Hi guys, I hope you're all doing great. I wonder if any of you with a similar PD has already received an interview date?  My pd is July 20, 2016.

My husband and I got a letter the 3rd of January , saying our case is completed and we just have to wait for an interview date. So far we still waiting, I will love to have an idea about when will it be...

    Hi! Congrats!!!

Unfortunately, you have to wait. I would say a few months, probably July or August, maybe even June if things move forward quickly.

Called USCIS for the pending I-485 to get an update.

they told me to "WAIT" as Jacksonville is processing April 2017 cases now.

Can someone explain the USCIS processing charts

"Processing cases as of November 30 2017"

So does this mean no movement since Nov 30 2017?

The Charts are the official dates that are being processed. However, I have been observing them since last year, and they are not very truthful. The "As of November 30, 2017" means that at that time, they were processing cases from the date they say there.

However, I think it is just a shield and filter USCIS uses to stop people from submitting inquiries when they are overloaded and processing at this very slow rate such as now.

Um yes I'm not in the US. Theyre dealing cases till march, 22'16. Right? The waiting is killing me

More than EAD, the Filing Date shows the cases that NVC can start processing, in March will be cases before May 2017. This means filing, sending documents and paying fees for people with approved i-130 and with current date on March's VB.

The Final Action Date for March 2016 means the Final Action taken on cases, which means that cases with dates older than March 22, 2016 are getting interviews at Consular Offices to get their F2A Visa.

For people inside the U.S., Filing Date might be used to file for Adjustment of Status, (together with EAD and AP), but that is decided on a monthly basis by USCIS if that date is approved to be used or not.

Yes. All of them are different but pretty much say the same thing. Are yours the same? Shouldn't they say "we reviewed your biometrics" or something like that?

No, your biometrics are captured, and the stamp on the biometrics notice is evidence you went to the appointment. Right now, your case is on queue, keep an eye on the other users with similar dates and checking online your status.

    hi guys,

I am asking this question on behalf of my wife. Her PD is March 2016 and just became current. We filled the AOS on Oct-2017. She had her Biometrics on 11/20/2017 and received 3 MSC receipts. However, all of them says:

On October 30, 2017, we received your Form I-765, Application for Employment Authorization , Receipt Number MSCXXXXXXXX, and sent you the receipt notice that describes how we will process your case. Please follow the instructions in the notice. If you do not receive your receipt notice by November 29, 2017, please call Customer Service at 1-800-375-5283.

I am wondering if you guys have the same message.

    Thank you in advance./

    Hi Tongua!

Do all of your receipts say they are for Form I-765?

You should also have receipts for Form I-485 and I-131, assuming you filed them all.

Also, the one you copied are the e-notification. It is very important for you to have the physical ones, as the i-485 receipt serves for your wife as proof of legal presence in the US, if needed.

    Hi,

I (perm resident) filed I-130 for my wife (F1 visa) under F2A on Dec 20, 2016 and my application is still pending with CSC. March 2018 service bulletin shows my dates are current, I was wondering if I could file for i-1485, EAD & Advance Parole without approval of I-130. Can my wife travel to India after filing for AP and comeback on AP once approved? Is there any risk associated with this approach ?

    Thanks

Hi! PD Dec 19, 2016, almost neighbors, i130 still pending, and considering concurrent filing too.

For exactly what you are asking, no. She has to wait for her AP to be approved for her to travel and her application not to be considered as 'abandoned'. If there is an emergency, she can get an infopass appointment and get an expedited AP filed and issued in a matter of days, but only for emergencies.

Now, to file for adjustment of status you have to wait until March, and depends if USCIS approves the use of chart b (I think they will, but you still have to wait, link: https://www.uscis.gov/visabulletininfo )

Now, about the concurrent filing, it is allowed by Uscis on several conditions, being the third:

"When permitted by USCIS (as described above in “Acceptance of Adjustment Status Applications”), your priority date is earlier than the cut-off date listed in the “Dates for Filing Applications” chart for your preference category and country of chargeability."

So, technically, you can file i485 and combocards, but have to wait for AP, and even approved AP, I would suggest to avoid traveling unless it is an emergency, because reentry is not guaranteed, and only as "paroled", Idk what that means exactly.

Hey tenyero what does that mean? I mean I saw two dates! 22 march and 1st may somewhere! Can you tell me which one is mine lol? I'm with the PD of June,17 by lpr (my spouse)

Your date remains being June 17, Filing Date moves cases to be allowed to be processed by NVC (or Adjust Status if within the US)

While Final Action Dates are the cases getting interviews at Consulate posts.

Also, CSC seems to not process a lot of applications until the Filing Date moves.

Any idea when priority dates for filing I-485 under F2A might move? It has been stuck at Nov 1st, 2016 for a few months while Final Action dates have made progress.

Also, any more progress on I-130 approvals in CSC? It's pretty frustrating not seeing much progress on that either! My PD is mid November 2016.

    Hi!

    Remember we talked about it?

It will move on March 2018!!!!!!!! from Nov2016 to May2017!!!

Thanks for the information, I was not aware of this option. However after finding the 2 nearest offices, none of them have available appointments, and I did not find an option to schedule one. Do these offices have a number I can call? Or am I able to schedule if I call USCIS?

I think the appointments calendar only scans the next 14 days, try logging in frequently, and right after midnight, and early in the morning, to see if the next available day appears available, Maryland is a high population density area, so, more people in the same space, with limited availability, it makes it harder to find a spot. Keep checking, maybe someone cancels an appointment, or the next day appears maybe after midnigth.

You can schedule your appointment here: https://my.uscis.gov/en/appointment

    Good luck!

  10. Also, on time requests does not actually submit a Request, they just tell you that you are not able to submit a request because your case is on time. I guess it saves them from the trouble of answering cases actually on time.

And finally, did you selected the option of Spouse of US citizen on the Service Request form? Because that you filed it as a Resident does not mean that it now is the same, and it won't allow for it to be sent since the published date is Nov 4th, 2016

I might just have to speak to a immigration lawyer and see if I have any other options, if anyone here has any info that would be greatly appreciated too.

In my opinion, you have not walked down every road. For example, Why don't you make an infopass appointment and see the real status of your case face to face with someone, and see if it was indeed upgraded?

If they told you it is an error on their part, ask them to expedite your case as a form of they making it up to you, since that is one of the option when requesting an expedited case.

But will my status then be illegal? Will I be tagged as overstaying?

You are asking on the family of Permanent Resident section of the forum. If your spouse is a Permanent Resident you can not file the i-130 package together nor stay on the country, you would be overstaying. Unless your spouse is a US Citizen.

In that case, you have to receive a digital notification. And later the notice of action.

Does any one know why there is no I-130 processing time shown for California Service Center under U.S Citizen filing for spouse?

My guess is that it is mostly handled by Nebraska Service Center, and CSC only handles the one that upgraded already at CSC. Any related question you might find more helpful answers at the corresponding forum inside Visa Journey:
