    Thank you, just having a look through yours now. on my check it says to bring i693 medical exam but i had a ds3025 in London for k1, is it the same thing or will i need a new one. it was october 2017.

    Well, unfortunately, she's going to have a problem at the port of entry. She is not supposed to visit when she has immigrant intent. I understand that you state that she will go home after her visit, but they just won't believe her.
    One of three things can happen if she tries and is not able to convince them:

    1. They will allow her to withdraw her request to enter the U.S. and she can go home, no penalty.
    2. They will not allow her to withdraw her request to enter the U.S. and will order her excluded. This has a 5 year penalty that she cannot come back unless she gets a very hard to get waiver.
    3. They will not allow her to withdraw her request to enter the U.S. and they catch her in a lie and they exclude her with a permanent bar due to fraud and/or misrepresentation and with that charge she cannot come back unless she gets a very hard to get waiver.

    So I wouldn't even try. Go visit her instead of her coming to visit you. I wish I had better news for you, but I am trying to keep her from getting in trouble and I hope you realize that.

     

    Considering everything I have read on this forum, his response seems harsh and doesn't align with the experiences detailed here on the forum.

    We would appreciate any guidance from people who have actually experienced the process.

    Now I'm not an expert but we visited the USA whilst I had k1 visa going thru and they didnt send me to secondary or anything. purpose of visit, visiting my fiancé. That was it, don't get too stressed!! Good luck in k1 process

  3. Hey all so I have my interview for AOS in May. I was wondering do I have to bring a copy of the X-ray cd that i got from my medical in london? Im struggling to find it! eek. Also I have this list, do I need anything else? 

    I cant wait to start working so I'm hoping i don't forget anything! 

     

    ·      The interview notice and photo identififcation

    ·      A completed medical examination (form I693 ) and vaccination supplementation (unless already submitted)

    ·      A completed affidavit of support i864 and  all required evidence unless previously submitted

    ·      All documentation establishing your lawful permanent residence status

    ·      Any immigration related documentation ever issued to you,

    ·      Birth certificate

    ·      Your petitioners birth certificate and petitioners evidence of US citizenship

    ·      All travel documents used to enter the USA ( NEW AND OLD PASSPORT) Advanced parole document (I-512) and i-94 (arrival/departure record).

    ·      Certified copy of marriage certificate

    ·      Copy of joint assets, bank statements,  lease, photos, copies of bills etc? Letter from parents or The apartment to say we are a legitimate couple

    ·      Police report?

    That sounds like a generic letter. Most who adjust status have been in the US and did not have a visa medical. Your K1 medical including immunizations is supposed to already be in your file. If it isn't, they will tell you at the interview to go get one. That way you will know exactly what you need before you go spend money.

  5. Hey all, so I've received this form for an interview next month. I moved here in November and on reading the form it says to bring a copy of 1693 medical examination and vaccinations? I already had a medical in London before I got approved for k1, is this what i take as I'm not sure?                                                                                                                                                                                                

  6. Hello all this is going to be a long question but I am hoping someone maybe able to assist me. So we filed for AOS last month and i just received an RFE for i765. 

     

    It basically reads this... 

     So this is what it says we need to do:

    - The sponsors household size on the petitioners form i-864 affidavit of support ( Revision date 07/02/15) was calculated incorrectly or not completed. A household size of o or 1 is not acceptable. the petitioner/ sponsor must correct / complete this and return page 4 of form 1-864. 

    -Submit all supporting tax documents (W2s, 1099s, form 2555 and all supporting document, submitted to the internal revenue service for the most recent tax year. the joint sponsor must submit all supporting tax documents for the most recent tax year. 

    - Based on the documents submitted with the form i864, for the joint sponsor, the income did not meet 125% of the poverty line for the joint sponsor household size. submit evidence of assists that meet the standards listed below or obtain a different joint sponsor. 

     

     

    So I'm confused. Because my husband was in England with me last year so didn't work in the US, hence why we used his dad as an additional sponsor. His dad lives alone in Georgia (So when it says a household of 1 is not acceptable, I'm not too sure because he is a household of 1). he earns 55k a year which is well above the GA poverty line.  Also we defiantly sent W2s for the last 5 years, a letter from his bank saying how much money goes in every month etc, letter from his job etc. The only thing I think it can be is that my husband and I moved to Florida (So will that affect the decision because were not in the same household?), my husband just found a job but when we filed he was just down as a student becausee he wasn't working at that time. I;m not sure if this is making sense, I'm so confused. Is there a number i can call them on?

  8. Hey all, so I had a letter today from USCIS requesting for more information. Its seeming that its all extra information for the 1-864 however I know that I put everything in the package that they asked for, so I dunno I'm kinda confused. I'm not sure if its because we put my father in law and my husband as a joint sponsor? Anyone had anything similar? 

     

    Also I was wondering if this will effect the time it takes me to get travel document and work authorisation permit or if they are processed separately as they are separate documents?

    Yeah thats exactly what I thought! So I was thinking just keep my maiden name and then further down the line I can change my name. Because also my social security number will be in my maiden name also. When do you move over hun? I'm in Chattanooga (90 mins from Atlanta) until January time. We could explore Atlanta together! :)

    The AOS guide under the 'Guides' tab is very helpful in outlining what you will need to file for AOS as well as EAD/AP. It is true that AOS and EAD/AP can be filed together in 1 package. The filing cost is currently $1225. 

    Things you can start to put together now are 3 copies of your I-94 (1 for each petition, I-485, I-765 and I-131), 6 passport photos (2 for each petition), 3 copies of the visa and bio/main page of your passport, copies of your birth certificate. You could also start working on the I-864 affidavit of support and the supporting documents needed for that (tax returns, pay stub, employer letter, ect).

     

    Be sure to include your DS-3025 vaccination proof from your K1 medical if you have it. If you don't have that or it doesn't list all of your vaccinations, you may need to see a civil surgeon to complete a I-693. 

     

    Once you get married, you will need 3 copies of your marriage certificate, 1 for each petition. 

     

    For the Social Security number, all you need is to fill out a Social Security card application (found on the Social Security website), bring that along with your I-94 and passport to your local social security office. You can usually set up a bank account with just Social Security card and passport, but some banks have stricter requirements than others, so you might need to look around. 

    Thanks very much for all your information, really appreciate it. Can i get a social security number straight away do you know? We have a lot of supporting evidence for the I134 that we used  2 months ago so we can use that and just print off a new  form?

  11. Hello Everyone! 

     

     

    I entered JFK last Monday on the 20th November using the K1 visa, 485my fiancee and I are getting married December 15 and before that I want to get all the paperwork together in order so we can just send it straight away so I can start woking ASAP. 

     

    I've read somewhere that you can file the I-485(AOS) , the I-765 application for employment and I-131 AP  all together, does anyone know what documents are required for each? or where I could find the info out. Can any of these done online?I really don't wanna miss anything because I wanna start working & travelling ASAP. 

     

    Also in the mean time when can i get my social security number and set up a bank checking account? What information would I need to take for that?

    Feeling you a thousand times over. Moving out is one thing, but moving to the other side of the world is another. It's so hard to say goodbye. Especially when it feels like you are choosing one part of your family over another. I just hope AOS goes quickly and I can come home and see everyone again asap!

    It really is so hard :( I think once AOS comes back it'll be a lot easier as we can come back whenever we want rather than the wait and not knowing. Hope you managed to sleep, I woke up at 5 am. We start travelling at 1pm our time to heathrow and then arrive in our final destination Chattanooga 5pm US time tomorrow. Eek Long day!
