I was married in 2013 and have my 10yr green card. During the marriage I had a child with someone else in 2017. My ex and I tried to work things out but when covid came he decided it was time to move on. Partly because I told him my child was mine and only mine. In 2021 we officially got divorced. Will they hold it against me for having my son. I get along real well with my ex.

In general, you must file a Federal gift tax return (IRS Form 709) if you gave someone more than $15,000 during the year. In some cases, you are required to file Form 709 even if your gift was below the $15,000 annual exclusion. Note that only individuals are responsible for filing gift tax returns — corporations or trusts that make gifts will pass the filing and payment responsibilities onto their individual stockholders or beneficiaries. Additionally, a married couple cannot file a joint gift tax return.
Form 709 is an annual return that is due by April 15 of the year after the gift was made. While this is the same deadline as the individual income tax return (Form 1040), the gift tax return must be filed separately. You can request a 6-month filing extension for your gift tax return with Form 8892 (Application for Extension of Time to File Form 709 and/or Payment of Gift/Generation-Skipping Transfer Tax). Furthermore, if you use Form 4868 (Application for Automatic Extension of Time to File U.S. Individual Income Tax Return) to obtain a tax extension for your 1040 return, you will automatically receive an extension for Form 709.
2018 Instructions for Form 709 United States Gift (and Generation-Skipping Transfer) Tax Return
Who does not need to file. If you meet all of the following requirements, you are not required to file Form 709. You made no gifts during the year to your spouse. You did not give more than $15,000 to any one donee. All the gifts you made were of present interests.

Today I received the I-797-c for my wife's 10 yr old daughter. My wife already has her 10 yr green card. Under You must bring everything I understand except the one for supporting evidence of your relationship, such as copies of any documentation regarding joint assets or liabilities you and your wife may have together. This may include tax returns, bank statements, insurance documents, property documents, rental agreements, utility bills, credit cards ect..... does this apply in this case, since wife has already got her 10 year green card. Should I just bring everything we sent plus new documents or does this not apply to the AOS of a minor and refer to if we were adjusting my wife's status. I am wondering if this is just a form letter and they are just listing everything as if it was for marriage based.

Yes, I sent in the IRS Tax Transcripts and I-1040, only thing I did not see was a 1099 since when I sent everything in I had not amended my taxes as of yet. Everything else was sent,. Letter from both employers, 2015, 2016 and 2017 tax transcripts, w2's from both jobs, bank statements for the previous 12 months. Go figure. I will just resend everything again.

Just received an RFE for the I485 stating I do not make enough income and to resubmit my supporting documents. Does this mean they lost my original documents. Last year I grossed 71000 adjusted on line 22 of the I-1040 and this year alone I have had 54000.00+ dollars deposited from in earnings into my bank account. The RFE stated I did not make enough above the poverty line which is funny due to the fact that I take home 1100+ a week after taxes and the 2018 poverty guidelines stated I need to make 47,575. To-date I took home 38,500 after taxes from job 1 and 13,865 after taxes from job 2 for a total of net 52,365 with 17 weeks left to go for the year. At the current rate I will make another 18,700 for job 1 and 5,950 for job 2 for a total of 24,650 and if you add that to what I already earn if would be 77,017 net after taxes which is almost 30,000 dollars above the 2018 Poverty amount of 47,575.
I am wondering if I should have included my 1040 instead of the tax transcript because looking over the instructions I noticed the following.
If you provide a photocopy of your Federal individual income tax returns, you must include a copy of each and every Form W-2 and Form 1099 that relates to your returns. Do not include copies of these forms if you provide an IRS transcript of your Federal individual income tax returns rather than a photocopy unless you filed a joint income tax return with your spouse and are qualifying using only your income.
When I went through my original I-864 I noticed a slight mistake should I resubmit a new I-864 or just send the tax forms, w2's, 1099,s ext.. that they are asking for. If I can resubmit the I864 should I include my wife and submit a I-864a with it.

According to her own embassy she will need a letter of no objection for the child to leave India from the other parent regardless if she has full custody unless she has a court document stating the daughter can leave the country

A month before we applied for roc we created a will for both, power of attorney and health care proxies. I added my wife as a non driver to my car insurance and she got approved.

I am helping my Stepdaughter fill out the I-751, I am the USC, on part 4 do I need to put my info or my wife's info. The problem is if I need to, I do not want to sign the form. I do not want to consent to my fingerprints or biometerics I find it an infringement to my rights as an american. She came as a K2 and filed a year after her mom for the conditional green card.

According to the uscis website k1 medicals are good for one year. I know when my wife did her physical it had a 90 day expiration date on it but that was to get her visa. Her physical was valid for one year they do not go by the expiration date on. They go by the date you got you phsyical so if you got it done in june 2017 it will be good until june 2018. If i knew how to cut and paste i would cut and paste the web link to uscis on this subject.

I sent my wife 11.25 million pesos over 7 years and not once got scammed. They have been in the us since 2013. The wife and daughters aos and roc without any issues. They received there 10 yr gc this june.
We used citi bank. When i went over i openned and international account and just deposited the money in citi bank here and her issued a debit card.

Do you have both of their noa's from aos and do they have the same approval date on them. If they do i will upload a redacted letter i sent for my stepdaughter so you can see what i said. Both wife and daughter got therevten year gc end of june.

Did your wife and daughter file roc on same form together

What could have happened was the system did not show a clear print of just those fingers and they just scanned the fingers they needed.

When our packet was sent in three days before the date our daughters green card had the wrong date on it so my wifes and daughters roc packet got rejected and sent back to us with a blue slip. We resent it with explantion of green card issue and when they received it back they used her date it was originally sent.
My wife and daughter had no issue and received their 10 year gc 334 days later.
I would wait and resend it with the check. You should get a blue slip why it was rejected and they will.ask you to resubmit it.
I do not think you will have an issue.

It seems you forgot to mail the i-129f with your paperwork. When we aos my wife's 2 child we got an rfe because i sent her gc approval letter instead of the orginal i-129f aporoval notice. I mailed in the i-129f aporoval notice and 3 weeks later her daughter received her gren card.

It depends on your employer. Are they easy to speak to, you could explain to them you need more visits with your spouse to increase your chances in getting your spouse here. What is your company policy, where i worked i was allow to go visit my fiancee anytime i wanted as long as i had the vacation time. I get 7 weeks off a year so i was able to visit my fiancee twice a year.
I guess just be honest with your employer and let them know how important it is to you. You might have an employer who understands and it does not hurt to try.

It goes in cycles csc is up for months and vsc people complain, vsc is up and csc people complain it is all a vicious cycle. K1 vcs lagged big time and same results, aos vsc took a long time same results. Fortunately for roc it only took 334 days at vcs without and interview. Submitted july 26th approved june 27th green card arrived july 3rd. Through it all if your paperwork is done correctly eventually you will make it through the process.

If you are talking about your spouse came over on a k1 fiancee visa and you married before 90 days you file for aos not another visa. Once you file the aos your spouse will receive a noa form i-797c She is in status but can not leave the united states until she gets her gc or advance parole if you filed i-131 at the same time.
If she leaves prior to getting her green card or advance parole you would have to start a new process in order to get her back in to the us.

My wife waited 1 1/2 years to file aos and she just got her 10 year gc doing roc and she had no interviews for either aos or roc. In general you would want to do aos as soon as possible in the current climate. But i have yet to read or see any cases on people being deported for doing aos after 90 days.
I agree in our case we had x amount of money to pay for 5 aos's so we waited when we had the money for all five of them to adjust at the same time.

My wife applied for aos 1 1/2 after getting married and she did roc last year and she had no problems at all. She did her aos and roc and had no interview for either process. I be more concerned about getting married on day 89. Like previous posters stated anything can happen.
Also in current clim i wouldn't wait a long time to do aos.
