I don't like your lawyer!!! Does your fiancé have paperwork showing that the "sentence" was carried out. There are many approved that spent time in prison. All they need to know is that the courts have approved whatever punishment and that your fiancee is now free and clear.
Another thing is that you cannot expunge a conviction. You can expunge an arrest but if there is a conviction that is on your record forever. Make sure she has the proper court documents and that her police certificate is clean now. All she has to do is prove that she served her time/ paid her fine.
I have been expunged for an arrest in 1991. I know this well. My lawyer did it for $2000 and I did it in Cook County, Illinois. That is about the most expensive place that can be done.
I think your lawyer is trying to squeeze you a little.
It is US law that the CO is concerned about. As long as she is clean now and has paperwork with the previous disposition you should be fine.

I believe the NOA2 is just going to show up. No explanation. Just approved like it is any other day. When that happens, just smile and forget the past. Keep moving forward, even if that is at a crawl. This journey is just a test. It separates the men from the boys and the woman from the girls. Be strong and persevere. We are all there with you and we are all waiting for you to finally get on with your life.

Read the last paragraph .. they throw out "legal" and then the proof comes regarding an illegal deportee .... blocking illegals is good. deporting illegals is good. We DO NOT want an amnesty. TPS cancellation is good, along with cancellation of visa waiver, chain migration and DACA. Clear the decks!!!!
Been through the Clinton 2000 December amnesty ... not good situation for law followers.
