    Whoa, such a big difference between your NoA1 date on the old and the new site. Is that right, two weeks difference?

    I don't think you can go to a different one even if you wanted to. Just like in Brazil, only one consulate in Mexico does the interviews for immigrant visas.

  3. Hello all, 

     

    So long story short, our lawyer forgot to send in my fiancée's (petitioner) proof of citizenship. We were gonna use the passport as the proof but she forgot to include in the packet. She sent in a supplemental packet about 2 weeks when we had our case number. This packet contained the proof of citizenship. But we called this week and a tier one officer said they have no records of a supplemental packet in our file, which obviously upset us tremendously.

     

    So two questions:

     

    First -  I've known that this would require an RFE, but is it ground for a NOID or just the RFE?

     

    Second - Our lawyer also didn't write our names on the back of our passport pictures and printed out our pictures in black and white without on printer paper and without dates and where we were when the picture was taken. Will these two also likely be reasons for RFEs?

     

    Thank in advance to any anyone who might be able to give me some insight.

    My fiancee is the USC petitioner btw.

     

    I really hope so, it's just so frustrating you know? We paid good money for a service thinking it be for the best. Never would we have imagined this happening and them forgetting a crucial document in the process. If my fiancee or myself had filed the petition we would feel more confident.

  5. Quick rant!

     

    So our lawyer, back in Jan still, forgot to send in my fiancees proof of citizenship. After we had received our case number she mailed in a supplemental packet to USCIS with my fiancees proof of citizenship and told us not to worry and they everything would be okay.

     

    Today my fiancee decided to call check up on our case and the agent told her that there is no record of a supplemental packet in our file!!! Like really? It's like, now I don't know what to think. At this point I'm gonna be just happy to receive an RFE and no Notice of denial.

     

    Sorry for the rant.

Then he/she will either tell you that they have not received your case or you will be asked for the names and dates of birth for each of you.

    Oh alright. Cool cool cool cool cool cool. I'll try giving them a call today in case my fiancee is not able to.

    Thanks for the quick reply! I was in doubt if it would be okay for me (beneficiary) to call because I believe I had read on VJ that they'll only give out any information to the petitioner.

     

    Do you know if they'll ask for my fiancee's social security number or some other personal information.

    Really?! That's counter productive I think. But it could explain why some cases get adjudicated before others.

     

    What in the world is an ombudsman? Lol and how will he help in this situation @Lucy&Jason? I'm legitimately curious.

    Lol I think there's some kind of confusion here. Let me try to explain better. I know that every case goes to an adjudicator. I just meant to ask if your case is in the hands of your specific adjudicator. 

     

    And you said that everyone's case is technically assigned to an adjudicator, but is that the case? I didn't think it was like that. I thought it was more along the lines of ... An adjudicator goes into where they store the files and brings a stack back to his desk and works on them without them knowing who's file is in the stack until he scans it or does what ever they do.

     

    By the way you said it made me think that our case is assigned to an agent as soon as it gets there lol.

     

    But that's unfortunate, I thought they were gonna be able to tell you if your case was being worked on and stuff.

I spoke to a Tier 1 officer who created a service request for me and said it would take 15 to 30 days to hear an answer on why my case is delayed. He couldn't give me any new information unfortunately. I did request to speak to a Tier 2 but was told that Tier 2 would not be able to tell me anything special and that the service request would go directly to the specific officer adjudicating my case and they would give me a better answer then a Tier 2.  I hope that if I do get approved in the next week or so that the service request doesn't cause my case to go to NVC and bounce back to USCIS and be in a black hole because I have seen that happen a few times here.

    But does that mean that your case has been assigned to an adjudicator? At least that's good news, right?

    Correction, I checked and I am signed up for the 2 weeks inactivity notification. But these notifications just started to come in this month. And like it happened to you, I know most people have this checked and still arent getting these notifications.

    But hey, at least they're doing something on your case though! Also, even though I have mine turned on I never get any single email from them (even when I changed my address 2 months ago) lol still waiting here... 192 days active 😪

  13. The email that a lot of people received today, I've received it three times now. But didn't receive it today.

     

    Received it July 2: Said they last took action on my case June 18.
    Recehevei it July 16: Said they last took action on my case June 18.
    Received it July 30: Said they last took action on my case June 28.

     

    They're doing something with it. I just don't know what they're doing. Seems strange though.

    Did they ask that tho? Bc I just re read the form and still couldn't find where they asked that question.

    I just checked here and they don't ask if the person has had a visa denied before. They ask only if someone has applied for a fiancé visa before. Your fiance will be asked about this on his DS-160 though.

    Your RFE, did you get notified of it on the new site or did you receive it silently in the mail?

    From what I know, you need to have the visa interview confirmation in hands in order to schedule the medical. At least the physician in Belo Horizonte Will only schedule me in after I already have the interview scheduled. And I believe the physicians here all do the same.

     

    Maybe you should call the doctor you plan on going to and personally ask just to be sure.

  18. Alright, so after reading this post im a little worried about something that I had calmed myself about. The thing is that we hired a lawyer to file out petition and she forgot to include my fiancees proof of citizenship in the packet. Then two weeks later, after we had our case number, she sent in a supplemental packet with the proof of citizenship and told us not to worry because if they need more documents they'll ask before denying. So should we expect an RFE or is there a chance of receiving an intent to deny?

    Thanks in advance for any help.

    Oh boy, that's not good. If anything they should sent out RFEs first since they know it takes time for them to send out the Notice and to get it back. So if they know it's gonna delay a couples petition then why send RFEs out even later? I'm saying this bc we forgot some little things in our packet and expect an RFE. So I would want it sooner rather than later since it's gonna delay us in a couple of weeks.
