    Thanks!

You couldn’t get the tier2 to talk to?

I guess you just have to file 2017 soon and send it ASAP. It is too bad that they wouldn’t accept 2016.

    No i couldn't, I asked both times.

Yeah hopefully the accountant will be fast with the tax returns.

Does anybody knows if my EAD an AP is also on hold because of this RFIE?

    Great! Thanks!

So I got a little bit more information about my RFIE. There was an attorney of the USCIS present at the biometric center. Luckely it wasn't busy and I was able to sit down with him and talk about it. He couldn't really give me a correct answer but he told me that he was confused about the situation. he said that I send in the right information since my mother in law doesn't has her Tax return for 2017 since she has an extension for it. ( so with other words I send in the most recent tax returns).

after that I tried to call USCIS and asked them what to do. I called them 3 times today because none of them could really help me. They literally just read something to you from the book.

after that I tried to schedule a appointment with my field office but there where no appointments available for the upcoming 2 weeks.

So I just asked my mother in law to ask her accountant to get her tax forms for the year 2017 ready as soon as possible. he will start on it tomorrow.

Let's hope he will be fast and I can send it in ASAP.

I would send in this, along with the 2016 tax return, just to highlight it is in fact the latest one. When is your RFIE deadline?

I think your husband is right, the filing itself will probably only take a day. But accountants can be busy and may have to collect documents so likely that's why Roy Janssen's mother-in-law's accountant says it will take some time.

yeah I think that would be the most obvious solution for me I guess. the deadline is in 87 days so that is not the problem. i just wan't to fix it ASAP haha.

Good idea, i would definitely call them and ask them what to do. Usually i think the first person who answers the call doesnt know much, I would try to get Tier2 to talk. It doesnt hurt to ask people in the ACS when you do your fingerprint tomorrow too. Also you can ask how long you would have the interview and maybe they know something.

Please tell me your solution tomorrow because I am expecting a RIFE too now ..

I cant believe it takes 2 weeks to do it, if you have to file it, just have to do it then.. But my husband said can be done in a day? I dont quite understand ...

I will defenitly do that. As soon as I know something i'll let you know. they can't get the taxes ready in one day because it is a pretty big business. she owns a multidisciplinaire health clinic. so the taxes are very complicated.

Omg, when did you send your package in? My husband has the same situation like your mother in law, he didn’t file 2017 and we sent 2016 in.. I guess I will get a RFIE too. Maybe you can ask your mother in law to file it right away and send to them? How long does it take to file the tax returns? I am asking my husband to file it now:( even he had extended to August 2018.

Ow no, I guess you are in the same situation as me then. I will call them tomorrow and explain them the situation, see what they will say. I also have my biometric appointment tomorrow. Maybe they can answer my question and help me. My mother in law asked her accountant and he can start tomorrow on her tax returns for 2017. he said it will take roughly 2 weeks.

Maybe it is also an idea to send in proof of extension for tax return. that would show them that we filed the most recent tax return.

  6. Just recieved my RFIE. It said the following: The joint sponsor ( my mother in law) must submit a most recent federal income tax return. I submitted her tax returns for the years 2014, 2015 and 2016. She didn't filed her tax return for 2017 since she owns her own business and has a extension for it. ( this means she doesn't has to file her taxes before October 2018. So I don't know how I can provide them with the requested initial evidence. Maybe calling them and explaining them the situation??

Could be anything, that has to do with the initial requirements - what type of birth certificate do you have in the Netherlands? Did you submit it in Dutch with an English translation?

Yes, it's good that you're getting the RFIE rather quickly. It'll reset your timeline, unfortunately, but you won't lose many days.

hmm, we will see what it is. Yes i submitted a dutch birth certificate with an english translation. so that wouldn't be the problem.

  8. I just recieved an update via the USCIS app for my AOS. unfortunatly it said "Request for initial evidence was mailed" I have no idea what it could be.

but also this is pretty fast since I send in my application on june 1st. does this mean they are already working on my case. hopefully I will recieve the letter in my mailbox soon, so that I can find out what is wrong with my application.

Thanks guys for the help! @Roy Janssen - just a question, I didn't see that I even needed to submit copies of my marriage certificate with the any of the forms other than the I-485. The I-765 (EAD) instructions as far as I'm concerned ask for photocopy of passport page and two identical photos. And the I-131 (AP) instructions asks for photocopy of passport page, two identical photos and I-94. With the I-864 I couldn't find that the marriage certificate was needed either. Or have I missed something?

No you're right. The instructions don't say that you have to add the marriage certificates. I just added them to make sure. so don't worry. everything should be oke.

  10. Hello fellow VJ'ers,

I send in my AOS, AP and EAD on may 31st and it arrived at the USCIS on June 1st. so that makes me a June AOS filer haha.

I saw you guys talking about a certified marriage certificate. They only ask for a certified one for your Adjustment of status. With the other forms you can just send a regular copy.( saves you some money).

Hopefully everything will go smoothly for us.

Tell me more about it. My status on the app at 232 days is still case received. When they sent the NOA2 through mail, we got our copy first thAn our lawyer. So basically I should be the one being paid here not the lawyer...with the NVC case number, so far we never got any mail about it...I got my case number when I called this morning. And our lawyer’s expectation for the NVC case number was March 20....so if we just sat on our asses, nothing would have moved forward...

we just got a lawyer for this phase because my partner’s not into paper works...And application will have to be done from his end..

if I can find someone kind here to guide us through the change of status phase, I would ditch the idea of having a lawyer. And yes, barbeque Weekend and booze on us!😂😂😂😂

Well I'm going to work in Schaumburg. I can help you with your change of status phase and you can save the money you would've paid for your lawyer haha.

Barbeque and booze sounds good haha
