I’ll have a new baby when I interview (due soon so likely around 6 months old when interview finally gets here if estimated processing times are correct). They definitely want to see birth certificates of children resulting from the union, so yes a bump will help. I’ve seen comments on here from some users who become emphatic and adamant that children and pregnancies are not considered at all, but that’s simply not true. USCIS states they do want to see birth certificates and documentation of pregnancies, etc. Not sure what “anyone can get pregnant these days” means as I’m pretty sure it works the same way it always has.

Make sure you/your sponsor makes enough for a household of three!

    Thanks

Ultrasound pictures, due date letter from the doc's office are good things to carry.

The baby bump should help with the bonafide marriage part. Still carry all evidence you have just in case they want to see it.

The officer may ask your husband about your doc appts.

You can bring in some snacks( given your condition) and water. There's a vending machine as well.

    Thanks

  3. Just put it all together and label it. For example, I would staple or paper clip the itineraries of all the flights it took to get there and label that, etc. Like stated previously, an itinerary is not proof that you went to the country; boarding passes are better but a passport stamp certainly is proof that at least you were in the country so just don't forget to include that. The proof that you two actually met and saw each other in person comes with other things such as ANy hotel receipts, purchases etc. while you were together is good as well. Include pictures and you should be fine. In these processes more is better. And start keeping everything! Literally.

  4. You should definitely be consulting an immigration lawyer. The way things are now in the US when it comes to immigrants and law offenders it is very hard and only getting harder with this administration. There are also two options for you to come here: K1 visa as her fiancé, that is when you would need a work permit while you wait to adjust your status; or with a spousal visa which might be better because once approved you would automatically receive your green card with that visa. However, no visas are gaurenteed, and your criminal record may be taken into account through both applications processes. Please consult a lawyer and good luck to you!

Yeah, I'm worried about it... I'll have a huge GAP between the interview and the day I wanna go... Like a month... Maybe I'll take a risk and hope for the best... Thanks for sharing your experience :)

Oh ok. well a month seems like a good time. I can't remember exactly how much time it took for him to get it back but you know as a couple who never did this before I definitely thought it would be right away lol. Also, my husband's embassy is not in his original country...he had to travel to Barbados and they had to send the visa back. That also might have caused delay we were not expecting. But a month certainly is a huge gap. Just make sure you have a good cancellation or change policy and you should be good if you're willing to take the risk. Good luck!

We just had our interview (in San Francisco) yesterday. I’m 6 months pregnant. The IO did ask us if we had documentation of the pregnancy: we brought an ultrasound photo to include in our evidence.

Great! Hope all went well! Thanks. We definitely will include the ultrasounds and our baby shower actually is right before our interview so will definitely include pics from there as well.

technically you don't need to a new medical exam if you already took it overseas and it's marked complete.  BUT some poorly trained officers expect you to have a new medical, it's all really luck at that point.  If you have your DS-3025 it should be enough. worst case scenario they will tell you you need a resubmit a new one. it's up to you if you wanna do it now or after. but most of us do get approved with the DS-3025 alone.  All I can do is hope you get a very experienced officer.

Being prego might help, i dunno since anyone can get anyone pregnant these days lol. but maybe perhaps make sure you/whoever your sponsor is meets the required poverty line with baby to come?

haha yes anyone can get pregnant these days lol. I was telling my husband its kind of good and bad only because they really is no way to prove that he is the father as yet lol. and thanks for the advice about the income level/ I am pretty sure I am good but I did not think to check so thanks

  8. it is certainly a risk. you need to have your visa and passport physically in hand before you go and even if you are confident you are going to receive approval you cannot be sure of when your visa/passport arrives. This happened with my fiancé and I am glad we did not rush and buy the ticket before hand just to be cautious. We were confident he would get approved, which he did, and I certainly was ready for him to come like a week or two after and we were ready to purchase the ticket but his visa took longer than he had expected to be returned to him. Not sure how much cheaper it would be for you, but if you really want to I would just advise to be sure you are aware of cancellation/refund policy or the policy on changing the dates on your ticket.

  9. My husband just received his AOS interview date! His interview is next month. What should we expect? We live in NYC and will be interviewing in NYC.

Does my husband need a new medical? He completed medical and vaccines for his K1 visa in August 2018 and submitted them at port of entry October 2018.

any one go or know of any couple who went to the interview expecting or just had a baby together? I will be 7 months pregnant when he interviews...I'm assuming/hoping that would trump a lot of questions being asked lol

Some other things to throw in there in a pinch, on top of adding him to all of your bills:

    - cell phone bill

    - authorized user on your credit cards (will also help build up credit, requires SSN)

    - shared memberships like Costco

    - insurance documents (not just medical, but life insurance, pet insurance, etc.)

    - any 401k/benefits where he's the beneficiary

    - USPS Informed Delivery for both of you at the same address

    - if he has a valid driver's license (even from another country), add him as a second driver to your auto insurance if you drive

    - letter from your landlord that he's cohabitating with you and that the landlord is aware (others touched on this)

    - affidavits from friends or relatives that you live together merrily

    - even some silly things if it's looking thin--a library card in his name and address, a Starbucks gift card to your address that he uses, etc

Oh great. Thank you for these ideas

To apply for AOS you do not need to submit another police record check like you did for the K1 interview regardless if you have a criminal record or not.

What you DO submit with AOS is certifed police arrest reports or police incident reports and certified final court dispositions for all and any crimes IF you have answered "yes" to any question in Part 8 questions 25 - 45 of the I485.

If you do NOT have a criminal record at all, you would have checked "no" in Part 8 questions 25 to 45 of the I485 and not have to submit anything.

Read the instructions on the I485 in Part 8 "Criminal Acts and Violations".

Thank you. That makes more sense

That is technically true, although shared residency is important evidence for a bona fide marital relationship.  And failure to establish shared residency would raise suspicion, e.g., when your and your spouse's IDs show different addresses.

My interview invitation lists the following as suitable relationship evidence:

    • Tax returns
    • Bank statements
    • Insurance documents (car, life, health)
    • Property documents (car, house, etc.)
    • Rental agreements
    • Utility bills
    • Credit cards
    • Contracts
    • Leases
    • Photos
    • Correspondence
    • Any other documents you feel may substantiate your relationship

    Okay thank you

  13. 7 minutes ago, Khallaf said:

that is rough, other then the utility if you need other evidence is to make a living will together with the joint address, updating him on your heath insurance, adding him to life insurance as beneficiary,

Yes, okay. Thank you I will start with adding him to the utility bill and setting up our joint bank account and other things like that. Thanks

  14. 3 minutes ago, Khallaf said:

you can call up all the utility companies and have your husband added to those account, I would also get your landlord to provide a written statement as to why he is not allowing your husband to be added to the rental contract.

I have a landlord who added my husband and he wasn't even in the USA to sign they used docusign.

    Oh okay. Thank you

Yeah he told me he can't add him to the lease as yet because he had no verifiable income, so technically it's just me responsible for the apartment. Or he would add him as 'john doe'

  15. Hi,

So I know we have to show proof of residency here in US now that we are married, but I am wondering how to do that? We do live together. My landlord told me he cannot put my husband on the lease since he is not working and cannot provide any income documents. All our bills are in my name as well. So how can we show proof of residency for him if he's not on the lease and we have no shared bills or none of the bills are in his name at the moment?

  16. Hi,

My husband (previously k-1 fiancé) is applying to adjust his status now that we are married. I was reading on the USCIS website that one of the documents to send in is copy of police or court records of criminal charges, arrests, convictions (if applicable). He hasn't been arrested or convicted of anything, and got a copy of his record from his police department before he went to interview for his visa. Does he have to receive another one to submit with the AOS documents? Because that would be virtually impossible since he's not in his country anymore and he gave the copy of his record when he arrived to immigration at the airport and he did not receive it back. So, is it necessary to have one for the AOS?

If you clicked yes on the DS 160 then you should be getting it but i recommend you going to your local office to make sure they're doing it. Sometimes they don't.

I entered on a spouse visa and went to my local ss office a week after i entered the country. It was already in the system. Received it in the mail 2 days after visiting the local office.

ok thank you. I do not remember what we put on the DS 160 so i am not sure. i guess it will be in process if we did and he will find out when he goes into the office.

Go to a local SSA office and apply for one. No fee. Bring a copy of your I-94 (you can get this online and print it) and passport.

The two week wait is mostly outdated. It should be in the system within hours now, but I usually suggest waiting a few days anyway.

okay thanks. My fiance entered last thursday so it should be in the system by now?

So how did everything go?  Were there any issues at the port of entry?

Everything went great! Flight came in early and he was cleared and out in probably 30 minutes. He called me just as I was getting in my car and was like where are you lol so it went smoothly and quickly. thank you for asking.

He also mentioned that the officer didn't ask him much..just why he was here, how we met, and where i work.
