    Navg62 didn't specify if is going through Adjustment of Status, I thought it was Consular Processing.

    Hi Navg62! It's really nice that you are almost done with everything. Waiting without knowing anything is the worst part.

     

    We all want to know how the VB will move, but we can only guess. Michael brought to our attention an important part that appeared in February's VB. Which said that future VB's are expected to move around 3 to 5 weeks, from Feb VB it would place March with a Final action date between March 22 to April 8th, 2016. 

     

    If it moves more, it could include your case, so let's cross our fingers for that. But right now, in my opinion, the interview could be in April. Remember however, that the Vb could not move as expected due to other circumstances.

    In theory, the State Department and USCIS will be almost entirely open, by what I've read, only passport issuing at State, and E-Verify at USCIS will be affected. So, in theory the VB should be normal, but I share the doubts you have.

    Hi! If everything goes smoothly, and the Visa Bulletin continues to move forward at the same rate that it is going, I would say the interview would be on July or August this year.

    The government shutdown is not 'for' something, basically if there is no agreement today, multiple agencies ("non-esential ones") will have to close and a lot of people will be on a forced license because the people running the country can't agree on where the national budget should be spent. It would start tonight at midnight, and would last until an agreement is reached.

     

    I actually don't know where NVC or NBC would stand during a government shutdown. If someone can enlighten us on that aspect. I understand that USCIS is not based on government's budget, but on fees from the applicants and petitioners, and found a source that says: "During the last government shutdown in 2013, the impact for most customers of USCIS was minimal. Naturalization interviews, citizenship ceremonies and most of the other day-to-day work of the agency continued as normal. That is because USCIS is a fee-based agency"

     

    However, In my opinion, there could be some extra delay (On cases that are reviewed by other agencies).

  6. What geowrian said is important. I didn't notice it was January 30th your 5th year anniversary as a LPR.

    Filing before that and trying to overcome the 5 year rule (item C) is a much more difficult path. Waiting a few more days is definitely easier than overcoming a mandatory presumption of fraud.

    Under that same line of questioning, I know NYKid didn't say that, but I guess any Conditional Permanent Residence would not account for the 5 years as LPR, would it?

    To my understanding, Yes. Even if the company is somewhere else, you would have to provide the info that USCIS would use to contact the business if needed, to verify your employment there. You should try to do everything by the book and file your tax return in this Tax Season. Remember that in the future it will be asked from you an affidavit of Support, with evidence that proves that you can provide economical support to your relative, if needed.

  8. Well, by what you said, if you have been a LPR for 5 years, then you qualify by the B statement, and I would say that also the C statement, if you can provide compelling evidence. However, be aware that a USCIS agent or embassy officer can put some pressure into this topic during an interview. Cases that are only for personal gain, evasion of immigration laws and other like those are one of the things that have people like us struggling away from the person we love.

  9. Chounglinh is right, the USCIS decides each month which chart to use for AOS, for January and February 2018, you are supposed to use Date for Filing, which is 01 Nov 2016. 

     

    In other words, because your Priority Date is from September 2016, you are current to sent your Adjustment of Status Package to USCIS, remember to also include form i765 for her work permit, and i131 for a travel document, because she should not leave the national territory until she gets this document, or her case will be considered abandoned, however, while she awaits for all these forms to be processed, it is legal for her to stay without any further problem. Good Luck, any other question, you can always ask.

    It's normal to be nervous. You have to be prepared for questions related to that. This is not a normal case, but you shouldn't stress about it.

     

    In my opinion, as long as you proved you were honest during your stay (you didn't, work, etc.) they can put some pressure, but you actually did the right thing. As some in these forums have pointed out, they want to see you have a real relationship, and unfortunatelly, it's with documents and evidence that they usually want that to be achieved.

     

    What indeed could have made them call you for the embassy could actually have been that you only stayed in your country 1 month between these two long trips, however, you could point out that it was never your intention to stay that long on the second trip. Specially that you weren't planning on getting pregnant.

     

    If your husband had applied for citizenship after you filed on Jan 2017, your case could have been completed. Right now citizenship is taking a while longer, so either your case or the citizenship could get through first.

    Actually, the 9 months as of October 2017, is for the New York City field office, your field office in the New York State could also be Long Island, Albany, Buffalo, or Queens, depending on where are you located. Buffalo had the shortest processing time, Queens the longest.

    I think I don't understand the question, but the date shown is actually the cases that they were processing in oct 31st, 2017, and the date is not when the i130 was neither filed or approved, I believe is the date the i485 was filed.

    That is a good thing that you wrote in this forum, because actually, you are able to File Adjustment of Status (AOS), this is because the Filing Date right now, is NOV 01, 2016, you are actually able to apply right now your AOS package, and get a work permit and travel document while your documents get processed.

     

    Even if your spouse is a Permanent Resident, you are able to. I hope you can start that part of the process right away, it would take around 4 months for the work permit, and you are actually able to remain in the US while you wait for the completion of your case. (But you can't leave the national territory until you get your travel document).

     

    That's something you would have to discuss with your spouse and decide whether it is the best option for you two.

    At last, He told me that these two documents- a police report issued by UAE and the tax clearance certificate of my spouse, are very essential documents and that I must submit later. He asked for my original passport plus two 2X2 photos. He also kept my documents including photo album for reviewing and then he told me to wait for some time until they would call me again.

     

     

    After having waited for around 45 minutes, an officer announced my name from a counter. The officer showed me the forms and documents and asked me whether those documents related to me. Then, She asked me the some questions.

     

     

    1. How did your spouse entered USA and when?

     

     

    - I replied that she was taken to USA by her father through Immigration Visa.

     

     

    2. Is you spouse Citizen or LPR?

     

     

    - LPR

     

     

    3. With a doubtful expression, she repeated the question- Is your spouse LPR for sure?

     

     

    - I smiled in a confidence and replied 'yes'.

     

     

    She verified my documents once again and browsed my photo album. In that album, I also had kept my Credit Card of Bank of America that my spouse had sent for me. She showed me the card and asked me whether it was mine. We are using the same bank account jointly and I am using a supplementary card. I use this card to withdraw amounts as per my need. I told her this. I also told her I had remittance record and chat log of Skype and Facebook. But, She didn't asked for these records.

     

     

    Then, She returned to me all the original documents I had submitted to the NVC except Passport and 2X2 photos. She handed over to me 221G paper and made it clear to me that I should submit the tax return evidence. The 221G paper also indicated the same requirement. She told me, they would call me again after the submission of above evidence. She mentioned nothing regarding the submission of UAE Police Report.

     

     

    The next day I went to the embassy and submitted the tax return evidence. Although, 221G paper didn't mentioned the need to submit the UAE Police Report, She asked whether I have brought police report too. I replied that I hadn't. She told me to wait until would confirm whether it was needed or not. After a couple of minutes, She said that it was not needed.

     

     

    I returned home. Today is the fifth day. I have been waiting for their response.

     

     

  14. Hi!

    From what I've heard, basically you have to be prepared in case. Mainly the required documents such as the medical certificate and stuff, but also evidence of an existing real relationship. Not only things like photos, but also any financial, legal,insurance or other kind of document that links the two of you. Also, evidence backing the affidavit of support can sometimes be necessary, such as filed taxes, pay stubs, etc.

  15. Even tough officialy it says Sept 2nd, and before was Aug 23rd, technically they only moved forward 10 days after several months. However, right now the i-130's that we have received notification from users with PD of mid-October 2016, that were approved in Nov-Dec 2017. So, right now it's around 1 year and 1 month. The estimated time can get slower or improve, but that are things difficult to predict. 

     

    As of right now, it is around two years from start to finish, since January 2016 PD's are the ones getting the interview dates this days.

    Based on forums, the I-130 for spouse of USC is getting approved with May 2017 priority dates, but my application is not yet approved. I went to an infopass appt last week, and they told me that my application was "touched" on Dec 13, and they dont know what happened with that touch. They were unable to provide any other info, and asked me to just wait. 

     

    Can someone please advise what can I do to expedite this in any way given other applications with the same category are getting approved. 

    No two cases are the same, and I can speak only for myself, but CSC is a dissapointing black hole. Ask around the K Visa forums to see if you a K3 Visa is an option for you, I don't know how those ones work.
