The online status doesn't always update....that being said, however:

If I were in your shoes, I would ask to be transferred to a L2 and find out the status just to make sure if you're still wary---normally the regular customer service reps aren't able to access actual case details, as far as I know.

I will definitely do that. They did say they’re not able to provide me with more information but both agents i spoke to confirmed the application was approved.

You said you called and spoke to an agent (I assume an L2 officer), and that they told you that your AOS was approved...I'm going off of what you said earlier.

Yes i spoke to two different agents(called twice to make sure). They werent tier 2 they were just the regular agents, they both said the approval notice was sent to me and card was ordered. The only reason I’m a little confused is because my case status isn’t changing online.

Sometimes it updates right away, sometimes there's a lag.  I'm sure you'll hear something sooner, rather than later----in the meantime, kick your shoes off and relax for a little bit tonight, at least.

Update: i called uscis today and the rep told me i was approved yesterday around the same time i had my interview. I don’t know why io didn’t say so, online status still says interview scheduled

  4. Hi everyone me and my husband had our interview yesterday we didn’t get approved on the spot but the officer said to start checking the status online starting last night. My status still says interview scheduled so i called their cs number and the representative told me my case was approved yesterday around the same time we had our interview. My question is has this happened to anyone else? The io gave us a letter the case was still under review yet we were approved at the same time(thats what the rep told me).

I think the bolded part is a good sign....normally an IO won't delve into detail about how the green card works unless they were planning on recommending you for approval ;)

Thank you so much that really makes me feel better. The status still hasn’t changed from interview scheduled. Do you know if the case status updates regularly or does it take some time for it to catch up? Thank you.

  6. Hi everyone, me and my husband had our AOS interview today and the officer handed us a paper that our case was held for review. She explained how a conditionional green card works and said to give it two weeks to get a decision but also mentioned i should check the case status tonight for an update. She mentioned security checks. Do you think our case will be approved? The interview went well in my opinion but that paper kind of worries me though.

You have nothing to worry about. USCIS will not believe these people. Get away from them and change your number. Good luck!  It should only be about 7-8 more months. Just curious.... did you receive your EAD and AoS yet?

Thank you! I just received my EAD last week but no interview date yet. My pd is April so hopefully very soon

This is a difficult situation. The biggest concern is the blackmail. It has been well established (through history- and thats how we learn) that when someone gives in to blackmail it doesnt stop. Typically it escalates. If they scare you into giving them what they want, they most likely will ask for more and more. The best way to stop blackmail is to involve the authorities and not 'pay up'.

Now your attny is correct, if they withdraw their statements it is not in your best interest- but I highly doubt he suggested giving in to the blackmail was the best way to go either! I think the attny probably gave you 'legal advice' on what would happen if they withdraw their statements but didnt give you any advice on how to handle it.

Here are some suggestions- if you havent already disconnected their phones and/or prevented them from accumulating debt in your name do so immediately. Go to your local police department and file a police report as well as a small claims case against them for the money. Get new affidavits from other people and send a copy of the police report, small claims case filing and new affidavits to USCIS along with a letter stating what happened. Expect to get an interview from USCIS and/or USCIS to contact the new affidavit writers. If that all seems too scary for you an alternate plan is to have your attny write them (brother/sister in law) a letter explaining the legal consequences they can face for lying to USCIS. Most people dont realize how severe they are and just think- well I'll tell USCIS I lied and the immigrant will get in trouble. THEY will get in trouble for lying. Either because they say their first statement was a lie or USCIS determines their second statement was a lie.

The brother/sister in law are probably just trying to scare/bully you by saying this. If they do actually write a second statement that is false there will be consequences for ALL of you. A letter from the attny saying such might dissuade them from this, but honestly if they want to make trouble for you or threaten you they will find another way- so again the best action is to go file a police report, small claims case and if they harass you- a restraining order.

Its kind of hard for us to get new affidavits as we don’t have many friends, the only friends we have are his family and I don’t go out much and don’t have a job yet(just received my ead last week) so I can’t  really make friends.

Is it AOS (I-485) or ROC (I-751)?

I don't recall we need to submit affidavit from friend and family for AOS, but it may be needed for ROC if you don't have enough evidence to proof your marriage is legitimate.

Did they include the wording “I swear, under penalty of perjury, that the foregoing is true and correct to the best of my knowledge.” in that affidavit? If they did...then it's them who will face federal crime.

in the meantime, if you have other friends and families that know things about your marriage, maybe ask them to write the affidavit, just in case you needed during the interview

Its for I-485 it had to be sent along with our photos proving that our marriage is real.

Isn't there a statement on the affidavits saying that "everything is true to the best of your knowledge under penalty of perjury" or something like that?

Or is this not the I-864?

Not that I suppose it makes a difference at this point, it doesn't sound like they are very supportive regardless.

Its the affidavits for the aos proving that we’re in a real relationship not the sponsorship ones. They are sworn and signed too.

doubtful especially if you sued them and they tried to denounce their claim afterwards. and affidavits are pretty weak as proof of a bonafide relationship. Hopefully you have far better evidence.

im not the suing type. pay the bill and remove them from your life. hopefully you already cancelled the lines. this is why you dont add people onto your accounts. or loan money you can't afford to never see again.

I spoke to our lawyer about it and she said its not in our best interest and pretty much told us that immigration will listen to what they have to say about their affidavits which will affect us. However I don’t think its legal for them to retract true statements just so they can lie.

So they are black mailing you guys and will say to the government that they lied to them?

    Yeah good luck to them!

Take their phone numbers off your bill!

Yes they’re saying if we do take action they will say they lied in their affidavits. They also put us in debt which is unrelated to the phones and they won’t pay us that money either because if we take them to small claims court they’ll try to do the same thing.

  13. Hi everybody! Me and my husband send my AOS package in April and my husbands brother and sister in law were the people who wrote the affidavits since we lived with them for over a year and we were really close. They turned out to be really bad people and now they’re blackmailing us for paying their phone bill(they’re on our contract just added as lines). They refuse to pay their bill and say that if we sue them they’re going to retract their affidavits and say that they lied about everything they said initially (which is not true, everything in their affidavits was completely real.) My question is could that really affect my application?
