  1. K1 visa is only valid one time entry and only for 90 days. And she needs you to file for AOS after getting married to K1 visa petitioner.

     

    At this point, you don't really have to do anything since she's already out of status and if she files for anything, then, she has to spend $$$$$ for legal fees, or just cross the border and back. 

     

    Anyway, for spite, you can file a report to USCIS about your case. Regardless of it's priority of not, as long as you have paper trail, can save you from headaches in the future. Might not be necessary but if it will makes you feel a little bit better then why not.

  2. Regarding on his case, manslaughter and armed robbery you said, did any of this involved a minor under age of 18? There's one major exception for a US citizen/ greencard holder to petition is due to  2006 Adam Walsh Act. If his crimes didn't involve any minor then disregard first part of my comment.

     

    My next question is, when did you meet? Before he went to prison or while he's serving it? 

     

    Few assumptions might rise a few questions but what you really need to prove is the bona fide marriage. It's the intent and the actual relationship. These can be challenging to prove, since many limitations are involved. But that doesn't stop someone on marrying someone obviously.

     

    I humbly think, in your case, look at it in different perspective. Build your case by asking what makes this not to pass? Then, provide strong evidences that will support bona fide relationship and intent to marry. Your husband's incarceration is his circumstances, but the immigration proceedings is your circumstances. You need to prove that above all, you are not coming in the States under false pretense of marriage and in good faith, just happen to be married to him.

  3. I'm the Petitioner and my wife had a child who came in USA on K1-K2 visa. We had same-sex union and currently living here in Chicago, Illinois.

    Our child needs a last name change so that he is not the only one stuck with my wife's maiden name. Their I-485 AOS still pending at this time.

    I would like also to legally adopt him to tie all loose ends. No biological father involvement since gestational age (pregnancy). I just feel stuck

    right now. Does anyone has any input on the topic? I appreciate new light on this matter. Thanks in advance.

    I am having lots of impending delay, this friday is philippines' another holiday. 

     

    My situation right now is that our flight is this coming Saturday. With a delay like this will cause lots of financial burdens for me and my fiance. Instead of going to Manila for cfo requirement, we are considering our luck and we might get a chance for walk in process at Clark CFO Branch.

    As I track our case on the Nonimmigrant case tracker with the NVC case number, it says that its invalid. 

    But when I tried to track it on the Immigrant case tracker. I found our case status. 

    Should my fiance fill up the DS-160 or the DS-260?

    Congrats! You're on the fast track now.

    Go ahead and fill up DS 160 and then Print out the MRV, so that you can pay your visa fee to schedule your interview.

    Medical has no appointment, but make sure to have it 1-2 weeks before your scheduled interview.

    I'm always curious how people answer that given nobody knows the outcomes for sure, and it seems like people don't plan their weddings until after they get their visas in hand :)

    We got an exact wedding plans in place before even having our noa2. We are planning on handling over our wedding invitation to the consul on her interview if they ask for it. 😁 After all this, AOS next. Maybe we will be following new thread for sure.

    Yes, in about 2 weeks, petitioner will receive an official mail from NVC with NVC number, embassy where to go for interview. Then, depends on which country, 1 month after official NVC letter, you will receive packet 3 email instruction for payment, packet 4 email after 1 week, to schedule your interview. But usually, you will only receive these email when you already paid your interview visa fee. (probably, almost the same with other countries)

    Got a cool way to check your Eligibility so that you can set up your interview schedule right away.

    There are 3 possible results: "At NVC", "In Transit" and "Ready" (Meaning it has been received in USEM.)

    This worked, and it appears that the NVC letter date was the actual date USEM received the petition files from NVC. Hope this helps! Rock 'n roll!!!

    The first person I spoke with said email ask nvc. I did look it up and lead me to https://secureforms.travel.state.gov/ask-nvc.php . I wrote in the comment / question section. I told the #1 op several times the month-date-year. And even dd/mm/yyyy ; yyyy/dd/mm formats. She simply said: "Birth date did not match on file."

  12. Okay,

     

    NVC is driving me insane if not crazy already! First operator I spoke with said that DOB is wrong.

    I sent them a very comprehensive electronic email of complain, and then called them again.

    Put me on hold for 45 minutes and I stayed on the line. (I did stay on the line!!!!!)

    Another operator I spoke with easily verified the DOB with no problems. We finally got our NVC number

    and sending our case files over to embassy in few days. Why oh why do they need to do that?

    Making me panic. Someone needs to put out the sledge hammer! :bonk:

    We both are. I'm the petitioner. It's nice to have it plan like a month before, but it appears that with our case, its required to have plans already in motion before the interview. I guess that's the whole purpose of k1 visa. So, yeah, anything can happen here and there but October will still be a special day for both of us. It's nice to celebrate thanksgiving here in Chicago. If you're lucky, you'll get the chance to feel the snow. We sometimes get snow right after thanksgiving. If you get a chance, visit Morton Arboretum, trees are at their best color show. 

  15. I'm having hard time to decide what will be our final decision with our wedding day. Then, my fiancee suggested something and that opened up a whole new perspective with the wedding plan. All we want is to make it special for both of us and have some close friends to share our day with. Time to earn some serious cash, I want to see us both smillinh and carefree on our wedding day, and, a nice surprise for her before our wedding night! Still waiting for NVC case number, and its okay!! We can use the time to make the biggest step in our life--extra special.

     

    (I hope this can inspire you all March Whiners!) There are wedding bells waiting for all of us! Peace Out!
