    yea I'm trying to see if i can call our doctors to have the emergency contact info sent to me . that's my next step. 

    thinking about the affidavits too but i feel like they might work against it actually since I am low on evidence and they mind find it fake-ish? 

     

    unfortunetely don't have POAs and wills

    yes the lease is actually very detailed, with what is required of us to pay, amount, what is provided in the apartment etc. has both of our names on it and the date it went effective. 

  4. thanks guys for all the help, even though I haven't had the time to reply to it all, it has been really helpful. So far i was able to get a lease agreement from my brother. Asked him about it and he already had one ready in file! Together with the lease agreement should I put in a letter of explanation that we live in his property? or the lease typed out by my brother is enough? ty

    You need something proving that you need together and there's nothing here. Do you have driver's license with the address or bills on your name/address?

     

    Do you have each other on 401k or life insurance?

     

    I don't see what the trips to visit his family show in this? 

    how many photos should i go for? is it ok if its separate documents with our address? or we need one document that has both our names and addresses? 

     

    currently don't have a 401k

     

    i thought travel and reservations are a good indication that we are together? since we traveled together both times

    Currently not employed due to the covid setback. We were also overseas for about 6 months not long ago so that delayed the jobs finding. Neither of us drive and we keep our credit carts separate. can i just add him to mine now? or is it too late?

    we are getting ready to file my husbands i-751. I have the packet ready and was wondering if you guys can help me with figuring out if it looks complete or if I need to include more evidence etc. 

     

    Here's what it looks like so far: 

     

    -Money orders for biometrics and filing fee. (we have yet to do this, do we need 2 separate money orders? or add them up into 1?) 

    -cover letter

    -i-751 completed and signed

    -2 passport style photos (do we need these?) 

    -copy of his conditional gc front and back

    Evidence:

       -2019 and 2020 taxes filed jointly

       -36 photos with my husband and I spanning between when we first met until this x-mas

       -copy of marriage cert

       -e-tickets of our trip to his home country from 2019 (both ways) with both our names in it

       -e-tickets of our trip to his home country from 2020 (one way, cant seem to find the ones for the way back)

     

    This is all  we have so far for evidence. We live in a rented apartment that's owned by my brother so we don't really have official leasing etc. and don't own a car. We don't really have any join accounts either. 

    I read that some people include affidavits from friends/family regarding the relationship. Do you think we need to do this? 

     

    Is what I have so far enough evidence? Or do we need to do more digging? 

  8. Hi guys, we were going to submit our RFE documents per our deadline on April 9. They requested a new sponsor or more documents such as taxes so since I have more documentations and we didn't have luck finding a co-sponsor I was reapplying my information as my husbands cosponsor.. However today I was laid off. Please help, not sure what I can do in this situation. 

  9. Hi guys, 

    I have a couple of questions regarding my most latest RFE for my husbands AOS. I hope some of you can help me out. 

     

    First and foremost we went through an extremely hard time from December of last year and then now what is happening has really gotten us behind with replying to this RFE. The deadline is April 9 and before I send of the documents I wanted to ask a few questions. 

     

    Short story and RFE history: 

    -March of last year we applied for AOS. We received IRFE as I didn't have enough employment history to be a sponsor for my husband (3 month pay stubs only). We were asked to get a sponsor. We did and submitted the package. 

    -On October we had our interview, the interviewer told us he would approve us on the spot except the overseas cs had filled out my husbands medical form incorrectly so he gave us an RFE and asked us to re-make it. At this point our co sponsor had lost their job so they withdrew their application. We also let the interviewer know that since now a few months had passed and I had a valid amount of employment, I would like to be the sponsor. He said "yes it is fine" and when I offered him my updated Affidavit he said he didn't need it and just wrote a note. We re-did my husbands medical and submitted the package. 

    -January we received our 3rd RFE. It is saying that the CoSponsor has withdrawn their application and asking for a new co sponsor and/or a petitioning sponsor. Our deadline is April 9. 

     

    Here are my questions: 

     

    1. I saw USCIS has extended RFE's due to covid-19 by 60 days. Does this apply to cases with a deadline during this time (March-May)? Or only brand new issued RFE's?  https://www.uscis.gov/news/alerts/uscis-expands-flexibility-responding-uscis-requests

     

    2. For last year I didn't have any taxes to submit, so I didn't. I sent in my PayStubs, letter from employer, and letter of explanation why I hadn't filed taxes. This got me the first RFE. Now I have been employed with a new employer since Last Month. Last year I made above USCIS poverty guidelines and I have my taxes from 2019 to submit for this. Do I need to include PayStubs from my new job? Is it a problem that I have only been in the new job for 1 month? 

     

    4. I just noticed that my Passport expires this April 20... As a petitioning sponsor I will need to provide proof of US Citizenship but since I was not born here I do not have something else. Is a fast approaching Passport expiration a problem? 

     

    5. Lastly do you think we can get this approved with me as the only sponsor? I can provide w-2 and tax documents from 2019. I can provide the paystubs from the past month and also a letter from the employer. Do you think this will be good enough for approval? What else should I include in my packet. 

     

    6. Additionally I am afraid that since this is the 3rd RFE they might deny us if we miss out some information or they don't approve me as the sponsor again. In that situation, would they re-issue a new RFE or just deny the case?

  10. Hey guys just wanted to update I received my EAD/AP combo card today. I have put a mini timeline of the expedited process on the comments to my EAD timeline.  Please take a look if you are still in this process 😊 

     

    sidenote: PLEASE contact your representatives to help with this! I would still be waiting if it wasn’t for their help! Can’t put into words how grateful I am for their help. USCIS told them even after I had faxed them the documents, my file was still with the regular timeline piles and not to be looked at in MONTHS until senate pushed for it to be placed on someone’s desk. Also my representative told me that the national benefits center is one of the only centers that listens to them *hinthint* 😉 

  11. New Card Is Being Produced

    Woohoooo 😍😍 my Senators office told me that they really had to fight the NBC to push my case at the top because even though I had put in an expedite, my case was still on the normal processing times piles. He literally had to call his person at USCIS and tell them he want's to speak to their manager who in the end took my file out of the load and put it on a desk!!! I’m proud of my senator haha!  I suggest you guys push them if you are still stuck on this. 

     

    On another note, I only got an update online on the EAD and not AP but I was aware that they come together. For everyone else that got the card, did it come as EAD / AP combo or just EAD

  12. Hey guys, I have put in an expedite for my EAD based on a job offer. I contacted my senators office and this is the response he got from the NBC

     

    "Name: XXX Number: MSCXXX Form: I-765
    Thank you for your inquiry regarding this constituent’s immigration matter. We have requested the file be reviewed by an officer, once reviewed your constituent should receive a decision or notice of other action within 30 days of the date of this notice.We hope the information provided is helpful. If we may be of assistance in the future, please let us know."

     

     

    has has anyone ever received a similar update from the national benefits center or USCIS? Do they usually hold true to this or is this one of those copy and pasted responses? 

     

    Does this mean the expedite was approved?

    I am am a bit confused if this means the expedite was approved or not. Did anyone else’s receive an update like this? Do they really take 30 days to review?

    Does anyone know if "you will receive a decision or notice" means a decision to the expedite or a decision to the EAD? Does this mean Expedite request was approved?

    Fax never worked for me... I tried multiple times from morning to the evening, so I just mailed it, at the same time I contacted with congresswoman office, so I'm not sure which one worked for me in the end 

    Fax wasn’t working for me either from FedEx. I tried 3 times, it just said busy. Then I went to Office Depot, crosses my fingers, and it went through. I had no idea we could mail it so I was pretty scared. 

     

    Ill call congress or senate next week to have them follow up in case it helps...

And make sure you quantify the financial loss (For my case, I anticipate another 4 months to get EAD if follow the normal EAD processing time, that means $ XXX amount of loss in total, and also 401K, bonus, etc.).

    Thanks so much! I will add your suggestions about the amount lost if the job gets denied. How long after faxing did you get to hear from them?
