    The have received my RFE response almost 60 days ago. There is no update on the website.

     

    I am just afraid that they would send me a denial later claiming that they never received my response... (USPS says my package was delivered...)

    We got our approval on December 2nd and after a week, we still had not received the EAD card in the mail.

     

    So we called a Tier 2 officer every other day asking where/when the card will be sent. They kept telling that it can take 60 days and that we should just wait.

     

    I decided to make an Infopass appointment, which took 2 weeks because there were no available appointments. My wife had a job offer waiting for her to get her EAD. We thought making an appointment to see a live person would provide us with something she can use in the interim to work.

     

    APPARENTLY, the office that did my wife's biometrics sent them ONLY for her i485 and did NOT also mark that the biometrics were for her i765, even though we were filing for both and it stated on our biometrics appointment paper that it was for both. So they did not print her EAD card.

     

    There was NO WAY I would have known this if I had not made an Infopass appointment. The officers over the phone and the ones handling the emails were all useless. NONE of them had told me this had happened. This would have gotten sorted out WAY sooner if ANY of them had truly cared about our case. We received 0 notices that we were missing our biometrics for her i765.

     

    So it goes to show that even if you do every step perfectly, USCIS can still mess up processing your case, fail to tell you that your case is being held up, and then do nothing to compensate or accommodate their OWN MISTAKE after you go out of your way to meet them in person.

    If anyone else got an approval notice and hasn't gotten their card in the mail after a week, MAKE AN INFOPASS APPOINTMENT ASAP and save yourself from the stress and headaches I had to go through.

    Interim EAD[edit]

    An interim EAD is an EAD issued to an eligible applicant when USCIS has failed to adjudicate an application within 90 days of receipt of a properly filed EAD application or within 30 days of a properly filed initial EAD application based on an asylum application filed on or after January 4, 1995.[1] The interim EAD will be granted for a period not to exceed 240 days and is subject to the conditions noted on the document.

    An interim EAD is no longer issued by local service centers. One can however take an INFOPASS appointment and place a service request at local centers, explicitly asking for it if the application exceeds 90 days and 30 days for asylum applicants without an adjudication.

    I think not. The NOA is going to be the letter you will receive.

    Good luck! I am 91 days. I have been thinking about raising an SR or calling them for weeks. But then I thought: "maybe today is the day". No, it never was. Today is no exception: Informed delivery says I will be receiving some ad soon.

     

    Just a side question in case anyone knows, because I requested expedition, there is a "Next Steps":

    You can file I-765 again within 90 days before the current EAD expires for free.

    Is it the only thing required to request expedition, right?

     

    (And the reason, which is financial loss for us).

    Just spoke to a Tier 2 officer— apparently my case was assigned to an officer to be ready for an interview on December 12 :) he said the appointment notice will be issued 30-45 days after this day so 1/11-1/25 I will know when my interview is. Yay!

     

    Does anyone know when the actual interview is from the date that the interview notice is issued?

     

    online never updated by the way and ironically I never received my EAD stuff lol even if I receive it, it will only be good for a month or so...

    How did you get to talk to T2? Any tips? My time line is really close to yours and I was never able to get any information on the phone. I was never able to talk to T2 offer as well. Thanks!

    USCIS received my case on October 19. My EAD and AP were approved on 12/18, received my NOA2s in the mail on Dec 23. My combo card arrived yesterday! Now for the fun part - finding a job :)

     

    How many of you are already in the process of interviewing?

     

    ETA: I should also mention that we were not required to attend an interview, and that my online case status has not updated since my biometrics.

    Wow, are you the fastest among October filers, in EVERY aspect: I mean EAD and AOS. Congratulations!!

    Just talked to USCIS. It's been a month and half since they received my reply to their RFE. They said it is normal  not to hear back from them until 60 days. So for those that are with more than 60 days, you might be qualified to ask them to confirm that they received your RFE...

    When you request to expedite on the phone to USCIS you will be asked on which basis.....financial hardship was our reason.
    But your HR can just call and ask if it is possible to expedite with a job offer and hopefully not get a newbie who gives wrong information.
    Then you take it from there and HR will be happy that it's possible. The process takes about 2-3 weeks, depending on how fast you respond
    to their evidence request of the job offer itself and the financial hardship. We submitted a recent car loan, cc statements and a short letter
    explaining the situation.

    Thanks! I will add that. I am just not sure if he would call USCIS as it is their legal department's job to provide him with legal advice. I am just afraid that he would not go against their lawyer's advice and do his own research with USCIS. We are living on our savings so there would be financial hardship if USCIS keeps not giving me the EAD... Maybe the EAD is on its way to me. I am on 85 day mark and just raised an SR.

     

     

  15. Hi Guys,

     

    The HR of a company just called and offered me the job I applied for. Now he is talking to their legal department and was advised that it would be difficult for me to convince USCIS to expedite my EAD application, which is apparently not true according to VJ data here. So the HR is a little reluctant to move on even though I ask him to give me a written job offer so that I can request the expedition.

     

    I suspect that their lawyer might not be too experienced with K-1 -> AOS cases. I have told him everything from the beginning of the job application. But now what can I do? Please advise... (I suppose I cannot just ask the HR to check VJ as it is not official USCIS.)
