjustment of Status in January of 2007 vs submitting it this month. the reason for this that in January there is a free immigration clinic in town that would help us file the paperwork.

    my question is the following: if we end up filing for AOS in January, this would put us in a new tax year, but the W2 forms usually do not get in till the end of january, so would we still submit the tax return transcript for 2005 or would we have to wait on us receiving the W2 forms for 2006 and submit those?
