  1. Hello guys, 

    we have been working on our RFIE from my previous post here: 

     

     

    I want to double check with you guys what documentations I need to submit as I really don't want to mess this up. Here is what I have so far: 

     

    0. complete and signed i-864 ( joint sponsor )
    1. proof us U.S Citizenship ( joint sponsor )
    2. complete federal income tax return for last 3 years ( joint sponsor )

    4. copy of all RFIE pages

     

    also mentioned on RFIE was: 
    4. w-2s, 1099s, form 2555, tax schedules (most recent tax year) 

    5. IRS form 1040 

     

    My Questions are: 

    Do I need all (4.) ? what is tax schedules? 

    Is (5.) same as (2.) ? 

    Do I need to include my (petitioners) i-864 again with more evidence and pay stubs? My sponsor makes over what he needs to make and I don't think I qualify yet since I still haven't been employed for 6 months yet.

    Anyways,

    It was only after I re-assembled our  papers with our  2018 Return  that I understood  the significance of "the most recent Tax Return".

    I have not been around a long time here on VJ but I have a hunch USCIS  doesn't  like  asset applications unless they are far, far  in excess of the  requirements.  

    Our timing allowed us to go on income alone by the time we got the 2nd RFIE so it -fortuitously- worked out well  as we could submit the 2018 Return.

    So much easier putting the package together. Documenting assets and length of time ownership, it gets crazy after awhile.

     

    Still waiting for our AOS decision. Ned 

    what do you mean second RFIE?

    Not a problem at all. That's why I said submit all of your paystubs thus far and 6 months down the line when you have the interview you can submit even more evidence. You will be good so dw. The job offer letter with the pay stubs would be great.

    Looking at your post, it seems as though you didn't meet the requirements? Does your job [now] make the requirement? If not, it is best that you get a co-sponsor to help you out get exactly what it states in the letter. I would get the last 2-3 years tax returns, last 3 months pay stubs, a letter from employer(s), etc.

     

    This will put a hold on your EAD/AP until you get this sorted out.

    Hello, yes I make the required income over 2 times more. However I have only been employed for 3 months so far. 

  5. Hello guys, so we did end up getting a Request for Initial Evidence regarding our AOS application. I will attach photos of what they are asking for. Please can you help me what I should include in my response? I just want to be extra careful with this so decided to post for extra help. 

     

    Also on the same day we received the Biometics appointment letter. We should attend this normally, right? The RFEI is giving us 87 days to respond, should we respond before our Bio appointment on the 29th of March? 

     

    Additionally, does this delay our AOS or does it delay our EAD and AP as well? 

     

    Here is what I included on my Affidavit already: 

    -affidavit

    -proof of citizenship

    -letter of explanation on why i wasn't required to file taxes

    -letter from employer

    -job offer letter

    -pay stubs of only 2 months (the reason why I probably got RFIEd)

  6. Hey guys we filed on the 24th and just got text messages that they received it on the 27th!!! Does this mean i am still a feb filer? Or is the noa1 date the one that notates that? 

     

    Also I sent to the priority mail address with FedEx.  Maybe those of you who are waiting longer send it via usps?  Just a thought. The usps address goes to a po box while the priority mail actually gets signed upon received.  

  7. Hey guys so after reading all the instructions to aos and i864 I think I am finally ready to file!!! Here is a list of required docs I compiled while reading the instructions for the two forms. Please let me know if you see something missing or give me the A OK  :) I would really appreciate it.

    -cover letter 
    -g-1145
    -form i-485
    -I-797 approval receipt
    -2x passport style photos 
    -passport bio page (copy) 
    -birth certificate (copy) 
    -birth cert translation
    -passport entry stamp (copy) 
    -k-1 visa (copy) 
    -i94 (e-copy)
    -marriage cert (copy) 
    -affidavit of support
        -copy of bio page of passport
        -employment letter
        -pay stubs of previous 6 months
        -letter explaining why no tax returns

  8. Also a couple of last minute questions before filing!!! (I can't believe I'm finally saying this, haha) 

     

    1. About the USCIS online account number. I really don't remember if we got one. Does the k-1 visa ever require you to make an online account somewhere? Is it the thing where we were checking our WAC Numbers Progress online? 

    2. When they say "Copy of Passport" Do they mean just the bio page, stamp page, visa page, etc. or do they actually want all pages? Even the blank ones? 

    3. Police records are only required if there has been police involvement or do we need a statement declaring that no police records/no crimes? 

    4. Lastly, for the Birth Cert Translation, Tax Return letter of explanation, and Employment letter, are these supposed to be originals or photo copies? 

     

    Sorry for the many questions but as soon as these get clarified we can finally file! :dancing:

    It would look better.  Thankfully you're not a consulate that is super strict about it but it would look better. 

    So i Have worked just 4 months so far and I don't know if 4 months of work will look better since it will be a small(er) amount 😕

    Don't leave it blank.  They've changed the instructions so yes N/A would be appropriate.   You'll need to include an explanation of why you weren't required to file those tax returns.  Right now 2017 is the most recent but if you've filed 2018 go ahead and use it.

    2016, N/A

    2015, N/A 

     

    Like this? Since I was unemployed during those years and only got employed in 2018?
